In the early 1990s, I spent a couple of years as Chief of the Criminal Division in the Office of the U.S. Attorney for the Southern District of New York. One of my principal responsibilities was to hear "appeals" from defense lawyers, usually, although not exclusively, in white collar crime cases. These lawyers felt that their clients should not be indicted, or that the plea offer they had received from the prosecutor in charge of the case was unduly severe. Legal specialization takes several forms: decision-makers and advocates can specialize in particular types of cases, specialized rules can govern particular types of disputes, facts may be found by experts, appeals heard by special courts, or some or all of these combined. The American and New Zealand employment and labor law regimes make different use of specialized decision-makers, in part because of differences in their use of specialized legal rules for labor and employment law. These differences provide an opportunity to assess the appropriateness of specialization in legal decisionmaking.

In recent decades there has been an increasing interest in the ethical dimensions of leadership. James MacGregor Burns' (1978) watershed work, Leadership, heralds an intellectual breakthrough for grasping the significance of a moral level of consciousness that is universal. Although Burns (1978) writes that humanistic psychology now allows for generalization about leadership process across cultures, there remains little research which frames leadership in a Global Ethic, in humanistic psychological constructs or as philosophical ideas of a universal ethical consciousness. The Political Behavior Of California Community College Nursing Facilities In Response To Budget Cutbacks, 1982-1987, Karen J. Berger Edd

This study explored the political behavior of community college nursing faculties during a unique period of California history, 1982-87, when the community colleges were struggling to adapt to the economic and political consequences of Proposition 13. Using a two-phase qualitative design, it examined the effects of budget cutbacks on the nursing programs at 38 community colleges statewide, including twelve targeted for faculty layoffs, and identified the political behavior of their nursing faculties in response. It then focused on six districts, varying in size, structure, and location, for a series of in-depth case studies. In four districts, nursing programs were targeted …

Morale is important to all service organizations because quality is dependent upon the nature of face-to-face interactions. Because the workers in mental health service organizations must care for patients, morale is especially important. Although studies suggest that rapid change due to cutbacks, privatization, and managed care, have demoralized mental health workers, the literature suggests that management is the problem. Mechanistic organizations with top-down, command-control management typically exclude and alienate workers. Continuous quality improvement (CQI) can improve morale as well as the bottom-line. Fourth Amendment Accommodations: (Un)Compelling Public Needs, Balancing Acts, And The Fiction Of Consent, Guy-Uriel Charles

The problems of public housing-including crime, drugs, and gun violence- have received an enormous amount of national attention. Much attention has also focused on warrantless searches and consent searches as solutions to these problems. This Note addresses the constitutionality of these proposals and asserts that if the Supreme Court's current Fourth Amendment jurisprudence is taken to its logical extremes, warrantless searches in public housing can be found constitutional. The author argues, however, that such an interpretation fails to strike the proper balance between public need and privacy in the public housing context. The late 1990’s in Australia have seen major stresses in State and Federal systems of early years provision and have highlighted the need to develop an integrated approach to early years policy and provision to meet better the changing needs of Australian families. As an experienced Australian practitioner in the early years, the researcher decided to explore another country’s approach to early childhood provision and to contextualise her Australian experience from a fresh perspective. In Kandel’s (1933, 1955) terms, this is a classic area study rather than one which seeks to merely to compare and contrast.

