State Successions And Statelessness: The Emerging Right To An Effective Nationality Under International Law, Jeffrey L. Blackman Jan 1998

State Successions And Statelessness: The Emerging Right To An Effective Nationality Under International Law, Jeffrey L. Blackman

Michigan Journal of International Law

This paper surveys some of the recent developments in international law relating to nationality and state succession, and suggests a growing convergence among several legal principles-specifically the principle of effective nationality, the individual right to a nationality and the corresponding duty of states to prevent statelessness, and the norm of nondiscrimination. At some point this convergence of such diverse areas of law as nationality, diplomatic protection, and human rights will impose positive duties on successor states with respect to their inherited populations: namely the duty to secure effective nationality for persons affected by state succession.

Overt And Relational Aggression In Russian Nursery-School-Age Children: Parenting Style And Marital Linkages., C. H. Hart, D. A. Nelson, C. C. Robinson, S. F. Olsen, M. K. Mcneilly-Choque

Faculty Publications

Maternal and paternal parenting styles and marital interactions linked to childhood aggressive behavior as described in Western psychological literature were measured in an ethnic Russian sample of 207 families of nursery-school-age children. Results corroborated and extended findings from Western samples. Maternal and paternal coercion, lack of responsiveness, and psychological control (for mothers only) were significantly correlated with children's overt aggression with peers. Less responsiveness (for mothers and fathers) and maternal coercion positively correlated with relational aggression. Some of these associations differed for boys versus girls. Marital conflict was also linked to more overt and relational aggression for boys. When entered …

Genetic Evidence For The Proto-Austronesian Homeland In Asia: Mtdna And Nuclear Dna Variation In Taiwanese Aboriginal Tribes, Terry Melton, Stephanie Clifford, Jeremy Martinson, Mark Batzer, Mark Stoneking

Faculty Publications

Previous studies of mtDNA variation in indigenous Taiwanese populations have suggested that they held an ancestral position in the spread of mtDNAs throughout Southeast Asia and Oceania (Melton et al. 1995; Sykes et al. 1995), but the question of an absolute proto-Austronesian homeland remains. To search for Asian roots for indigenous Taiwanese populations, 28 mtDNAs representative of variation in four tribal groups (Ami, Atayal, Bunun, and Paiwan) were sequenced and were compared with each other and with mtDNAs from 25 other populations from Asia and Oceania. In addition, eight polymorphic Alu insertion loci were analyzed, to determine if the pattern …

Law’S Alienation: Furies And Nomoi And Bears (And Nuns), Emily A. Hartigan Jan 1998

Law’S Alienation: Furies And Nomoi And Bears (And Nuns), Emily A. Hartigan

Faculty Articles

The inclusion of spirit in the law is necessary because the exclusion of the spirit from the law separates the law from its dynamic source of animation. The inclusion of the spirit or spirituality with the law will better allow the United States to craft laws and policies designed to address undocumented workers and illegal aliens.

Even Socrates wrote about the separation of spirit and the law when he wrote about the Nomoi and the Furies; however, he also discussed his Daemon, an inner voice enters into dialogue with the Nomoi, the law. This inner voice that was essential for …

Regarding Rights: An Essay Honoring The Fiftieth Anniversary Of The Universal Declaration Of Human Rights Introduction: Locating Culture, Identity, And Human Rights Symposium In Celebration Of The Fiftieth Anniversary Of The Universal Declaration Of Human Rights, Tracy E. Higgins

Faculty Scholarship

The half-century since the drafting of the Universal Declaration of Human Rights' has been famously heralded as the "Age of Rights" and the concept of human rights described as "the only political-moral idea that has gained universal acceptance." During the same period, however, both terms defining the subject-human and rights-have become increasingly contested. Informed by the emergence of identity-based political movements, critics have attacked the category human has as bearing the baggage of Western Enlightenment assumptions about personhood and community, inherently racist, sexist, and classist. Theorists across the political spectrum have criticized the concept of rights as indeterminate, destructive of …

Introduction: Locating Culture, Identity, And Human Rights Symposium In Celebration Of The Fiftieth Anniversary Of The Universal Declaration Of Human Rights: Introduction, Catherine Powell

Faculty Scholarship

As we celebrate the Fiftieth Anniversary of the Universal Declaration of Human Rights, the idea of human rights endures. The human rights idea was honored at a conference organized by the Association of the Bar of the City of New York, held at Fordham Law School on December 10-12, 1999, to commemorate the first fifty years of the Universal Declaration of Human Rights. The four pieces that follow were presented at the conference as part of a panel addressing one of the central philosophical concerns regarding the human rights project: its universality. While the panel's title, "What is a Human …

Paulo Freire: Community Based Arts Education, Christine Ballengee Morris Jan 1998

Paulo Freire: Community Based Arts Education, Christine Ballengee Morris

Journal of Social Theory in Art Education

This paper is about Paulo Freire and his influence on the perspective and application of literacy programming and interdisciplinary education through the arts. Portraiture, as used in this paper, is a collection of stories that illuminate historical, social, and cultural influences that connect Freire to a community and to the world. Freire’s pedagogical theory requires educators and students to examine self, culture, and community. It also addresses issues of power, voice, conflict, class, gender, and race. Freire’s philosophy and application illustrates the value he placed on education through life experiences/knowledge, the arts, and cultures of the people. In this paper, …

Multiple Intelligence Motivational Activities Using Literature For Kindergarten And First Grade Students, Heidi Jo Ann Otis Jan 1998

Multiple Intelligence Motivational Activities Using Literature For Kindergarten And First Grade Students, Heidi Jo Ann Otis

All Graduate Projects

The purpose of this project was to identify a set of multiple intelligence activities that foster motivation for reading. These activities were to accompany specific pieces of children's literature. Children who are motivated and spend more time reading become better readers (Gambrell, 1996). The central element for this project was to develop activities for children's literature using Gardner's multiple intelligence theory. Gardner lists those seven intelligences as: Linguistic, logical/mathematical, spatial, music, kinesthetic/body, interpersonal and intrapersonal (Gardner, 1983). By giving young children a variety of intellectual modalities associated with children's literature it was hoped that all students would develop an early …

An Intergenerational Literacy Project For Migrant Families, Sandra E. Harmening, Amy C. Kiesz Jan 1998

An Intergenerational Literacy Project For Migrant Families, Sandra E. Harmening, Amy C. Kiesz

All Graduate Projects

The relationship between student achievement and parental involvement was reviewed and found to be significant. A model project was developed to include seven migrant families intergenerationally within the context of the classroom. The purpose was to enhance the relationship between students and parents/guardians and between these low literacy families and the school institution. The result was projected to be a better understanding of each family's heritage, an increase in volunteerism at the school site, more interest in school work and accomplishment, and the possible residual effect of parental desire to improve their literacy skills.

Parent Perceptions Of The Value Of The Juanita Apartment School Program, Stanley B. Hughes Jan 1998

Parent Perceptions Of The Value Of The Juanita Apartment School Program, Stanley B. Hughes

All Graduate Projects

The purpose of this project was to determine parent perceptions of the value of the Juanita Apartment School program. To accomplish this task interview questions were developed and family interviews conducted. Transcriptions of audio interview tapes were made and all data studied to determine response patterns. Families interviewed indicated the Juanita Apartment School program had either been "very helpful" or "helpful" in making their children feel more positive about and be more successful in elementary school.
