Fundamental Rights In The European Union, John P. Flaherty, Maureen E. Lally-Green Jan 1998

Fundamental Rights In The European Union, John P. Flaherty, Maureen E. Lally-Green

Duquesne Law Review

The process of European union has evolved from one based on economics alone to one concerned with keeping peace and the rights of individual citizens. This past year, the Member States of the European Union agreed upon the provisions of a new treaty that recognizes that the continued viability of the Union also depends on its people, not merely on its laws and institutions. The Treaty of Amsterdam focuses on the protection of fundamental human rights within the Union. When the member states ratify this treaty, as expected, individual citizens will be assured that the Union will protect their human …

Age Discrimination In Employment Act: Life After St. Mary's Honor Center V. Hicks - Rolling The Dice Against A Stacked Deck, David Culp

Duquesne Law Review

The Supreme Court of the United States' 5-4 decision in St. Mary's Honor Center v. Hicks has created uncertainty and confusion for both courts and parties involved in age discrimination cases. The Court noted in its decision that if Congress was displeased with the result, "[it] remains free to alter what we have done." In this article, the author strongly urges Congress to accept the Court's invitation and enact legislation to force courts to abandon the St. Mary's approach, which has effectively rewarded discriminatory practices by employers.

Utilizing An Effective Economic Approach To Family Court: A Proposal For A Statutory Unified Family Court In Pennsylvania, Stephanie Domitrovich

Duquesne Law Review

Pennsylvania's family court system is fragmented into various specialty courts. Other states have begun to reexamine the effectiveness of such a system and, using an economic framework, have taken steps to create unified family courts that better address the issues facing modern families and society. The author analyzes the effectiveness of such undertakings, discusses the underlying theories, and proposes that Pennsylvania implement a unified family court system by statute.

Autosomal Recessive Forms Of Limb-Girdle Muscular Dystrophy, David N. Catlett Jan 1998

Autosomal Recessive Forms Of Limb-Girdle Muscular Dystrophy, David N. Catlett

Mahurin Honors College Capstone Experience/Thesis Projects

Limb-girdle muscular dystrophy is a rarely occurring disease not recognized in the past as a distinct entity. Prior to the advent of sophisticated molecular biology techniques in the early I 990s, precise diagnosis of the disease was impossible. However, identification of the altered proteins and underlying genetic defects has brought limb-girdle muscular dystrophy to the forefront of recent biomedical research. Many articles concerning the investigation into limb-girdle muscular dystrophy have been published in genetic and neuromuscular journals since 1992. These fmdings are individually significant, but only a few publications have compiled the results into a comprehensive article relating all past …

Decision Record For The Environmental Assessment For Coal Planning Decisions In The Carbon Basin Area Of The Great Divide Resource Area, United States Department Of The Interior, Bureau Of Land Management

Record of Decisions (WY)

The Federal Coal Leasing Amendments Act of 1976 requires that Federal coal lands to be considered for leasing must be identified in a comprehensive land use plan. At the time the Great Divide Resource Management Plan (GDRA RMP, 1990) was prepared, approximately 60% of the Federal coal lands in the Carbon Basin Coal Area were leased and exempt from the coal screening/planning process. Subsequently, development of this lease was never pursued and the lease expired. In addition, the coal screening/planning process was not conducted on the remainder of the Federal coal lands in the Carbon Basin area during the RMP …
