Martial Lawlessness: The Legal Aftermath Of Kwangju, James M. West Jan 1997

Martial Lawlessness: The Legal Aftermath Of Kwangju, James M. West

Washington International Law Journal

On August 26, 1996, two former presidents of the Republic of Korea, Chun Doo-Hwan and Roh Tae-Woo, were convicted of insurrection, treason, and corruption. The charges arose out of their December 1979 coup and the ruthlessly violent suppression of a democratic protest in the city of Kwangju in May 1980. This article recounts the origins and analyzes the progress of this dramatic criminal trial, which has attracted worldwide attention. The current South Korean head of state, President Kim Young-Sam, has depicted the conviction of his predecessors as a historic juncture opening a new era of constitutionalism for Korea. Despite the …

Toward Excellence In Board Performance, N Balasubramanian Jan 1997

Toward Excellence In Board Performance, N Balasubramanian

IIMB Management Review

Is the board of directors the heart and soul of a company as it should be, ideally, or merely an 'old boy's club' which rubber stamps decisions taken by the CEO? Can it be a meaningful instrument of corporate governance? Various aspects such as the creation and running of an effective board, the difference between directing and managing, the interface between the board and the CEO, including the public sector perspective on the issue have been discussed by academicians and senior corporate executives.

Between 1991 and 1996 Russia underwent a precipitous economic and social decline with decreases in production, gross national product, and wages, and increases in inequality, crime, and corruption. Most people experienced a decline in their standard of living, and many fondly recalled the security and stability of the communist era.

Jewish Legal Theory And American Constitutional Theory: Some Comparisons And Contrasts, Samuel J. Levine Jan 1997

Jewish Legal Theory And American Constitutional Theory: Some Comparisons And Contrasts, Samuel J. Levine

UC Law Constitutional Quarterly

In recent years, American legal scholars have relied increasingly on Jewish law. Scholars have employed concepts from Jewish law in the analysis of health law, criminal law, legal ethics, legal interpretation, and constitutional law. Despite this trend, legal scholars continue to debate the value and validity of applying Jewish legal principles to American legal theory. This Article explores some of the ways in which Jewish law may shed light on issues in American constitutional theory. While acknowledging that there are fundamental differences between a religious legal system and a secular one, this Article argues that certain conceptual similarities between American …

Abraham Lincoln And The Doctrine Of Necessity, Allen C. Guelzo Jan 1997

Abraham Lincoln And The Doctrine Of Necessity, Allen C. Guelzo

Civil War Era Studies Faculty Publications

Abraham Lincoln was a fatalist. That, at least, was what he told many people over the course of his life. "I have all my life been a fatalist," Lincoln informed his Illinois congressional ally, Isaac Arnold. "Mr. Lincoln was a fatalist," remembered Henry Clay Whitney, one of his Springfield law clerks, "he believed ... that the universe is governed by one uniform, unbroken, primordial law." His Springfield law partner William Henry Herndon, likewise, affirmed that Lincoln "believed in predestination, foreordination, that all things were fixed, doomed one way or the other, from which there was no appeal." Even Mary Todd …

The New Dynamics Of Self-Determination, Valerie Epps

ILSA Journal of International & Comparative Law

The term self-determination still teeters on the borders of evolving legal precept, expression of political will, and universal human aspiration. The concept never quite settles down into a black letter law pronouncement or a clearly understood political dynamic.

Spiritual Disciplines And The Practice Of Integration: Possibilities And Challenges For Christian Psychologists, Mark R. Mcminn, Barrett W. Mcray

Faculty Publications - Doctor of Psychology (PsyD) Program

Spiritual practices have received less attention than psychological change techniques in the contemporary integration of psychology and Christianity, yet a Christian understanding of health has implications for the personal and professional use of spiritual disciplines as mechanisms for growth. We consider the practical nature of the spiritual disciplines in promoting change as well as possibilities and challenges introduced by using spiritual disciplines both outside and inside the consulting office. Used outside the consulting office, spiritual disciplines may affect the professional life of the Christian therapist by deepening his or her knowledge of God, promoting a posture of humble self-awareness, and …

Environmental Quality As A National Good In A Federal State, Richard B. Stewart Jan 1997

Environmental Quality As A National Good In A Federal State, Richard B. Stewart

Faculty Articles

Adoption of new approaches to securing the national good of environmental quality will depend critically on the intermediaries who determine or influence how public demand for environmental quality is channeled into the design and implementation of concrete environmental policy measures. These intermediaries are political and policy entrepreneurs, the media, legislators, regulators and administrators, environmental groups, industry, and others. Many of these intermediaries have a strong vested interest in the existing centralized command and control system. Many will continue to try to use environmental regulation to extract rents or otherwise advance their interests. These realities must be taken into account in …
