The Military-Bureaucracy Relationship In Nigeria: A Study Of Public Policy Making And Implementation, Robert Aziakpono Dibie Apr 1997

The Military-Bureaucracy Relationship In Nigeria: A Study Of Public Policy Making And Implementation, Robert Aziakpono Dibie

Dissertations

The Federal Government of Nigeria’s Structural Adjustment/Make-or-Buy policy was introduced in July 1986 to accelerate the development of Nigerian industrial capacity by contracting government R & D out to the private sector. This study expands the empirical and theoretical analyses of development policy and its implementation that have traditionally relied on motives of "rationality" (costs/benefits) to explain bureaucratic behavior. It examines and juxtaposes the military-dominated policy making apparatus with the traditional bureaucracy, which has the responsibility for the execution of public policy. It also attempts to make some contribution to Nigerian and comparative literature in the field of industrial development …

Plain English Or Plain Confusing, Dylan Lager Murray Apr 1997

Plain English Or Plain Confusing, Dylan Lager Murray

Missouri Law Review

A "presumption of perfection" attaches to the pattern instructions that Missouri judges read to jurors in every civil case.' Missouri law presumes that these instructions, as set forth in Missouri Approved Jury Instructions("MAI") Fifth Edition, are not only infallible statements of the law, but also perfectly comprehensible to the average juror. Even if jurors in a given case complain that they do not understand a particular pattern instruction, the trial judge is without recourse, required to leave these instructions undisturbed even if a more understandable improvement might result. In contrast to the emphasis in many states upon legal accuracy,' as …

Repose Or Not? Informal Objections To Claims Of Exemptions After Taylor V. Freeland, Kenneth D. Ferguson Apr 1997

Repose Or Not? Informal Objections To Claims Of Exemptions After Taylor V. Freeland, Kenneth D. Ferguson

Faculty Works

In Taylor v. Freeland & Kronz, over the trustee's untimely objection, the Supreme Court permitted the bankruptcy debtor to exempt $110,000 that was ineligible under substantive exemption law. The Court rejected the view that unless the debtor had a good faith claim to the exemption or a statutory basis for the exemption, even an untimely objection to the debtor's claim of exemption could terminate the debtor's right to the exemption. Disturbed by the prospects of debtors receiving unjustified windfalls, several courts have developed "informal objection" doctrines to circumvent the "strict constructionist" doctrine of Taylor. However, Taylor's potential for encouraging debtors …

Law And Iconomics, Jeanne L. Schroeder, David G. Carlson Apr 1997

Law And Iconomics, Jeanne L. Schroeder, David G. Carlson

Articles

Peter Goodrich's Oedipus Lex critically examines the English common law tradition through a psychoanalytic lens, revealing a 'legal unconscious' that underscores deep-seated repressions and contradictions. He argues that common law has historically attempted to exclude imagery and the feminine, yet these elements persist, leading to internal conflicts. By analyzing historical legal texts from the Elizabethan and Jacobean periods, Goodrich exposes violent rhetoric against enemies of the common law, such as Catholics and women, highlighting the law's struggle with its own unconscious structures.

Nine Complementary Principles To Retain Adults In An Esol/Literacy Program, Edmund T. Hamann Apr 1997

Nine Complementary Principles To Retain Adults In An Esol/Literacy Program, Edmund T. Hamann

Department of Teaching, Learning, and Teacher Education: Faculty Publications

The following list of principles is my attempt to share general recommendations to teachers of ESOL and/or limited literacy adults based on my specific practice running a bilingual family literacy program and confirmed by my more recent experience as a volunteer bilingual literacy teacher at the Asociación Latinoamericana (in Atlanta). Though I believe in bilingual classroom environments, I think the principles identified here are also pertinent to monolingual ESL environments.

Plain Meaning, The Tax Code, And Doctrinal Incoherence, Mary L. Heen Apr 1997

Plain Meaning, The Tax Code, And Doctrinal Incoherence, Mary L. Heen

Law Faculty Publications

This Article examines the Supreme Court's interpretive approach in recent tax cases. Part I of the Article sets the stage by describing the Court's interpretive approach, its focus on the relative determinacy of statutory language, and the backdrop of Chevron. Part II examines the effect of these issues on tax law, focusing on three cases that construe the same Code provision, section 104(a)(2), but apply quite different interpretive approaches. In United States v. Burke, the Court appeared to find the provision ambiguous and relied in part upon an interpretation of the statute contained in a Treasury regulation. Subsequently, in Commissioner …

Language Literacy As A Socializing Agent For Hispanic Juvenile Offenders, Ángeles González-Aller Apr 1997

Language Literacy As A Socializing Agent For Hispanic Juvenile Offenders, Ángeles González-Aller

Leadership Studies Dissertations and Theses

This study explored the links between literacy and the school experiences of Hispanic Juvenile Offenders that may have led to their dropout and delinquent behavior. It examined language literacy in terms of its role in the socialization of these juveniles from their primary language and culture into a secondary language and culture. Literacy as used in this study is that defined by Freire (1988), Giroux (1993), and Macedo (1994). Literacy must be explored in terms of a critical literacy, which empowers individuals to make informed decisions over their own lives. In order for this to occur, individuals must possess a …

The Susceptibility Of Formal Models Of Evidentiary Inference To Cultural Sensitivity, Ron A. Shapira Apr 1997

The Susceptibility Of Formal Models Of Evidentiary Inference To Cultural Sensitivity, Ron A. Shapira

Cardozo Journal of International and Comparative Law

The article examines whether formal models of evidentiary inference, specifically probabilistic (Pascalian) and inductive (Baconian) models, can accommodate cultural sensitivity. It argues that both models fail to adequately address cultural factors, which significantly influence evidentiary judgments. The probabilistic model overlooks the cultural context in sample space selection, while the inductive model, though rooted in a socially sensitive philosophy of science, does not explicitly incorporate cultural influences. This omission leads to potential biases and inaccuracies in legal proceedings.

The Construction Of Art On The Internet And The Mediating Influence Of The Search Engine, Brett Stalbaum Mar 1997

The Construction Of Art On The Internet And The Mediating Influence Of The Search Engine, Brett Stalbaum

SWITCH

This article examines how the nature of different search engines affect the visibility of artwork in the internet age. It defines three types of search engines: one of them based broadly on keywords and customer tailored experiences, one akin to a curated library of specified interests, and the last focused keenly on the catalogs of subcultures. It concludes that in order for art to gain traction with these search engines, the artist must be keenly aware of what their work is, and what they want it to represent. The author states that it is necessary for the contemporary artist to …
