"The People Have Not Obeyed": A Literary And Rhetorical Study Of Jeremiah 26-45, Gary E. Yates
"The People Have Not Obeyed": A Literary And Rhetorical Study Of Jeremiah 26-45, Gary E. Yates
Faculty Dissertations
The goal of this study is to provide a holistic reading of the largely narrative material in Jeremiah 26-45 that is informed by the disciplines of literary and rhetorical criticism. This study seeks to contribute to the growing trend of reading the book of Jeremiah as a literary entity that possesses an editorial unity in spite of the complex compositional history that appears to stand behind the book. This study will focus primarily on the overarching plot and structure that emerge from the reading of Jeremiah 26-45. The thesis is that this section of the book of Jeremiah consists of …

Super Duper Loopers, Richard Lederer
Super Duper Loopers, Richard Lederer
Word Ways
The letters of some words can travel in a circle, like the whirling of juggled balls. Such words -- in which the first letter can be moved from frontword to backword to form another word -- have been labeled "cyclic transposals." I prefer the more straightforward term "looping anagrams."
Bananagrams, Edmund Conti
Bananagrams, Edmund Conti
Word Ways
Bananagrams--anagrams to drive you bananas--consist of rhymed couplets, each one containing a pair of anagrams to be solved. One of the rhyming words will always be an anagram, and the couplet itself will offer clues to help solve the anagrams. Answers will be in found in Answers and Solutions at the end of the issue.

A "Hare-Owing" Experience, Robert F. Fleissner
Word Ways
W. H. Auden's Academic Graffiti (Faber & Faber, London 1971) upon first reading may appear to contain little else than slightly satirical examples of nonsense verse in the familiar tradition of Edward Lear. Its most obvious analogue would appear to be with T. S. Eliot's Book of Practical Cats, but just as at least one of Eliot's prime feline creations had a basis in 19th-century fiction, in the depiction of Conan Doyle's Professor Moriarty (namely his tom, Macavity, as "The Napoleon of Crime"), so it is permissible that Auden's lyrical sketches can have more meaning than at first meets the …
Portraits And Landscapes In Family Narrative, Hayden Roberts
Portraits And Landscapes In Family Narrative, Hayden Roberts
Masters Theses & Specialist Projects
This thesis works from my interest in how individual perspectives affect family narratives and constructions of family history. Narrative exists chiefly in story form, but it also exists in people's mind, helping them to understand material culture, customs, and other forms of folk expression. These folk ideas define us and bind us socially. The way we arrange things in our minds, make sense of life experiences and the narratives we about create these experiences, define our social ties, such as family. Before one can understand the collective or group perception of itself, one must understand how each component or person …
Effect Of Item Clarity And Probability Of Item Endorsement On Response Latencies On Personality Test Items, James R. Kinney
Effect Of Item Clarity And Probability Of Item Endorsement On Response Latencies On Personality Test Items, James R. Kinney
All-Inclusive List of Electronic Theses and Dissertations
In this study, regression analysis was used to examine the affects of item clarity and probability of endorsement on response latencies of 60 undergraduates responding on personality test items from the Sixteen Personality Factor Questionnaire (16 Personality Factor test) (Cattell, Eber, & Tatsuoka, 1970, 5th Edition). Response latencies to personality test items, though frequently studied, have yet to be operationally utilized in the interpretation of personality tests. Forty-four items from the 16 Personality Factor test were selected. Each item from the original test was rated for clarity and matched with an emotionally neutral statement with an equivalent number of words. …
The Problematics Of Moral And Legal Theory, Richard A. Posner
The Problematics Of Moral And Legal Theory, Richard A. Posner
Articles
In these Holmes Lectures, delivered a century after the publication of Oliver Wendell Holmes's great essay The Path of the Law, Judge Posner argues for an essentially Holmesian conception of the proper relations among modern normative moral philosophy ("academic moralism"), morality, and law. Academic moralism, he argues, lacks either the intellectual cogency or the emotional power to change people's beliefs or behavior; the power to do so resides in "moral entrepreneurs," which academic moralists emphatically are not. Academic moralism's lack of cogency disqualifies it to guide judicial decisionmaking even - in fact, especially - in cases involving controversial moral issues, …
The History Of The Special (Struck) Jury In The United States And Its Relation To Voir Dire Practices, The Reasonable Cross-Section Requirement, And Peremptory Challenges, James Oldham
William & Mary Bill of Rights Journal
In this Article, Professor Oldham provides a unique historical study of the special, or struck, jury in the United States. First, Professor Oldham discusses the influence of the 1730 English statute on eighteenth- century American law and reviews the procedures of several states in which the struck jury remains valid, in addition to the once authorized procedures that states have since declared invalid. He also analyzes the relationship between the struck jury and peremptory challenges. Second, Professor Oldham analyzes the special qualifications of the jurors comprising special juries in the context of the "blue ribbon," or "high-class, " jury, the …
The Journey Through Perspective Transformation: Learning Nursing Theory, Judith R. Heggie Dnsc, Ms, Rn
The Journey Through Perspective Transformation: Learning Nursing Theory, Judith R. Heggie Dnsc, Ms, Rn
Dissertations
Through the use of grounded theory, educational methods most useful for nurses to achieve a perspective transformation, as exemplified by learning nursing theory were examined. Perspective transformation is a theory originally developed by Mezirow (1978) in a study of older women returning to college for additional education. Mezirow defined perspective transformation as the alteration or change of meaning perspectives. Perspective transformation in an individual can be compared to a paradigm change within a scientific community. Within the nursing literature on perspective transformation, most articles related to the perspective transformation needed for nurses to learn to use nursing theory as the …
The Moral Failure Of The Clear And Present Danger Test, David R. Dow
The Moral Failure Of The Clear And Present Danger Test, David R. Dow
William & Mary Bill of Rights Journal
The clear and present danger test has been used for almost a century to determine the speech the government may restrain. This test assumes that at some point speech transforms into an act and at that moment the speech becomes punishable. Under the clear and present danger test, the First Amendment does not protect speech that is an incitement to imminent lawless action. Professor Dow suggests that the clear and present danger test protects too little speech. He posits that speech should be protected unless the following three conditions are met: (1) the speaker's specific intent in uttering the words …

