No Dichotomies: Reflections On Equality Forafrican Canadians In R. V. R.D.S., April Burey

Dalhousie Law Journal

The contrasts, in form and substance, were stark. In form, I was a black woman in a wheelchair, pleading before an all-white, able-bodied and almost all-male Supreme Court of Canada. The usually empty public galleries in the Ottawa courtroom were filled with people of colour, who had come from across the country to witness the hearing of this landmark case. On their entrance, the nine white judges, dressed in their staid, black robes made an almost audible gasp as they were met with this colourfully clad, intently silent band of people of colour.

R. V. R.D.S.: A Political Science Perspective, Jennifer Smith Apr 1998

R. V. R.D.S.: A Political Science Perspective, Jennifer Smith

Dalhousie Law Journal

Political scientists, including those who study Canadian government and politics, regard the judiciary as a component of the system of governance as a whole. They view it as an institution in relation to other institutions. Thus in The Judiciary in Canada: The Third Branch of Government, Peter Russell examines such issues as the structure of the judiciary in the federal system, the separation of powers and judicial independence, and the appointment, promotion and removal of judges.' As well, political scientists follow the development of the law itself, in areas of peculiar relevance to political life, like electoral law, or of …

Bodies Of Law, Moira Mcconnell Apr 1998

Bodies Of Law, Moira Mcconnell

Dalhousie Law Journal

"Don't judge a book by its cover" is a maxim most frequently recited to children by adults to explain the idea that one should not judge people on the basis of appearance. This maxim captures the gist of the topic explored in Alan Hyde's Bodies of Law. Bodies of Law seeks to expose the fact that we simultaneously view a person as an entity distinct from her or his physical manifestation while our understanding and response to a person is affected by our perceptions and judgments regarding their physical characteristics.

Predicting Academic Success Of Entering Freshmen At An Urban University Through The Assessment Of Oral And Written Language Competency, Karen D. Cobbs Apr 1998

Predicting Academic Success Of Entering Freshmen At An Urban University Through The Assessment Of Oral And Written Language Competency, Karen D. Cobbs

Theses and Dissertations in Urban Services - Urban Education

In Moores and Klas' (1989) definitive study on college student retention, postsecondary administrators ranked the maintenance of student enrollment second in importance on a list of twenty critical issues facing higher education. Of particular relevance to college administrators has been the retention and graduation of African-American college students (D. B. Hawkins, 1994; Western Reserve, 1991).

Researchers, in considering the overall problem of student attrition, particularly, among African-Americans, have explored such questions as these: Which students are dropping out (Sherman, Giles and Green, 1994; Robinson, 1992)? Why do they discontinue their studies (Austin, 1982; Bohr et al., 1995; Kraft, 1992; Tinto, …

How Phonemic Awareness Training And Direct Phonics Instruction Effect The Decoding Ability Of Children With Reading Problems, Lynda Elaine Thatcher Apr 1998

How Phonemic Awareness Training And Direct Phonics Instruction Effect The Decoding Ability Of Children With Reading Problems, Lynda Elaine Thatcher

Masters Theses

The purpose of this thesis was to study how phonemic awareness and direct phonics instruction can effect the decoding abilities of children with reading problems. The importance of having phonics and phonemic awareness in the initial teaching of reading to young children was discussed. A review of the literature indicated that there is causative correlation between phonemic awareness and decoding skills. The research demonstrated that phonemic awareness intervention programs were very effective in increasing reading skills. Finally, the research implied that an effective reading program for young children with reading problems should include both phonological training and phonics instruction. In …

Interreligious Friendship: A New Theological Virtue, James L. Fredericks Apr 1998

Interreligious Friendship: A New Theological Virtue, James L. Fredericks

Theological Studies Faculty Works

Today, in an effort to respond to their religiously pluralistic situation, Christians should recognize friendships with non-Christians as a theological virtue. The first section of this essay reviews some of the recent discussion of virtue theory, noting that virtues are enduring aspects of character that incorporate values and skills, have histories, and often act as correctives to vices. The second section reflects on friendship as a virtue, using Aristotle, Sartre, and Levinas, among others. The third section discusses interreligious friendship in particular as an example of a human excellence, a new virtue that incorporates values and skills and helps Christians …

Is Tobacco A Drug? Administrative Agencies As Common Law Courts, Cass R. Sunstein Apr 1998

Is Tobacco A Drug? Administrative Agencies As Common Law Courts, Cass R. Sunstein

Duke Law Journal

Professor Cass Sunstein argues that the FDA has the authority to regulate tobacco products. He considers the text of the Federal Food, Drug, and Cosmetic Act, which supports the FDA assertion, and the context of its enactment, which argues against the FDA. He resolves the tension between text and context in favor of FDA jurisdiction by turning to the emerging role of administrative agencies. In modern government, he contends, administrative agencies have become America's common law courts, with the power to adapt statutory regimes to new facts and new values when the underlying statute is ambiguous. Professor Sunstein's Article, like …

