Judges As Advicegivers, Neal K. Katyal

Since Alexander Bickel, scholars have understood the Supreme Court to have a threefold power: striking down acts for unconstitutionality, legitimating them, or employing the passive virtues. Professor Katyal contends that the Court wields a fourth power: advicegiving. Advicegiving occurs when judges recommend, but do not mandate, a particular course of action based on a concern for rule or principle. Courts have been giving advice, consciously at times, unconsciously at others, and this article seeks to provide a normative justification for the practice. Professor Katyal breaks down advicegiving into several categories and explains how advice, when given to the political branches, …

The Impact Of The Physical And Cultural Geography Of Southeastern Utah On Latter-Day Settlement, Sally Timmins Mandurino

Theses and Dissertations

The Latter-day Saint settlements in southeastern Utah, namely Bluff, Monticello and Blanding, were impacted by the physical and cultural geography of the area. These geographic elements hindered, and in some cases prevented, the Latter-day Saint colonizers from fulfilling the seven basic principles of Latter-day Saint expansion and colonization in the Great Basin. The impacts of physical geography were the geology, the climate, the soil and the rivers and streams. The impacts of cultural geography were the Navajo Indian Tribe, the Paiute Indian Tribe, and the criminal element. This thesis discusses the geographic elements of the area, how they impacted the …

Instituting Environmental Protection: From Red To Green In Poland, Daniel H. Cole

Under socialism, Poland suffered tremendous environmental devastation. After socialism, Poland's environmental performance has improved remarkably. This book explains that system-specific institutions of socialism undermined environmental protection by creating regulatory conflicts of interest that led the Party/state to soften budget and law constraints on polluters. Those problems have diminished in post-Communist Poland as socialist legal, political and economic institutions have been replaced by liberal-democratic institutions and competitive markets. The analysis carries important implications for an institutional theory of environmental protection.

Bioactivity Of Marine Organisms: Relationships With Taxonomy, Geography And Depth., John K. Reed, Susan H. Sennett, Peter J. Mccarthy, Tara P. Pitts, Amy E. Wright, Shirley A. Pomponi

Harbor Branch Oceanographic Institution (HBOI) has a worldwide collection of over 25,000 marine macro-invertebrates and algae representing diverse geographical, latitudinal, and depth (0-3000 ft) ranges. Samples are tested for biological activity in a panel of whole cell and enzyme/receptor assays, including antibacterial, antifungal, cytotoxicity, antitumor, and immunomodulatory assays. Of the taxa sampled, Porifera have the greatest incidence of activity within these screens and especially within the antimicrobial assays. Cnidaria, Chordata (Ascidiacea), Phaeophyta, and Chlorophyta also show strong antimicrobial activity. A comparison of bioactivity and depth of collection indicates that benthic organisms are active throughout the depth range of this study. …

The purpose of this article is to describe a 6th grade project intended to build responsibility in students for their own learning and develop an integration of curriculum areas through the study of Ancient Civilizations. Within this project, 6th grade students were involved in a research project with the final production of an ancient civilizations museum where they shared their knowledge and taught other students about their chosen civilization.

Evidence For Damaging Historical Earthquakes At Priene, Western Turkey, Erhan Altunel

Turkish Journal of Earth Sciences

The ancient cilty of Priene was one of the earliest Ionian settlements within the western part of the Büyük Menderes valley (the ancient Maeander River) and was first founded about 8 km in the east of the present site. The old Priene was probably destroyed by a destructive earthquake in the 350s BC and the city was shifted to the existing place in 350 BC. The new city contains an abundance of evidence related to earthquakes. The following evidence indicates that damaging earthquakes, occurred in the Büyük Menderes graben, caused great damage to the new Priene. (1) Part of the …

The purpose of this study was to explore the pedagogical methods of Hindu gurus that could be applicable to elementary school teaching for the inner development of students. With severe cutbacks to classroom instruction and demands by economic, political, and educational leaders for education to produce a highly skilled work force for the future of the economy, teachers are forced to use precision teaching for measurable learning.