Festivals, Function And Context: An Ethnographic Study Of Three Festivals At Holden Village, Andrea Mericle
Masters Theses & Specialist Projects
The purpose of this thesis is to explore how three festivals function together to meet the Mission Statement goals of Holden Village, an isolated Lutheran renewal center located in the Cascade mountains in Washington State. The Holden Village Mission Statement states that Holden Village is organized to provide a community for healing, renewal, and refreshment of people through worship, intercession, study, humor, work, recreation, and conversation in a climate of mutual acceptance under the Lordship of Jesus Christ. The purpose of this community is to participate in the renewal for the church and the world by proclaiming the gospel of …
Legal Writing: Its Nature, Limits, And Dangers, Douglas Litowitz
Legal Writing: Its Nature, Limits, And Dangers, Douglas Litowitz
Mercer Law Review
Lawyers have a unique and highly technical manner of writing, one that differs significantly from standard English. Legal education involves an indoctrination into this new discourse, a process that ends when one awakens to find oneself writing in a manner that once seemed impossibly obscure. Of course, the mastery of legal language reflects a paradigm shift in thought, sometimes called "learning to think like a lawyer" or "seeing things from a legal perspective." The conceptual scheme and language of the law are so different from the ordinary way of thinking that Lord Coke was perhaps correct when he characterized the …
The Heart Of The Matter: The Property Right Conferred By Copyright, Douglas Y'Barbo
The Heart Of The Matter: The Property Right Conferred By Copyright, Douglas Y'Barbo
Mercer Law Review
The purpose of this Article is to offer a single coherent model that explains copyright law's essential features and to apply the model to reconcile the apparently disparate infringement decisions that comprise contemporary copyright law.
The fundamental premise underlying copyright law-and the one that I intend to dislodge-is that a copyright is a limited property right in relation to the author's original text. The thesis of this Article is that a "copyright" is not an enforceable property right in relation to a particular work of authorship or the expression embodied in it (i.e., "a text"). Instead, I shall demonstrate that …

