Labelling Genetically Modified Products Under International Law, Mary Caroline Harris

LLM Theses and Essays

This paper focuses on the debate on the health, policy and legal regimes that require the special labeling of food, drugs and other products that contain genetically-modified-organisms. The paper examines national and international regulatory schemes on genetically-modified-organisms and the roles of the General Agreements on Tariffs and Trade (GATT) and World Trade Organization (WTO) conventions for non-restrictive global trade. This paper analyzes the scope, aims and objectives of the proposed international Biosafety Protocol in line with the overarching goals of GATT/WTO. The paper concludes that the food industry and individual producers should have the liberty to decide whether to label …

Child-Custody Adjudication - The Twentieth Century Dilemma: Reconciling The Best Interest Of The Child In A Cross-Cultural Setting, Jasmine Rita Renner Jan 1998

Child-Custody Adjudication - The Twentieth Century Dilemma: Reconciling The Best Interest Of The Child In A Cross-Cultural Setting, Jasmine Rita Renner

LLM Theses and Essays

Child Custody determination in family law is a herculean task. It typically depends on the balancing of interests between two parents that works in tandem with the best interest of the child. This paper addresses the legal and constitutional factors that affect custody adjudication in the 20th century such as feminist jurisprudence, and the growing concept of joint custody with primary caretaker rule. The paper also examines the role and impact of assisted reproductive technology on custody adjudication. Most importantly, the paper focuses on the best interest of the child doctrine under Article 3(1) of the United Nations Convention on …

The Transboundary Movement Of Hazardous Waste A Comparative Analysis, Els Reynaers Jan 1998

The Transboundary Movement Of Hazardous Waste A Comparative Analysis, Els Reynaers

LLM Theses and Essays

An analysis of the transboundary movement of hazardous waste requires a comparative examination of three main regulatory entities. First, the international Basel Convention on the Control of the Transboundary Movements of Hazardous Wastes and Their Disposal will be covered. More particularly, an inquiry of its raison d'etre, will be followed by a critical examination of its goals and mechanisms. The relationship the United States has with the Convention and its national approach towards the export of hazardous waste will be covered next. A brief investigation of the real situation impacts of the Basel Convention will finalize this chapter. The second …

A Corba-Base Integration Of Distributed Electronic Healthcare Records Using The Synapses Approach, Jane Grimson, William Grimson, Damon Berry, Gaye Stephens, Eoghan Felton, Dipak Kalra, Pieter Toussaint, Onno Weir Jan 1998

A Corba-Base Integration Of Distributed Electronic Healthcare Records Using The Synapses Approach, Jane Grimson, William Grimson, Damon Berry, Gaye Stephens, Eoghan Felton, Dipak Kalra, Pieter Toussaint, Onno Weir

Articles

The ability to exchange in a meaningful, secure, and simple fashion relevant healthcare data about patients is seen as vital in the context of efficient and cost-effective shared or team-based care. The electronic healthcare record (EHCR) lies at the heart of this information exchange, and it follows that there is an urgent need to address the ability to share EHCR's or parts of records between carers and across distributed health information systems. This paper presents the Synapses approach to sharing based on a standardized shared record, the Federated Healthcare Record, which is implemented in an open and flexible manner using …

Effectiveness Of Prevention Interventions With Youth At High Risk Of Drug Abuse, Richard F. Catalano, Kevin P. Haggerty, Randy R. Gainey, Marilyn J. Hoppe, Devon D. Brewer Jan 1998

Effectiveness Of Prevention Interventions With Youth At High Risk Of Drug Abuse, Richard F. Catalano, Kevin P. Haggerty, Randy R. Gainey, Marilyn J. Hoppe, Devon D. Brewer

Sociology & Criminal Justice Faculty Publications

A recent report describes three types of prevention programs: universal, selected, and indicated (Institute of Medicine 1994). Universal prevention approaches are those that serve the entire population who share a general risk to the disorder without regard to specific risk status. Selected prevention approaches serve those whose precursors of problem behaviors are elevated but who have not yet manifested the problem behavior to be prevented. Indicated prevention approaches serve those who have initiated the problem behavior to be prevented but have not yet developed a serious or chronic behavior problem and do not warrant at that time a clinical diagnosis …

