Kahan On Mistakes, Daniel B. Yeager
Kahan On Mistakes, Daniel B. Yeager
Faculty Scholarship
In Ignorance of Law Is an Excuse - but Only for the Virtuous, Professor Dan Kahan reconciles what I had thought was an irreconcilable body of law. To be sure, imposing order on whether and when mistakes of law should pass as responsibility-evading accounts
of untoward actions is far from light work. Yet Kahan somehow pulls it off in just twenty-seven pages. In addition to acknowledging the importance of Professor Kahan's essay, I write here to point out if not correct what might have been two oversights in his view of the meaning and operation of mistakes. First, Kahan …
Ethnicity And Child Mortality In Sub-Saharan Africa, Martin Brockerhoff, Paul C. Hewett
Ethnicity And Child Mortality In Sub-Saharan Africa, Martin Brockerhoff, Paul C. Hewett
Poverty, Gender, and Youth
Analysis of recent survey data reveals large differentials in child mortality among ethnic groups in countries throughout sub-Saharan Africa. These disparities correspond with the prominence of specific ethnic groups in the national political economy. In many countries where heads of state since independence have come from one or two ethnic groups-as in Côte d’Ivoire, Kenya, and Niger-these groups have experienced levels of early child mortality at least one-third lower than those of other groups. In other countries where there have been several transitions in state control, as in Ghana and Uganda, descendants of precolonial kingdoms such as Ashanti and Buganda …

The Changing Social Environment For Adolescents In Kassena-Nankana District Of Northern Ghana: Implications For Reproductive Behavior, Barbara Mensch, Daniel Bagah, Wesley H. Clark, Fred N. Binka
Poverty, Gender, and Youth
This study reports on a primarily qualitative investigation of adolescent reproductive behavior in the Kassena-Nankana District, a rural isolated area in northern Ghana, where traditional patterns of marriage, family formation, and social organization persist. The study is based on in-depth interviews and focus groups with adolescents, parents, chiefs and traditional leaders, teachers, youth leaders, and health workers, supplemented by quantitative data from the 1996 wave of a panel survey of reproductive-aged women conducted by the Navrongo Health Research Centre. The social environment faced by adolescent boys and girls in the Kassena-Nankana District and its links to reproductive behavior are described. …
Social Networks And The Diffusion Of Fertility Control, Mark R. Montgomery, John B. Casterline
Social Networks And The Diffusion Of Fertility Control, Mark R. Montgomery, John B. Casterline
Poverty, Gender, and Youth
Theories of the fertility transition now routinely reserve a place for diffusion effects. Two fundamental behavioral mechanisms account for such effects: social learning and social influence. Social learning refers to the acquisition of information from others. The information might have to do with a new technology or with the health, social, and economic consequences of decisions. In the case of fertility, individuals might learn from others about the availability of a new contraceptive, or about health side effects of certain contraceptives, or about the apparent gains and losses from having fewer children and investing in their schooling. Social influence refers …
Indexical Expressions: Syntax And Context, Barbara Bevington
Indexical Expressions: Syntax And Context, Barbara Bevington
Dissertations, Theses, and Capstone Projects
Indexicals are those expressions in natural language–such as I, you, here, and now–whose reference varies with occasion of use, picking out individuals in virtue of their contextual roles. Although analyses of the semantics of indexicals have been advanced–most notably by Kaplan–their syntax has heretofore been largely ignored. This dissertation puts forth a theory of the syntax of indexical expressions, within the framework of generative grammar, and proposes a new model of the formal context for natural language.
The central argument against prior accounts of indexicals is that such theories draw the distinction between the first and second person pronouns versus …

Dolls And Upholstery: The Commodification Of Maya Textiles Of Guatemala, Margot Blum Schevill
Dolls And Upholstery: The Commodification Of Maya Textiles Of Guatemala, Margot Blum Schevill
Textile Society of America: Symposium Proceedings
Introduction
Maya weavers of Guatemala are well known for their beautiful backs trap and treadle-loomed cloth, which they create for clothing and related garments and for sale, both within and outside Guatemala. Backstrap weaving, mainly a woman's occupation done in the home, has an ancient history over two millennia, although there are few extant examples of the weavings of the ancient Maya due to climatic conditions (Figure 1). The process, however, was documented in ceramic art, and the tradition of handwoven clothing can be seen in monumental stone carvings, murals, and also in ceramic art. Today weavers purchase the yarn …