Moving Toward Neutrality: The National Telecommunications And Information Administration's New Stance On Sectarian Programming, Nancy L. Reynolds
Moving Toward Neutrality: The National Telecommunications And Information Administration's New Stance On Sectarian Programming, Nancy L. Reynolds
Federal Communications Law Journal
The National Telecommunications and Information Administration (NTIA) has recently reinterpreted its funding policy regarding religious programming to create a policy more consistent with the religion clauses of the First Amendment and more responsive to the goal of government neutrality toward religion. Until 1996, the NTIA categorically denied all funding to government programming that provided any incidental or attenuated benefit to religion. However, in light of recent Establishment Clause cases, the NTIA modified its interpretation of sectarian programming, allowing a radio station to receive government funding even if its programming provides an attenuated or incidental benefit to religion. The NTIA's new …
Past Tense Marking In English By Chinese Learners, Hsuehmei Liu Price
Past Tense Marking In English By Chinese Learners, Hsuehmei Liu Price
Master's Theses
Researchers in the field of both first and second language acquisition have been studying the mechanisms underlying the marking of past tense in English, and have identified verb saliency, grammatical aspect, and proficiency level as some of the factors influencing the process. This study tests these factors by comparing 60 Chinese English learners' correct marking of English past tense under various conditions using analysis of variance. I found that Chinese learners of English are more likely to mark irregular verbs and aspectual perfectives than regular verbs and aspectual imperfectives for past tense. However, proficiency level was not found to have …
The Process And The Product: A Bibliography Of Scholarship About Legal Scholarship, Mary Beth Beazley, Linda H. Edwards
The Process And The Product: A Bibliography Of Scholarship About Legal Scholarship, Mary Beth Beazley, Linda H. Edwards
Mercer Law Review
This bibliography of scholarship about legal scholarship was originally prepared for the 1997 Conference of the Association of Legal Writing Directors. The Conference explored the rapidly developing area of scholarship by legal writing professors and the ways in which this important scholarship can be encouraged. Characteristically, when writing teachers turn their attention to a particular kind of writing the genre employs-that is, the process and the product. This bibliography is one result of that study. We hope that it will prove helpful to anyone interested in legal scholarship, especially to law faculty in the early stages of their scholarly careers. …
A Sociolinguistic Survey Of Bilingual Education Among The Shipibo Of Amazonian Peru, Kathleen Ann Tacelosky
A Sociolinguistic Survey Of Bilingual Education Among The Shipibo Of Amazonian Peru, Kathleen Ann Tacelosky
Linguistics & TESOL Dissertations - Archive
In the 1950s, the trend worldwide in public education was for classes to be conducted in the national (prestige) language. In Amazonian Peru however, an alternative was being considered: Bilingual Education (BE). Since monolingual education in Spanish in Peru had been unsuccessful, the government was looking for a way to educate indigenous Peruvians. Therefore, the government of Peru, together with the Summer Institute of Linguistics (SIL), implemented a BE program that incorporates vernacular indigenous languages and Spanish. The BE experiment was designed on a transition model: children are introduced to school and new concepts and skills such as reading in …

Factors That Influence Academic Achievement, Leah Georgene Shaffer
Theses and Dissertations
Does environment affect academic achievement? The dispute over environmental influences has been the topic of numerous debates. This study was designed to investigate the relationship between academic achievement and the following environmental factors: family structure, ethnic background, socioeconomic circumstances and family size. The 1,500 participants of this study were collected from a large, extremely diverse elementary school population. From this general population, 134 students were selected for the control group based on participation in the Basic Skills Program. Data was collected using teacher surveys and parent contact information. State and federal guidelines were used when identifying children for Basic Skills …
