The Good Friday Agreement: An Overview, Bertie Ahern Jan 1998

The Good Friday Agreement: An Overview, Bertie Ahern

Fordham International Law Journal

On 22 May, it received the overwhelming endorsement of the people of Ireland in referendums, North and South. For the first time, a precise mechanism has been defined - and accepted by the British Government - by which a united Ireland can be put in place, by the consent of Irish people and that alone. This involves setting up a new North-South Ministerial Council to develop consultation, co-operation and action within the island of Ireland on matters of mutual interest and establishing, as a start, at least six implementation bodies operating on a cross-border or all-island basis. The people, North …

Legality, Legitimacy, And Democratic Renewal: The New Assembly In Context, Colin Harvey Jan 1998

Legality, Legitimacy, And Democratic Renewal: The New Assembly In Context, Colin Harvey

Fordham International Law Journal

This Essay examines the structure and functions of the new Northern Ireland Assembly within the context of the constitutional changes in the Britain and Ireland. Since its election in May 1997, the new Labour Government has been steadily putting in place key constitutional reforms. The changes were widely discussed, both internally while the party was in opposition and externally within the scholarly community. The Labour Government came to power on a manifesto that promised substantial constitutional reform with an emphasis on decentralization and participation. It is evident that the change of government had an impact on the process in Northern …

Dash For Agreement: Temporary Accommodation Or Lasting Settlement?, Dennis Kennedy Jan 1998

Dash For Agreement: Temporary Accommodation Or Lasting Settlement?, Dennis Kennedy

Fordham International Law Journal

The same dilemma remains for those in Northern Ireland today who genuinely want peace, reconciliation, and stability, but who at the same time see in what is termed the peace process, if not deceit, then much glossing over, a lot of ambiguity, and a deal of bad history. In 1921 the new institutions in Northern Ireland, the regional government and Parliament began life under the fiercest onslaught from Irish nationalism, both within its own boundaries and from the rest of the island. It was also critical of the early peace process under which John Hume of the SDLP had commenced …

Affirmative Action, Ethnic Minorities And China's Universities, Barry Sautman Jan 1998

Affirmative Action, Ethnic Minorities And China's Universities, Barry Sautman

Washington International Law Journal

China greatly expanded its longstanding set of preferential policies for ethnic minorities in the 1980s and 1990s. Affirmative action in higher education annually allows for the admission of tens of thousands of ethnic minority students who, based on their national entrance examination scores alone, would be unable to gain a much sought-after place in one of the country's thousand universities. The variety of ways in which the admission and retention of PRC minority students are facilitated by laws, regulations and policies are examined, as are attitudes toward affirmative action on the part of Han majority and ethnic minority students. In …

God's Designs: The Literature Of The Colonial Revival Of Religion, 1735-1760, Allen C. Guelzo Jan 1998

God's Designs: The Literature Of The Colonial Revival Of Religion, 1735-1760, Allen C. Guelzo

Civil War Era Studies Faculty Publications

In December of 1990, after the completion of a section on Jonathan Edwards at the annual meeting of the American Historical Association in New York City, a dozen or so of mostly younger scholars of Jonathan Edwards swept around the corner from the convention hotel and settled themselves down to a staggering repast at a posh north Italian restaurant. In the midst of some very un-Edwardsean consumption, I offered a question to everyone around the table: What is the most important book which you've ever read on the Great Awakening? With only one exception, the Young Edwardseans gave the palm …

Writing Across The Curriculum Efforts At Northern Arizona University's School Of Forestry, Jon A. Souder Jan 1998

Writing Across The Curriculum Efforts At Northern Arizona University's School Of Forestry, Jon A. Souder

Natural Resources and Environmental Issues

The objective of Writing across the Curriculum (WAC) in the School of Forestry is to build critical thinking and writing skills throughout the duration of a student’s program. The program, as it has evolved over the last four years, has resulted in more writing assignments in classes where previously little had been required, a movement from descriptive to analytical writing by the students, and finally, a demonstrable improvement in student writing abilities. Success has been due primarily to four key features: (1) a revision of the Forestry Professional Program prerequisites, (2) revising the Forestry curriculum both to increase the amount …

Engineering The Middle Classes: Class Line-Drawing In New Deal Hours Legislation, Deborah Malamud Jan 1998

Engineering The Middle Classes: Class Line-Drawing In New Deal Hours Legislation, Deborah Malamud

Faculty Articles

The likely readers of this Article work for a living, or are studying with the hope that they will work for a living very soon. Unlike many other workers in this society, they do not (and will not) get paid time-and-a-half for overtime. In this Article, I tell the story of how upper-level white-collar workers - people like the intended readers of this Article - came to be exempt from the Fair Labor Standards Act's general overtime rules. My purpose in telling this story is not to participate in the debate on whether the so-called "white-collar exemptions" to the Fair …