Consumer Protection, Globalization And Democracy, John Goldring Apr 1998

Consumer Protection, Globalization And Democracy, John Goldring

Cardozo Journal of International and Comparative Law

The article examines the challenges posed by globalization to consumer protection and the role of nation-states in regulating economic activities. It argues that while globalization offers benefits, it often undermines consumer protections by creating inequalities in information and economic power. The analysis highlights the tension between international trade agreements, which can limit national sovereignty, and the need for robust consumer protection laws. The article also explores the complexities of extraterritorial enforcement of laws and the role of nation-states in maintaining legal frameworks that balance consumer rights with business interests.

The Yugoslav Crisis: Challenge For A New Theory Of Federalism, Thomas Fleiner Apr 1998

The Yugoslav Crisis: Challenge For A New Theory Of Federalism, Thomas Fleiner

Cardozo Journal of International and Comparative Law

The article addresses the violent ethnic conflicts in the former Yugoslavia, highlighting the challenges these conflicts pose to traditional notions of state sovereignty and democracy. It argues that the modern state concept, based on majority rule and the social contract, is inadequate for resolving ethnic conflicts. The author proposes rethinking sovereignty and constitutional frameworks to accommodate ethnic diversity, emphasizing shared sovereignty and consensual decision-making to prevent further violence and ensure peaceful coexistence.

Collapsing The Philosophy/Rhetoric Disjunct: Nietzsche, Plato And The Perspectival Turn, Ned Vankevich Apr 1998

Collapsing The Philosophy/Rhetoric Disjunct: Nietzsche, Plato And The Perspectival Turn, Ned Vankevich

Institute for the Humanities Theses

Often overlooked within the standard views of academe lie hidden a number of tacit assumptions. Until the time of Nietzsche, the status of rhetoric as a discourse formation in Western intellectual history was often colored by the unflattering view generated by Plato in a number of his dialogues. In this thesis I present a case that revisits Plato and Nietzsche with an eye toward understanding the reasons why these two highly influential figures in contemporary philosophy adopt the views they advocate. In doing so, I attempt to illumine the reason Plato forms a fundamental split between philosophy and rhetoric and …

Spectral/Temporal Segment Features For Automatic Speech Recognition, Xi Hong Wang Apr 1998

Spectral/Temporal Segment Features For Automatic Speech Recognition, Xi Hong Wang

Electrical & Computer Engineering Theses & Dissertations

In this thesis an approach for efficiently computing a compact spectral/temporal feature set for representing a segment of speech, with effective resolution depending on both frequency and time position within the segment, is developed, analyzed, and tested. The goal of this method is to mimic the resolution properties of the human auditory system, but using a computationally efficient FFT-based front end rather than a more complex auditory model. In particular this method applies both frequency and time "warping" to FFT spectra to obtain good frequency resolution at low frequencies and good time resolution at high frequencies. Time resolution is also …

Electrocortical Output And Hemispheric Contributions To The Alert State During A Sustained Attention Task, Treven Curtis Pickett Apr 1998

Electrocortical Output And Hemispheric Contributions To The Alert State During A Sustained Attention Task, Treven Curtis Pickett

Psychology Theses & Dissertations

This study investigated the relative electrocortical contributions of specified cerebral locations and the potential motoric influence of handedness in a biocybernetic feedback environment. Thirty six right-handed subjects engaged in two sixteen minute trials of a compensatory tracking task by guiding (via a joystick) a circle over a stationary target presented on a computer screen, performing one trial with their preferred (right) and one using their non-preferred (left) hand.

For each subject, a Macintosh computer interpreted electrocortical activity through an engagement index (20*beta/(alpha+theta)) and changed the task mode, i.e. manual (subject guides the task) or automatic (computer guides the task) as …

Neuro Fuzzy Reasoning For Pattern Classification And Object Recognition., Jayati Ghosh Dr. Mar 1998

Neuro Fuzzy Reasoning For Pattern Classification And Object Recognition., Jayati Ghosh Dr.

Doctoral Theses

In real world, pattern classification and object recognition problems are faced with fuzzi- ness that is connected with diverse facets of cognitive activity of the human being. An origin of sources of fuzziness is related to labels expressed in feature space as well as to labels of classes taken into account in classification and /or recognition procedures. Though a lot of scientific efforts have already been dedicated to pattern recognition problems, especially to classification procedures, still pattern recognition is confronted with a continuous challenge coming from a human being who can perform lot of ex- tremely complex classification tasks by …