Disease of the respiratory tract is a major problem for cattle and it continues to cause serious economic losses for producers. Bovine respiratory disease (BRD) causes increased death losses as well as medication costs, labor, and lost production. Many different infectious agents may cause similar clinical signs. It was the aim of this dissertation to determine if and how religiousness in family members caring for relatives suffering from dementia affects the mental health of family caregivers. To that end two theories were presented for testing in the form of path models. These theories were based on stress-process cognitive theory as adapted to the dementia caregiver situation. In this theory caregiver strain (mental distress) was thought to be mediated by cognitive appraisal, and appraisal to be influenced by contextual characteristics, personal and family resources, and stressors. The problem being addressed through this study is the need to adequately understand the significance of the spiritual experience for older adults, especially as related to their resolution of the final life stage of integrity versus despair as conceptualized by Erikson (1963). Qualitative research methods were utilized to conduct and analyze structured interviews with six older adults. Interview questions were validated by past research efforts on spirituality and on integrity versus despair. Bird populations and forest vegetation were monitored before (1984-86), during (1987-88) and after (1989-96) a gypsy moth outbreak and subsequent defoliations at the Sleepy Creek Public Hunting and Fishing Area in Morgan and Berkeley Counties, West Virginia. The objective of this study was to examine how gypsy moth defoliation affected forest vegetation, and how changes in forest structure and composition affected bird populations and the nesting ecology of four bird species. Repeated defoliations killed many overstory trees (primarily oaks, Quercus spp.), opening the forest canopy and allowing vigorous growth of understory vegetation. This dissertation is composed of two topics that share the focus of placental vascular tone control. In the first investigations, we looked at the effect of caffeine (Caff; 10nmol/L-10{dollar}\\mu{dollar}mol/L), nicotine (Nic), and cotinine (Cot) (1nmol/L-100{dollar}\\mu{dollar}mol/L for both) administration on isolated placental blood vessels, to see if these substances altered placental vascular tone. We found that moderate relaxations were initiated by all three alkaloids in precontracted placental blood vessels. We also found that pretreatment of placental blood vessels and Caff, Nic, and Cot did not alter responses to a variety of contractile agents. In conclusion, it would seem that the adverse …

The purpose of this study was to compare the perceptions held by female and male osteopathic students in regard to the status of women in the osteopathic medical education environment. Three general categories were examined: family/career conflict, professional representation, and gender discrimination. A sample of 576 students finishing their second year of education at five osteopathic medical schools in the United States was surveyed with a final return rate of 69.44%. Particle mixing by the polychaete Capitella sp. 1 was investigated in a 22 d microcosm experiment in the presence and absence of the sediment-bound polycyclic aromatic hydrocarbon (PAH) fluoranthene. Mixing by Capitella sp. 1 (30000 ind. m–2) was examined using glass bead tracers (diam. = 30 to 100 μm) with and without a pulse introduction of fluoranthene to the sediment surface. Worms had a profound effect on the sediment appearance and reworked sediment in a conveyor-belt fashion. The predominant mode of mixing was bioadvective, and the worms created a subsurface maximum in the glass bead tracer profiles. Glass …

Lactose intolerance is frequently encountered in children with persistent diarrhoea (PD). Selection of an appropriate milk-based formulation is a major management problem in the developing world. In a consecutive series of studies, we evaluated the role of feeding a traditional rice-lentil (khitchri) diet alone (KY) or in combination with either soy formula (KY-Soy) a dilute buffalo milk (KY-B), in children (age 6 months-3 years) with PD. Serial observations of stool output, caloric intake and weight gain of these children over a 14 day period indicated satisfactory tolerance of the KY diet with adequate weight gain. A series of acyclic phosphonomethylether nucleosides were synthesized and then evaluated for inhibitory activity against respiratory viruses of clinical significance using CPE inhibition, neutral red uptake and virus yield reduction assays. Of the 20 compounds synthesized, none significantly inhibited influenza A or B viruses or respiratory syncytial virus strains A2, Long or 18537; the selective indices (SI) were less than 10. A new compound, GS-2128 (2R, 5R-9-[2,5-dihydro-5-(phosphonomethoxy)-2-furanyl]adenine; D4API), selectively inhibited adenovirus 5 (SI>10) as did GS-0577 (9-(3-hydroxy-2-phosphonylmethoxypropyl)-adenine; HPMPA) and GS-0504 [(S)-1-[3-hydroxy-2-(phosphonylmethoxypropyl)]-cytosine; HPMPC]. The 50% effective concentrations (EC50) ranged from 8-100 μg mL-1 and 50% cell inhibitory concentrations (CC50) from …