William Ockham And Trope Nominalism, Stephen E. Lahey Jan 1998

William Ockham And Trope Nominalism, Stephen E. Lahey

Department of Classics and Religious Studies: Faculty Publications

Can we take a medieval metaphysician out of his scholastic robes and force him into a metaphysical apparatus as seemingly foreign to him as a tuxedo might be? I believe that the terminological and conceptual differences that appear to prevent this can be overcome in many cases, and that one case most amenable to this project is the medieval problem of universals. After all, the problem for the medieval is, at base, the same as it is for contemporary philosophers, as for Plato: How do we account, ontologically, for many tokens of the same type? If one object has the …

Beyond The "Band-Aid" Approach: An Alliance Party Perspective Upon The Belfast Agreement, Stephen Farry, Sean Neeson Jan 1998

Beyond The "Band-Aid" Approach: An Alliance Party Perspective Upon The Belfast Agreement, Stephen Farry, Sean Neeson

Fordham International Law Journal

In the absence of a ready-made solution that could be adopted by the people of Northern Ireland, or a magical formula from the British and Irish Governments, the only alternative lay in locally-mandated political parties negotiating a political agreement. This alternative in turn entailed a common recognition that the zero-sum politics of "winner takes all" ultimately leaves everyone a loser. An accommodation, while requiring each party to sacrifice some of its aspirations, stood to benefit Northern Ireland society as a whole.

'Constructive Ambiguity' Or Internal Self-Determinatinon? Self-Determination, Group Accommodation, And The Belfast Agreement, Christine Bell, Kathleen Cavanaugh Jan 1998

'Constructive Ambiguity' Or Internal Self-Determinatinon? Self-Determination, Group Accommodation, And The Belfast Agreement, Christine Bell, Kathleen Cavanaugh

Fordham International Law Journal

This Essay examines the Belfast Agreement (or "Agreement") in the light of international law on self-determination and minority rights. Northern Ireland cannot be evaluated in a vacuum; already it is being suggested that the Northern Ireland peace process and the formula devised in the 1998 Belfast Agreement may serve as a model for other divided societies. Indeed, this possibility was raised by President Clinton during his September 1998 visit to Belfast and was reiterated by the U.N. High Commissioner for Human Rights on her more recent visit in December 1998. International law claims to address many of the issues central …

Let's Get It Started: Teaching Teachers How To Implement A Culturally Relevant Pedagogy, Jamal A. Cooks Jan 1998

Let's Get It Started: Teaching Teachers How To Implement A Culturally Relevant Pedagogy, Jamal A. Cooks

Trotter Review

In today's American schools, many teachers are faced with the problem of keeping African-American students engaged in the lessons taught in pre-K-12 classrooms, a problem which at times leads to low academic performance. According to data presented in the 1994 National Assessment of Educational Progress, 48% and 66% of African-American students scored below the basic competency level in reading and mathematics respectively. With many African-American students being labelled "not proficient" in some academic content areas, a growing achievement gap exists between African-American and European-American students. This gap contributes to fewer African-Americans 1) gaining access to institutions of higher education; 2) …

Ebonics, Local Color, And Official Language: Who Resists Whom?, Richard L. Murray Jan 1998

Ebonics, Local Color, And Official Language: Who Resists Whom?, Richard L. Murray

Trotter Review

At a time when the media has branded Ebonics "a second class language for a second-class life" and worse, a time when politicians have sought to legislate standard English as the only official language in an increasingly linguistically diverse United States, the link between the power of a single language and the power of those who determine its dominance should come as no surprise. Those who, like columnist Ellen Goodman, oppose recognizing Ebonics as a separate language hark back to the melting pot era in which the children of immigrants were "Americanized" in the public schools because "there was ... …

The Implementation Of Radical Constructivism Within The Urban Mathematics Classroom, Randy Lattimore Jan 1998

The Implementation Of Radical Constructivism Within The Urban Mathematics Classroom, Randy Lattimore

Trotter Review

One of the most serious problems in mathematics education continues to be the dismal statewide mathematics proficiency test performance of African-American students in urban schools. It has been argued that one of the best ways to improve performance is by connecting the pedagogy of mathematics to the lives and experiences of these students. Although many theories have been implemented in the urban mathematics classroom to assist African-American students in developing and increasing conceptual understanding, members of the urban mathematics education community should take a closer, more serious look at the implementation of radical constructivism within urban mathematics classrooms.

A number …

Teaching Upperclass Writing: Everything You Always Wanted To Know But Were Afraid To Ask, Lissa Griffin Jan 1998

Teaching Upperclass Writing: Everything You Always Wanted To Know But Were Afraid To Ask, Lissa Griffin

Elisabeth Haub School of Law Faculty Publications

A survey conducted as part of this project reveals that law schools generally require their students to have an upperclass writing experience taught or supervised by non-writing tenured or tenure-track faculty. These teachers currently bear the responsibility for assigning, supervising, reviewing, and evaluating most of the writing by upperclass students, either through substantive seminars or independent study projects. In almost all schools there is no major curricular planning, systematic instruction, faculty training, or institutional support for upperclass writing.