Conceptualizing The Impact Of Health Care Crimes On The Poor, Brian K. Payne Jan 1998

Conceptualizing The Impact Of Health Care Crimes On The Poor, Brian K. Payne

Sociology & Criminal Justice Faculty Publications

Past research shows that a small percentage of health care employees commit an assortment of criminal acts while on the job. Missing from previous research, however, is an examination of the effects such acts have on the poor (i.e. the victims). This paper fills this void by considering the effects of three broadly defined health care crimes: Medicaid fraud, elder abuse, and prescription fraud. In addition to the direct victimization experiences of those served by me health care system, the physical, economic, and time losses are also considered. Implications for future research and policy are provided.

Grandparents Today: A Demographic Profile, Maximiliane E. Szinovacz

Sociology & Criminal Justice Faculty Publications

This article presents a demographic profile of grandparents, using the National Survey of Families and Households. Specific dimensions of grandparenthood addressed include grandparents' survival, the timing of grandparenthood, grandparents' involvement in other roles, surrogate parenting, and stepgrandparents. The data indicate considerable heterogeneity among grandparents of different genders and races or ethnicities. They also suggest modifications in previous descriptions of modern grandparenthood.

The Meaning Of Quality In Living Service Environments: An Analysis Of The Experiences Of People With Disabilities, Elderly People And Service Workers, Ruth Marquis

Theses: Doctorates and Masters

The purpose of the study was to examine the experiences of both people with disabilities and elderly people and to identify their perceptions of quality as it relates to living in a service or being supported by a service to live in the community. The study was naturalistic in design and used a phenomenological approach and inductive analysis. It involved immersion in living services for a two year period, in-depth interviews with people living and working in services and participant observation. Fifty service users between the ages of twenty-one and ninety-six, and twenty-six service workers between the ages of twenty-six …

Rural Palliative Care Nursing: A Modified Grounded Theory Study, Ruth Mcconigley Jan 1998

Rural Palliative Care Nursing: A Modified Grounded Theory Study, Ruth Mcconigley

Theses: Doctorates and Masters

This paper presents the findings of a study of rural palliative care nurses in Western Australia. The numbers of rural centres in Western Australia offering palliative care services are increasing; however at present there is little empirical data available about the roles of the nurses involved. This study was undertaken to begin to correct this deficit. The study examines basic social processes associated with the role of rural palliative care nurses and identities issues that affect the nurses’ professional practice. A modified grounded theory approach was used to form a conceptual framework that describes rural palliative care nursing. Theoretical sampling …

User Response And Organisational Fit For Information Systems In Earth Observation, Jeff Kingwell Jan 1998

User Response And Organisational Fit For Information Systems In Earth Observation, Jeff Kingwell

Theses: Doctorates and Masters

A group of seventy six scientists and data managers in the Australian research agency CSIRO were surveyed to establish their needs and preferences in relation to information systems for Earth observation data. After study of available alternatives, three prototype Earth observation information management systems were installed and the user response was evaluated through interview of fifteen of the group. The prototypes consisted of web-based client servers which permitted users to interrogate databases of Earth observation datasets; to search for information about sensor or satellite performance, and to retrieve data and information products. The chosen systems were CILS, the CEOS (Committee …

Exclusion Mapping Of Polycystic Kidney Disease: A Third Locus, Eoin Thompson Jan 1998

Exclusion Mapping Of Polycystic Kidney Disease: A Third Locus, Eoin Thompson

Theses: Doctorates and Masters

The aim of this research was to perform exclusion on a rare form of hereditary autosomal dominant polycystic kidney disease (ADPKD). To-date, two genes for ADPKD have been identified: PKDI which has been localized to the short arm of chromosome 16 and PKD2 which has been localized to the long arm of chromosome 4. However, a small number of families have been reported that have not shown linkage to either of these two loci, thus suggesting the existence of at least one additional locus (PKD3). Two families that are affected with ADPKD and do not show linkage to PKDI or …

