Housing Abandonment And New York City's Response, David J. Reiss

This article reviews and evaluates the debate surrounding the management and disposition of city-owned housing in New York City, paying particular attention to those programs that rely on for-profit landlords. The first section reviews the theory and history of housing abandonment by the private sector and the City's responses to it. The second section documents the history of POMP and summarizes the studies that have been made of it by the City, the business-centered advocacy community, and the tenant-centered advocacy community. Education on death, dying, bereavement, and end-of-life care is a vital component of the basic preparation of the registered nurse. Yet, practicing nurses continue to report that programs offered in nursing schools do not prepare them adequately to provide comprehensive care to the dying. An explanation given in the literature is that some nurse educators do not value the inclusion of death education in the nursing curriculum. These educators argue that the current curricula are already too full and that skills related to the care of the dying are not as important as life-sustaining skills. Student discipline in the public schools has been a major public concern. Public elementary schools in school districts in and around Little Rock, Arkansas are faced with rising numbers of discipline referrals resulting in out-of-school suspensions. This study examined three questions: (1) Is there a significant relationship between elementary school climates (open, closed, mixed) and the relative frequency of suspensions? (2) Is there a significant relationship between elementary school teachers' and principals' pupil control orientation, humanistic or custodial, and the frequency of suspensions assigned? The purpose of this study was two-fold: (a) to describe nurses' perception of collaborative practice behaviors with physicians in a 529 bed mid-western acute care hospital setting and to relate those findings to nurses' satisfaction, and (b) to describe the perceptions of collaborative practice behaviors reported by physicians.

The study was a cross-sectional descriptive correlational design. The convenience sample included 264 nurses, 72 staff physicians and 22 medical residents in a sample setting of medical-surgical, critical care, pediatrics, women's health services, emergency, and surgical services departments. The study used the Collaborative Practice Scales (CPS) to measure nurse and physician perceptions …

Development Of A Scale To Assess Concern About Falling And Applications To Treatment Programs, Michelle M. Lusardi, Everett V. Smith Jr.

This study used Rasch methodology to pursue three goals. First, we sought to demonstrate the psychometric limitations of the Falls Efficacy Scale (Tinetti, Richman, & Powell, 1990). Second, we addressed these limitations using a simultaneous calibration of the Falls Efficacy Scale and Mobility Efficacy Scale items. Third, we review previous explorations of the self-efficacy construct in relationship to health behaviors and discuss a possible treatment program based on the simultaneous calibrated items and Social Cognitive Theory. Results indicate that responses from the Falls Efficacy Scale fail to assess the higher ends of the self-efficacy continuum. Simultaneous calibration of items improved …

Unveiling Protectionism: Anti-Dumping, The Gatt And Suggestion For Reform, Patrick Gay

While anti-dumping actions taken under the auspices of the GATT are becoming increasingly prevalent, many commentators have questioned their economic justification and called for the replacement of current anti-dumping provisions with a system based upon competition law principles. This paper reviews the economic analyses, in light of political considerations, and suggests that calls for reaching reforms are premature and ignore the important safety valve function of anti-dumping measures. The paper concludes that a public economic interest provision should be added to the GATT Anti- Dumping Code, and that anti-dumping regulation should be subsumed within expanded safeguard provisions of the GATT …

The recent Supreme Court of Canada decision in Egan v. Canada has resulted in significant controversy and unanswered questions surrounding the status of homosexual couples. Egan has also raised doubts as to the status of the Canadian Charter of Rights and Freedoms section 15(1) analysis first announced in Andrews v. Law Society of British Columbia and later expanded in R. v. Turpin. Egan was released concurrently with Miron v. Trudel and Thibaudeau v. Canada. In this article the author considers three examples of modern constitutional doctrine that show how judges have stolen bits and pieces from popularized skepticisms about the job of judging and have molded this stolen rhetoric into doctrine. In the first example, she asks whether constitutional law's recent penchant for doctrinal rules based on "clear law" could have existed without the modern age's obsession with legal uncertainty. In his reply to my article on workplace harassment law and freedom of speech, Professor Volokh does not respond to my most important critiques of his earlier work. For example, he fails to grapple with the true complexity of the problem by focusing exclusively on one side of this conflict of rights-the burden that the law imposes on workplace expression. Equal attention must be paid to the other side: the harm inflicted by discriminatory speech on employees of a single gender. The Santa Clara Experiment: A New Fee-Generating Model For Clinical Legal Education, Patricia Pierce, Kathleen Ridolfi

Santa Clara University's Law Clinic was established over twenty-five years ago. From January 1995 through May 1996, we experimented with a fee-generating model at the Clinic which consisted of an employment law project operating in conjunction with the criminal defense clinic already in place. Our results exceeded our expectations and offer an encouraging new model for a clinical program that can generate substantial fees without compromising the goals and values of clinical educators. In recent years a lively and often heated debate has arisen in clinical scholarship about the feasibility and utility of implementing fee-generating legal clinics. This debate has …