What precisely is one asserting when one claims to be Latina/o? A political identity, an experiential identity, or both? Is the Latina/o identity racial, or ethnic, or cultural? Is it even ideologically or ontologically manageable? My father happens to be an African Cubano. My mother is Jamaican. I was born and raised in England. Am I a Latino? Or am I finally "just Black"? But you may be asking, why be binary? Identity is never an either/or proposition. Perhaps I am a "Black Latino." If so, doesn't the "Black" preceding "Latino" signify some lesser claim to Latino identity (I've never …

Interview With Manuel Delanda, Switch Staffs
SWITCH
An interview with philosopher Manuel De Landa and SJSU CADRE students, Brett Stalbaum, Matt Hoessli, Geri Wittig, Kristin Cully, Geoffrey Bruce, Anne-Marie Schleiner. De Landa's work focuses on the use of networks as a medium of expression. The discussion traces networking technology, including machine intelligence or artificial intelligence’s evolution from military to civilian contexts. They discuss, "One Thousand Years of Nonlinear History", De Landa's most recent book at that time that shows the history of the world from a non-anthropocentric view to make the worldview more inclusive as a self-organized and dynamical system that is unaffected by the hierarchical perspective …

Inventive Minds, Jay Cox
Indifférance, John F. Pohorylo
Indifférance, John F. Pohorylo
Theses
The main intention of this thesis is to wrestle Derrida's notion of différance from an endless free-play of signification into some sense of boundedness, and to release meaning, knowledge and understanding from its relentless grasp. In achieving this goal, an entirely new field of "value" and "Quality" based discourse would open up within applied schismatic architectural theory.
Robert Pirsig offers a strong alternative to différance with his discourse on the Metaphysics of Quality, wherein he defines "Quality" as a pre-intellectual reality. This pre-intellectual reality, which I call "indifférance", is made up of the lenses of inorganic, organic and social …

Articles
The tenth anniversary of this Journal is an occasion not only for celebrating its remarkable achievements, but also for thinking again about the nature and premises of the work it reflects. One way to begin might be with its two central terms, "law" and "humanities" (or the obvious alternative to the second, "literature").

United States V. O'Hagan: The Supreme Court Abandons Textualism To Adopt The Misappropriation Theory, Amy E. Fahey
Fordham Urban Law Journal
This article analyzes the Supreme Courts ruling in United States v. O'Hagen holding that Section 10(b) of the Securities and Exchange Act can be applied to insider trading by corporate outsiders. The article argues that the Supreme Court incorrectly expanded the reach of the statute beyond that which Congress had intended.

Some Examples Of Using Legal Relations Language In The Legal Domain: Applied Deontic Logic, Layman E. Allen
Articles
The fundamental concept of the LEGAL RELATIONS Language (LRL) is the recursively-defined notion of LEGAL RELATION (LR). As LR is defined here, there is an infinite number of different LEGAL RELATIONS, and LRL is a language for precisely and completely describing each of those infinite number of dfferent LEGAL RELATIONS. With its robust collection of dfferent names, one for each of the different LEGAL RELATIONS, LRL provides adequate vocabulary for (1) describing every possible legal state of affairs, (2) accounting for every possible change from one legal state of affairs to another, (3) representing every possible legal rule, and (4) …

'About Talk': The Category Of Talk-Reflexive Words, Corey Anton
Peer Reviewed Articles
The present exploration examines the everyday capability to talk about talk by considering mainly the use of a particular word-type, what I shall be calling 'about talk' words. As an important note, the reader of this text should observe that almost all the sentences within this paper (except for quotations) embody 'about talk'. But, rather than continue to distract the reader by underlining every instance, I shall highlight (i.e., underline) only within the first two paragraphs of this essay all of these definite references to the verbal order. As for the other sentences, paragraphs, and pages, the reader is strongly …
