Improving Stream Bioassessment Methods For The Montana Valleys And Foothill Prairies Ecoregion, Wease Bollman

To assist in the characterization of the ecological integrity of streams of the Montana Valleys and Foothill Prairies, I investigated the distribution of aquatic macro invertebrate assemblages over that geographically variable ecoregion. DECORANA (DCA) ordination and TWINSPAN classification techniques indicated that elevation was the variable with the greatest influence on distributions of benthic taxa in the region, and that three assemblage groups are distinguishable. The Montana Department of Environmental Quality (Montana DEQ) uses an adaptation of U.S. EPA’s Rapid Bioassessment Protocol (Plafkin et al. 1989) to evaluate and monitor streams here, and the elements of the protocol were examined for …

Adding Zest To Opac Instruction: Humor And The Unexpected, Bonnie Petry

This article evolved from " Getting Students to NOTIS, "

a presentation that the author gave at the 1995 Chicago NOTIS Users

Group Meeting (NUGM) conference. Humor is a desirable element of

all types of instruction, particularly bibliographic instruction. A good

method for injecting some humor into bibliographic instruction is

introducing whimsical catalog entries. The author identifies five types

of bibIiographic records useful for this approach, provides strategies for

locating them, and suggests ways to incorporate them into a class.

Who Was Dick? Constitutional Limitations On State Choice Of Law, Jeffrey L. Rensberer

Dick is not easily reconciled to interest analysis. The latter states that a state may and should apply its own law if it benefits a local party. Dick disallowed Texas from applying its beneficial law to a Texas domiciliary. Although a state may violate due process by unfairly surprising a foreign party, the issue of surprise is at best debatable on the facts of Dick. If the Supreme Court insists upon choosing interest analysis over Dick, it should overrule it. This is to be preferred over creating a legal fiction about Dick's domicile by rewriting the facts of Dick.

Castles In The Sand: Balancing Public Custom And Private Ownership Interests On Oregon’S Beaches, Steven W. Bender

Although much has been written about Oregon's unique legacy of public privilege to use private beaches, scholarship has tended to focus on articulation as well as spirited critique of the custom doctrine. More recently, commentators have addressed the question of whether the public's beach rights can withstand scrutiny under the constitutional takings doctrine. In contrast, this article assumes that the custom doctrine is sufficiently embedded in Oregon's history and case law as precedent to withstand reconsideration of the doctrine and to constitute a background principle of state law for purposes of the takings doctrine. This article discusses the role of the guardian ad litem, as Part I dissects each of the five potential guardian ad litem roles: Lawyer, Expert Witness, investigator/Lay Witness, Mediator/Facilitator, and Party. For each role, this section explores: how the well-known role is typically performed within the court system as a whole; how that role might be performed in a custody case, consistent with its occurrence elsewhere in the judicial system; and how that role, when held by a guardian ad litem, actually is performed in a custody context. Alcohol Related Violence And Unwanted Sexual Activity On The College Campus, Mary E. Nicholson, Min Qi Wang, Dolores Maney, Jianping Yuan, Beverly S. Mahoney, Daniel D. Adame

The purpose of this study was to explore the relationships among alcohol consumption, sexual assault and rape, and nonsexual violence in a college population at a large Northeastern university. A 49-item questionnaire was designed to elicit responses from both victims and perpetrators. Of the 1,084 respondents: 518 were male, 566 were female, the majority were White (91.8%), and in the 18-21 age range. Unwanted sexual activity, rape, and violence were significantly related to alcohol consumption on the college campus studied. These data indicated that alcohol was involved in: a) unwanted sexual activity--both from the victim's perspective (85.7%) and from the …

The purpose of this study was to investigate two underlying questions related to welfare reform and its impact on participants in the Cumberland Plateau Region: (1) What are the training and other noneducational needs of the participants in the VIEW program? and (2) What is the projected success of the impact of the training on the lives of the participants? The research study included 47 interviews with four distinct groups of individuals--VIEW participants, case managers, administrators, and trainers. It is costly to train the counselors who serve in intensive Family Preservation Services (IFPS). The hiring agency must pay for traveling expenses in addition to any fee paid for training. When an IFPS worker chooses to terminate employment before the end of two years of employment, this puts a strain on an already tight budget. This problem could be alleviated by finding an efficient pre-hire screening instrument. The three personality traits described in Hardiness Theory literature: commitment, challenge, and control, are traits often used to describe the ideal IFPS worker. The small rural mountain town of Alberton, MT located 32 miles west of Missoula, MT was the 1996 site of the largest contamination event in railroad history involving a mixture of chemicals. On April 11, 1996 a Montana Rail Link train derailed just west of the town of Alberton, leaking 130,000 pounds of chlorine gas, 17,000 of potassium cresylate (spent oil refinery waste), and 85 dry bulk pounds of sodium chlorate into the Alberton environment. Approximately 1000 people were evacuated from their homes, many for the seventeen day evacuation period that followed. The video documentary project that I embarked on …

The Octofoil is the offical publication of the Ninth Infantry Division Association, Inc., an organization formed by the officers and men of the 9th Infantry Division in order to perpetuate the memory of fallen comrades, preserve the esprit de corps of the Division, promote peace and serve as an information bureau about the 9th Infantry Division. The Association is made up of 9th Infantry veterans from WWII and Vietnam, spouses, widows and lineal descendants.

The incremental generation and disposal of hazardous waste, causing severe environmental pollution, has become one the world’s most important ecological problems starting with the Stockholm Conference in 1972. This paper examines two legislative reactions to pollution caused by hazardous wastes in the United States, under the Resource Conservation and Recovery Act 1976 (RCRA), and Argentina, in Law No. 24051. These advancements and interests require a regulatory framework to control the operation of, and competition within the telecommunications industry. This paper focuses on government regulation of telecommunication carriers, information services (internet), video-programming and wireless telecommunication (spectrum). The continuing influence of a myriad of alternative dispute resolution (ADR) techniques has permeated the field of family, and domestic relations law. This thesis reviews mediation as one of the ADR techniques in contrast with traditional court-litigation for divorce, child-custody disputes. The main part of the thesis addresses the weakness and ethical problems of mediation in domestic relations dispute. The thesis concludes with an acknowledgment of the successes of mediation in divorce cases while discussing the importance of the protection of confidential information which parties disclose during the mediation process.

The environmental marketing of goods and products have a substantial influence on the demand and supply. This thesis reviews the scope, advantages and disadvantages of diverse types of environmental marketing and further addresses the need for international regulations on eco-labeling programs. This thesis finds that there is a substantial connection between trade and environmental marketing which has resulted in the need for an international harmonization of eco-labeling strategies including the General Agreements on Tariffs and Trade (GATT).
