Competitive Issues In The Deregulated United States Railroad Industry, Johannes Christian Koeppe Nov 1997

Competitive Issues In The Deregulated United States Railroad Industry, Johannes Christian Koeppe

Student Work

In 1980, the railroad industry was deregulated due to poor industry performance as well as an ideological shift. The newly developed contestable market theory provided the political justification for deregulating what was previously perceived as a natural monopoly. The theme of this study is the examination of whether contestable market conditions exist in the U.S. surface transportation industry which are sufficient to justify giving up direct governmental involvement in the railroad industry. The main generic market structures that play an important role in the regulatory discussion are introduced and implications for regulatory intervention in the case of railroads are drawn. …

An Investigation Of The Heat Transfer Suppression Mechanisms In The Pool Boiling Of Aqueous Solutions Of Ethylene Glycol, Lucas Alves Nov 1997

An Investigation Of The Heat Transfer Suppression Mechanisms In The Pool Boiling Of Aqueous Solutions Of Ethylene Glycol, Lucas Alves

Theses

An experimental investigation of the heat transfer behavior of a binary system, whose constituents are water and ethylene glycol, is undertaken. The objectives of this study are: 1 . To conduct a comprehensive literature search. 2. To examine the effect of certain parameters on the heat transfer suppression mechanisms of binary systems. 3 . To gather new data for boiling heat transfer of aqueous ethylene glycol solutions, over the entire range of concentrations. The dilute concentration range, with solutions of 0.0 - 0. 1 mass fractions, is given special attention in clarifying what are the effects of surface tension, mass …

The Role Of The "Harm/Benefit" And "Average Reciprocity Of Advantage" Rules In A Comprehensive Takings Analysis, Lynda J. Oswald Nov 1997

The Role Of The "Harm/Benefit" And "Average Reciprocity Of Advantage" Rules In A Comprehensive Takings Analysis, Lynda J. Oswald

Vanderbilt Law Review

A "regulatory taking" occurs when the government does not formally exercise its power of eminent domain, but enacts a law or undertakes an action that results in a de facto "taking" of property for which compensation is constitutionally mandated., The United States Supreme Court has struggled for decades to determine when a land use regulation is a valid exercise of the police power (and thus not subject to the compensation requirement of the Fifth Amendment to the United States Constitution) and when such a regulation goes "too far" and becomes a regulatory taking.

The Supreme Court has developed a number …

A Straitjacket For Employment At-Will: Recognizing Breach Of Implied Contract Actions For Wrongful Demotion, Gregory M. Munson Nov 1997

A Straitjacket For Employment At-Will: Recognizing Breach Of Implied Contract Actions For Wrongful Demotion, Gregory M. Munson

Vanderbilt Law Review

For over a century, employment at-will has been the law in almost all American jurisdictions.' As a result, employers can fire their employees, and employees can quit, with or without reason. In addition, employers have the authority under the at-will rule to regulate all terms and conditions of employment. During the past two decades a series of judicial exceptions to the at-will rule that prohibit termination of an employee for a variety of reasons have eroded the at-will doctrine. These exceptions fall into two categories. First, an employer may not terminate an employee for reasons that violate public policy Second, …

No More Excuses: Refusing To Condone Mere Carelessness Or Negligence Under The "Excusable Neglect" Standard In Federal Rule Of Civil Procedure 60(B)(1), Bree W. Weathersbee Nov 1997

No More Excuses: Refusing To Condone Mere Carelessness Or Negligence Under The "Excusable Neglect" Standard In Federal Rule Of Civil Procedure 60(B)(1), Bree W. Weathersbee

Vanderbilt Law Review

Rule 60(b)' is an attempt to codify the equitable, common law practice of reforming judgments under special circumstances. The rule, inter alia, authorizes a court to relieve a party from a default judgment for "excusable neglect." This standard, however, is not defined in the rules, and courts have struggled with its meaning. Some circuits define the term liberally and often grant requests to vacate default judgments. Others adopt a strict interpretation and consistently refuse to vacate default judgments resulting from mere carelessness or negligence. Recently, in Pioneer Investment Services Co. v. Brunswick Associates Ltd. Partnership, the Supreme Court clarified the …

Ornamental Nationalism: Indigenous Images In Porfirian Mexico, 1876-1911, Seonaid Valiant