An Art Therapy Programme Incorporating Buddhist Concepts To Address Issues Of Aggression In Adult Male Prisoners, Diane Randall Jan 1998

An Art Therapy Programme Incorporating Buddhist Concepts To Address Issues Of Aggression In Adult Male Prisoners, Diane Randall

Theses: Doctorates and Masters

This thesis has researched and designed a programme that offers an alternative way of working with aggression in a male prison population, using an art therapy approach that incorporates Buddhist concepts as an intervention. Buddhist practices have traditionally been used in Eastern cultures to calm the mind and to develop compassion as an antidote to aggression. Therefore these practices have seen used as a basis for the design of exercises in the programme. The purpose of the programme is to offer an intervention that will complement, support, or be an alternative to existing treatments, which are primarily cognitive-behavioural in orientation. …

Industrial Development In Indonesia, Development For Whom?: A Case Study Of Women Who Work In Factories In Rural West Java, Peter J. Hancock Jan 1998

Industrial Development In Indonesia, Development For Whom?: A Case Study Of Women Who Work In Factories In Rural West Java, Peter J. Hancock

Theses: Doctorates and Masters

This research was conducted in order to address two major research questions: 1) To what extent and in what ways are a cohort of female factory workers in Sundanese West Java influential in the cultural, social and economic development of the geographic area in which they live and more specifically within their own households? 2) To what extent does the Indonesian state support or inhibit such development? In order to answer these and other secondary research questions I conducted qualitative and quantitative research. I used a theoretical framework which directed the methodology, questionnaires and both qualitative and quantitative data was …

The Burdens Of Capability, Jean P. Peterson Jan 1998

The Burdens Of Capability, Jean P. Peterson

Department of Educational Studies Faculty Publications

I once specialized in counseling talented and gifted children. Before that, I taught these students in my high school English classes for many years, and they taught me about themselves through their writings and discussions. Motivated by what I had learned from my most memorably talented students, I began discussion groups for them when I became a "gifted education teacher" in the 1980s. I knew there was a need for affective support. I also knew that educators, coaches, and even parents sometimes forgot that these bright and complex students were more than just potential fulfillers of adults' dreams, more than …

Is Mammography Useful In Screening For Local Recurrences In Patients With Tram Flap Breast Reconstruction After Mastectomy For Multifocal Dcis?, A P Salas, M A Helvie, E G Wilkins, H A Oberman, P W Possert, Alan M. Yahanda Md, Facs, A E Chang Jan 1998

Yahanda Md, Facs, A E Chang

PCI Publications and Projects

BACKGROUND: Skin-sparing mastectomy with immediate transverse rectus abdominis musculocutaneous (TRAM) flap reconstruction is being used more often for the treatment of breast cancer. Mammography is not used routinely to evaluate TRAM flaps in women who have undergone mastectomy. We have identified the potential value of its use in selected patients.

METHODS AND RESULTS: We report on four women who manifested local recurrences in TRAM flaps after initial treatment for ductal carcinoma in situ (DCIS) or DCIS with microinvasion undergoing skin-sparing mastectomy and immediate reconstruction. All four patients presented with extensive, high-grade, multifocal DCIS that precluded breast conservation. Three of four …

Questioning The "Slippery Slope": Ethical Beliefs And Behaviors Of Private Office-Based And Church-Based Therapists, Barrett W. Mcray, Mark R. Mcminn, Katheryn Rhoads Meek Jan 1998

Questioning The "Slippery Slope": Ethical Beliefs And Behaviors Of Private Office-Based And Church-Based Therapists, Barrett W. Mcray, Mark R. Mcminn, Katheryn Rhoads Meek

