The Courts And The Congress: Should Judges Disdain Political History?, Peter L. Strauss

In an earlier article in these pages, Professor John Manning argued that the use of legislative materials by courts in effect permits Congress to engage in delegation of its authority to subunits of the legislature, in violation of the separation of powers. Professor Strauss, acknowledging that the previous generation of courts may have excessively credited the minutiae of legislative history, responds that judicial attention to the political history of legislation is required, not forbidden, by considerations of constitutional structure. Only awareness of that history will promote interpretation reflective of the context and political moment of Congress's action. Our history of …

Demons And Angels In Hazardous Waste Regulation: Are Justice, Efficiency, And Democracy Reconcilable?, Michael B. Gerrard

The Superfund program is perhaps environmental law's best Rorschach test, in which those who write about the national effort to clean up contaminated sites disclose as much about their own philosophies of justice, democracy, and economic efficiency as about environmental legislation. The ten books reviewed here show deep conflicts among these values. I argue, based on these disparate judgments, that many of the Superfund debates have an almost religious character. The law has been shaped to fit the view that demonic polluters were, and remain, at work. The law also reflects a sense of higher duty to future generations – …

Within the pragmatics literature, a number of studies have investigated the speech act of complaining. In most cases, the researchers have failed to define a "complaint" before proceeding with analysis. The purpose of this study is to provide a theoretical definition of a "complaint" and to examine in-depth the linguistic details of the speech act of complaining, with a particular view to illuminating the linguistic devices employed in managing the "face" of the participants involved in Potential Complaint Situations. This thesis concerns the COMMIX system, which automatically extracts information on what a text is about, and generates that information in the highly compacted form of compound nominal expressions. The expressions generated are complex and may include novel terms which do not appear themselves in the input text. From the practical point of view, the work is driven by the need for better representations of content: for representations which are shorter and more concise than would appear in an abstract, yet more informative and representative of the actual aboutness than commonly occurs in indexing expressions and key terms. This research is concerned with the implications of reading sculpture as a mode of communication that is indicative of an art/language homology. An investigation of the inter-relationship of the functions of ‘Language’ and 'Conventions of Visual Communication' is viewed against contemporary redefinitions of the role of sculpture, its character of presentation and mode of engagement with respondents. Theoretical investigation examines models of communication and identifies corresponding systems in an art that is exemplified by the sculpture of Tony Cragg. The purpose of this paper is to examine grade retention. It looks at the advantages, disadvantages, and the alternatives to retention. This paper discusses factors that increases a child's chance of being retained. Aspects in education that have affected retention are also discussed. In addition, this paper looks at teachers' beliefs and why they hold these beliefs concerning_retention. Finally, the last chapter summarizes this study and draws conclusions from the literature and suggests recommendations for further study.

The article examines how naming practices, deeply rooted in patriarchal societies, influence women's identity, autonomy, and societal status. It argues that traditional naming conventions, such as women adopting their husbands' surnames, reflect broader power dynamics that marginalize women and erase their individuality. Radical-Right And Neo-Fascist Political Parties In Western Europe, Roger Karapin

Far right-wing parties have gained dramatically in many West European countries since the early 1980s. Recent cross-national studies distinguish between neo-fascist parties, which are anti-democratic and anti-capitalist, and radical right-wing parties which combine anti-immigration appeals with pro-capitalist, neo-liberal economic positions, social conservatism, and a basic acceptance of representative democracy. While the former have been stagnant and unimportant, the latter have been gaining. Yet there are also borderline cases where it is more difficult to determine whether the party rejects fascism and accepts democracy, a problem which the theoretical literature has neglected. One of the striking features of Australian higher education over the last ten years has been the marked increase in participation by Indigenous Australians. In a National Review of Education for Aboriginal and Torres Strait Islander Peoples, carried out in 1994, it was noted that the number of Aboriginal and Torres Strait Islander students had more than doubled between 1988 and 1993 (National Review of Education for Aboriginal and Torres Strait Islander Peoples, 1994:28-29). Indigenous Australians constitute 1.6 per cent of the population of Australia and in 1993 some 5,578 indigenous people were attending Australian public universities, which is 1.3% …

The study reported here aimed to identify the particular practices and uncover the particular principles of a group of ESL teachers. Some of the teachers were working with adult learners and some were working with young children. The research aimed to answer three main questions:

In a previous study on derivational morphology (Eddington 1996), the alternation between the unstressed mid-vowels /e/ and lo/, and the stressed diphthongs /je/ and /we/ was seen to escape straigh tforward explanation in rule-based a nalyses. Diphthongization in Spanish was instead attributed to the influence of other lexical items which contain the same derivational suffix.

This research paper is a study of looping. The purpose of this study was to conduct a review and an analysis of the literature concerning looping. Three questions were asked in the study: 1. What is looping and how does looping differ from multi-age grouping? 2. What are the advantages and disadvantages in looping? 3. What are the guidelines for an effective looping arrangement? The study seeks to understand and develop insights into the San Diego-Tijuana transborder economic collaborative partnership, by examining the Binational Planning and Coordination Committee (BPCC). This entity was established in 1993 via a Letter of Agreement between the City of San Diego and the municipality of Tijuana. Pursuant to the Letter of Agreement the BPCC is examined against the backdrop of the global economy, the emergence of region-states, U.S.-Mexico relations and transborder relations in the San Diego-Tijuana region. Many scholars, practitioners, and policy makers know very little about individual Latino administrators' cultural and professional experiences, responses to discrimination, and patterns or institutional conditions which relate to K-12 ethnic minority administrators' success. Moreover, many are also unaware that as ethnic diversity increases, the relative proportion of minority administrators, many of whom could be role models, shrinks.