Dissertations and Theses

When General Porfirio Dfaz became president of Mexico the country was unstable. During his years of leadership, 1876-1911 he managed an uneven stability. One method he used to promote nationalism was the use of symbols. This thesis derives from the theory introduced by the historian of Mexican economy, Barbara Tenenbaum, that the Porfirian administrators attempted to establish themselves as the legitimate rulers of the Mexican nation by forging a line of succession from the ancient Aztecs to themselves through association with indigenous symbols and territory. The intention of this thesis is to demonstrate that the Mexican government manipulated images of …

Task Scheduling In Networks, Cynthia Phillips, Clifford Stein, Joel Wein Nov 1997

Task Scheduling In Networks, Cynthia Phillips, Clifford Stein, Joel Wein

Dartmouth Scholarship

Scheduling a set of tasks on a set of machines so as to yield an efficient schedule is a basic problem in computer science and operations research. Most of the research on this problem incorporates the potentially unrealistic assumption that communication between the different machines is instantaneous. In this paper we remove this assumption and study the problem of network scheduling, where each job originates at some node of a network, and in order to be processed at another node must take the time to travel through the network to that node.

Our main contribution is to give approximation algorithms …

Salinity And Hydrology Of The Mills Lake Catchment, R Ferdowsian, A T. Ryder

Resource management technical reports

The Mills Lake Catchment is located north of the Ongerup-Jerramungup Road, 35 km west of Jerramungup and 10 km north-east of Ongerup. It covers about 23,800 ha of agricultural land that is more than 90% cleared and predominantly cropped. The average annual rainfall of the catchment is about 370 mm. Many low-lying parts of the study area have become salt-affected during recent years. The extent of soil salinity is growing rapidly and it is feared that, without any treatment, more land will become salt-affected.

Startegy And Force In The Liquidation Of Secured Debt, Ronald J. Mann Nov 1997

Startegy And Force In The Liquidation Of Secured Debt, Ronald J. Mann

Michigan Law Review

The question of why parties use secured debt is one of the most fundamental questions in commercial finance. The commonplace answer focuses on force: A grant of collateral to a lender enhances the lender's ability to collect its debt by enhancing the lender's ability to take possession of the collateral by force and sell it to satisfy the debt. That perspective draws considerable support from the design of the major legal institutions that support secured debt: Article 9 of the Uniform Commercial Code and the less uniform state laws regarding real estate mortgages. Both of those institutions are designed solely …

The Origin, Development, And Regulation Of Norms, Richard H. Mcadams Nov 1997

The Origin, Development, And Regulation Of Norms, Richard H. Mcadams

Michigan Law Review

For decades, sociologists have employed the concept of social norms to explain how society shapes individual behavior. In recent years, economists and rational choice theorists in philosophy and political science have started to use individual behavior to explain the origin and function of norms. For many in this group, the focus of study is the interaction of law and norms, of formal and informal rules. Exemplified by Robert Ellickson's Order Without Law, this literature uses norms to develop more robust explanations of behavior and to predict more accurately the effect of legal rules. Norms turn out to matter in legal …

Equal Protection, Class Legislation, And Colorblindness, Melissa L. Saunders Nov 1997

Equal Protection, Class Legislation, And Colorblindness, Melissa L. Saunders

Michigan Law Review

Scholars and judges have long assumed that the Equal Protection Clause is concerned only with state action that has the effect of singling out certain persons or groups of persons for special benefits or burdens. Under the traditional doctrinal framework, state action that has this purpose and effect bears a certain burden of justification under the clause, a burden whose stringency varies, depending on the criteria used to define the class being singled out for special treatment and the importance of the interest affected. But state action that lacks such a "discriminatory effect" is not, on the traditional understanding, subject …

Psychology Faculty Research and Publications

Brains from 41 aged canines (≥10 years of age) were examined immunohistochemically to characterize the laminar distribution and age-related progression of β-amyloid (Aβ) in frontal cortex. We classified the Aβ patterns into four distinct types. Type I was characterized by small, faint deposits of Aβ in deep cortical layers. Type II consisted of diffuse deposits of Aβ mainly in layers V and VI. Type III had both dense plaques in superficial layers, and diffuse deposits in deep layers. Finally, Type IV had solely dense plaques throughout all layers of cortex. We compared the A …
