Under the First Amendment, "Congress shall make no laws respecting an establishment of religion or prohibiting the free exercise thereof." Nevertheless, congressional actors have on occasion enacted laws that expressly make religion the subject of legislation. Many scholars justify these laws on the grounds that Congress at the time of the Founding had an implied power to legislate on religion if necessary and proper to an enumerated end.

Professor Lash argues that the "implied power" theory cannot withstand historical scrutiny. Whatever "implied power" arguments may have emanated from the original Constitution, those arguments were foreclosed by the adoption of the …

This article examines the complex of cultural effects and possible legal responses in the wake of the Princess of Wales' death. To say that the paparazzi were complicit in her death is to forget that, in spite of their frequently invasive means of obtaining news, these were also the kind of journalists who were complicit in the public celebration of her life. Had the Hutchins Commission this tragedy to include in its deliberations about press responsibility, it likely would have stated its indignation and suggested Diana's death as more evidence that journalists be regulated. Relationships Among Grain Sorghum Quality Factors, Roberto A. Buffo, Curtis L. Weller, Anne M. Parkhurst

Correlations among grain sorghum quality factors (proximate composition, physical properties, and water absorption properties) were evaluated. Samples of 46 commercial hybrids (24 and 22 from crop years 1993 and 1994) were analyzed for starch, protein, crude free fat, test weight, absolute density, 1,000 kernel weight, percent kernel abraded, water absorption index, initial water absorption rate, and moisture saturation point. Test weight, absolute density, and percent kernel abraded were positively correlated among themselves (r > 0.5). Protein was negatively correlated with both test weight and absolute density (r < -0.5), while moisture saturation point showed negative correlations with test weight, absolute density, 1,000 kernel weight, and percent kernel abraded (r < -0.4). Principal component factor analysis through the covariance matrix explained 95% of the total variation of quality factors among hybrids (two factors), and, through the correlation matrix, 85% of the total variation (five factors). Water absorption rate decreased with increasing starch content of grain sorghum kernels as water absorption rate increased and amount of water for saturation decreased with softening of kernels.

West Wallabi Island in the Houtman Abrolhos, Western Australia, provides significant breeding habitat for the largest colony of Wedge-tailed Shearwaters, Puffinus pacificus, in the Eastern Indian Ocean. The Department of Conservation and Land Management (CALM) surveyed the Island in 1992 and estimated the population to be in excess of 1,117,000 pairs of breeding birds. Recent proposals to open the Abrolhos area to a larger number of visitors has identified the need for more detailed investigations into the relationship of birds and habitat. Young Children's Understanding Of Design In The Technology Process, Jean E. O'Sullivan

This study explored the development of children's thinking when social constructivist principles of learning were implemented through technological experiences. The study monitored the development of children's understanding of “design" through project work, using classroom based action research. In addition to investigating children's understandings, the study explored the use of technology in early childhood curriculum to develop the skills said to be required in the next millennium. The study found that five year old children are capable of "designing" and that technology is an effective vehicle for developing socially, contextually and culturally appropriate learning experiences.

Effective advertising campaigns are based on a systematic and detailed analysis of product, market, media, and consumer information. Advertisers and their agencies conduct a considerable amount of in-house research, especially personal and focused group interviews, to understand consumers' motivation and decision processes. This philosophy of scanning the environment, conducting research, and obtaining consumer insights in the development of an advertising campaign is essentially known as strategic planning (Gatignon and Burke, 1991).

The study focuses on the mineral and chemical composition, the textural characters and environmental assessment of some soils from the UAE. About forty soil samples were collected from AI Ain District and the Eastern Mountain District. Soils in AI Ain and its suburb are strongly influenced by the aeolian sedimentation, while those of the Eastern Mountain are formed in narrow valleys strikingly close to ophiolitic hinterland.

The studied soils· are remarkably impoverished in clay size fraction and clay minerals as well. This is due to the impeded chemical weathering under the prevailing arid climate. Corroborative techniques including X-ray diffraction, infrared …

The Korea Journal’s series of articles addressing the question of civil society are a timely addition to the struggle over the discourse of democracy which is common to many countries in Pacific Asia. Since Professor Han Sang-Jin’s article does an excellent job of critically summarizing Chung Chulhee, Cho Hein and David Steinberg’s arti cles on Korean civil society, it seems that there is not much more to be said on the topic. Computers equipped with a Graphical User Interface (GUI) and connected to the Internet are common in both the business and educational communities. These computers, using a web browser, easily share programs written in the Java programming language that are able to execute on a variety of heterogeneous machines.

While programs written in many languages will not execute unmodified on different computing platforms because of portability restrictions, Java has overcome these limitations and provides a platform independent language. Behavioral And Emotional Indicators Of Sexual Abuse: A Comparison With Physically Abused And Non-Abused Children, Janine L. Post-Anderle

The focus of this study was to identify behavioral and emotional symptoms among hospitalized children who were 1)sexually abused 2)physically abused 3)non-abused, and non-hospitalized non-abused children.

Information about children between the ages of 6 and 12 was obtained through a retrospective analysis of 120 closed records from two different child psychiatric hospitals. A convenience sample of 40 parents with non-hospitalized children was used to obtain data about non-hospitalized non-abused children.

The “Child Behavior/Emotion Checklist”, developed by the author, was used to collect data regarding symptoms exhibited by children. Results indicated no difference in symptoms among the hospitalized groups of children. …

The Effect Of Eccentric Fatigue Of The Hamstrings On Knee Joint Proprioception, Kenneth M. Arends, Scott T. Miller, John T. Vandermaas

The purpose of this study is to determine the effects of eccentric hamstring fatigue on the ability to accurately reproduce different knee joint angles. Thirty-one males and 29 females, 18-40 years old, were randomly assigned to treatment and control groups. Using the Biodex®, proprioceptive pre-test and post-test measurements were taken having the blindfolded participant replicate predetermined angles of 25°, 45°, and 65°. The control group underwent a passive movement protocol and the treatment underwent a fatigue protocol. Data Analysis was performed using 2-tailed t-test comparing the means of pre-test and post-test angle accuracy measurements for the control and treatment groups. …

Crosstalk: Surface Versus Intramuscular Electrodes For The Peroneus Brevis And Peroneus Longus, Tanya Cardillo, Susan Dresden, Jacquelyn Solem

The purpose of this descriptive study was to measure crosstalk when using surface electrodes over the peroneus brevis and peroneus longus muscles. EMG was recorded from the right lower extremity of 14 normal subjects, taken from a sample of convenience. Surface electrodes were applied over the peroneus brevis and peroneus longus muscles; fine wire electrodes were inserted into the peroneus longus, peroneus brevis, anterior tibialis and extensor digitorum longus muscles of each subject. During manual muscle tests for the peroneals, anterior tibialis, and extensor digitorum longus, data were recorded from all electrodes simultaneously over 5 trials of each. Pearson product-moment …

The purpose of this study was to evaluate the effect that a five-day horseback riding program had on the standing and/or sitting balance of children ages eight to eighteen afflicted with a variety of disabling diagnoses. The stated hypothesis is that after participating in a five-day session of therapeutic riding, subjects will show significant improvement in standing and/or sitting balance as measured by the Functional Reach Test (FRT) and the Modified Functional Reach Test (MFRT). As educators and future educators, we will be working with students from diverse groups and all walks of life. Many of us enter this field entrenched in our own culture with no real understanding of how others' life experiences have influenced their values and beliefs. The multicultural courses in the College of Education force us to examine how we came to adopt our values and from where our beliefs originated. No other course in the graduate curriculum forces us to challenge the myths and stereotypes of American society as profoundly as these courses.