Faculty Publications - Doctor of Psychology (PsyD) Program

Counselors and other mental health professionals whose primary office is in a church building often face unique challenges in maintaining appropriate client-therapist boundaries. A sample of 497 Christian counselors responded to an 88-item survey of their ethical beliefs and behaviors. Of the respondents, 148 reported a church as their primary work setting and 162 reported a private office as their primary work setting. Survey results were factor analyzed, then church-based therapists were compared with private office-based therapists regarding their views of ethical behaviors. Although church-based therapists take greater liberties with multiple-role relationships than private office-based therapists, they appear similar with …

Mandatory Arbitration Of Employee Discrimination Claims: Unmitigated Evil Or Blessing In Disguise?, Theodore J. St. Antoine Jan 1998

Mandatory Arbitration Of Employee Discrimination Claims: Unmitigated Evil Or Blessing In Disguise?, Theodore J. St. Antoine

Articles

One of the hottest current issues in employment law is the use of mandatory arbitration to resolve workplace disputes. Typically, an employer will make it a condition of employment that employees must agree to arbitrate any claims arising out of the job, including claims based on statutory rights against discrimination, instead of going to court. On the face of it, this is a brazen affront to public policy. Citizens are being deprived of the forum provided them by law. And indeed numerous scholars and public and private bodies have condemned the use of mandatory arbitration. Yet the insight of that …

Survivability Of Noneconomic Damages For Tortious Death In Washington, Steve Andrews Jan 1998

Survivability Of Noneconomic Damages For Tortious Death In Washington, Steve Andrews

Seattle University Law Review

The focus of this Comment will be the 1993 amendment to Washington's general survival statute. In particular, the goal is to interpret how noneconomic damages for tortious death are to be treated under the new survival statute and to answer the question of what noneconomic damages are available to the victim's survivors. Because of Washington's complex statutory scheme, each of five potentially applicable statutes will be examined for available noneconomic damages, the survivability of these damages, the beneficiaries of the action, and possible duplication of damages. In answering these questions, this comment will also address the issue of survivability of …

Casebooks And Constitutional Competency, David E. Engdahl Jan 1998

Casebooks And Constitutional Competency, David E. Engdahl

Seattle University Law Review

Today's casebooks are far better adapted for fostering constitutional competency among lawyers than were their earlier counterparts. Part 1 of this Article traces the evolution of the constitutional law casebook from James Bradley Thayer's massive compilation of raw data in the Dean Langdell tradition, to the modern style of extensively edited cases with comments and questions to help students identify, anticipate, and assess potential avenues of analysis and development. Part 2 examines some basic concepts of federalism law still afforded too little attention by casebook editors. The classic analysis of enumerated powers (including Congress's power under the necessary and proper …

Problem Solving And Storytelling In Constitutional Law Courses, William A. Kaplin Jan 1998

Problem Solving And Storytelling In Constitutional Law Courses, William A. Kaplin

Seattle University Law Review

The author’s primary methods to teach Constitutional Law are problem solving and storytelling. He selected Farber, Eskridge, and Frickey’s Constitutional Law: Themes for the Constitution's Third Century and continues to use it in part because it includes both stories and problems. The author also selected this particular casebook because it places the individual rights materials before the materials on federal powers. He wanted to experiment with this reversed order and thus far has been satisfied – largely because the rights materials engage student interest better than the powers materials. They also set a more contemporary and practical tone for the …

The Violence Against Women Act Of 1994: Connecting Gender-Motivated Violence To Interstate Commerce, Judi L. Lemos

Seattle University Law Review

This Comment explores whether the Supreme Court will grant certiorari in the Brzonkala v. Virginia Polytech and State University, and whether the Court will uphold the Violence Against Women Act (VAWA) as a constitutional use of the commerce power. Part I explains the provisions of VAWA. Part II scrutinizes the development of Commerce Clause jurisprudence, which culminated in the Lopez decision. Part III analyzes the panel's Fourth Circuit ruling in Brzonkala. Part IV reviews the Supreme Court's handling of post-Lopez Commerce Clause cases and discusses whether the Court will grant certiorari to a challenge of VAWA's constitutionality. …
