Externship Site Inspections: Fitting Well-Rounded Programs Into The Four Corners Of The Aba Guidelines, William Wesley Patton

Robert Seibel and Linda Morton recently charted the demographics of externship programs. They lauded "the incredible diversity of programs which currently exist," but warned that the American Bar Association's (ABA) "micromanagement" regulatory approach which focuses on "content review" rather than addressing "institutional support" will serve as a decrement rather than an enhancement of externship programs. This is a companion essay which focuses not on who we are, but rather on whom the ABA wants us to be and the methods employed during site inspections to insure uniformity. It is difficult to speak briefly of the extraordinary accomplishments of Edgar S. Cahn and Jean Camper Cahn in the fields of poverty law, human rights, and clinical legal education. These achievements, described eloquently by the University of the District of Columbia School of Law Faculty in their unanimous nomination of the Cahns for the Section's Award, have decisively shaped the meaning of the law for generations of lawyers and clients. Testing The Grades: Evaluating Grading Models In Clinical Legal Education, Stacy L. Brustin, David F. Chavkin

In 1994, the JOURNAL OF LEGAL EDUCATION published a survey of grading practices at law schools across the United States. That survey revealed a mix of grading approaches for clinical programs. 31 percent of all clinical courses used a fully-graded model; 33 percent graded students on a pass/fail basis; and 16 percent utilized both graded and pass/fail models. The article did not attempt to evaluate qualitatively the effectiveness of the various grading models. By far the most challenging value is the injunction to strive to promote justice, fairness, and morality. Arguably, the first value, the provision of competent representation, can be fostered by effective skills training. The third value, striving to improve the profession, can be fostered through active participation in the Bar. The fourth value, professional self-development, appears to be mainly concerned with effective Continuing Legal Education programs that enhance lawyers' ability to learn through experience. One of the goals of clinicians as teachers is to train law students to listen to, hear and retell their clients' stories. This task is complicated by the fact that the students - who are for the most part white and middle-class, and by definition college-educated - inhabit a world vastly different from - indeed some might say diametrically opposed to - the world inhabited by the clinic's client population, which generally tends to be poor people with a limited education, and for the most part people of color. Small business and community economic development (CED) clinics represent an important and growing component to the future of clinical legal education. The national political trend is away from government entitlements and toward personal responsibility and economic self-sufficiency. Mental health professionals, like other professionals involved in family
matters, feel constrained when advocating for the interests of children by the belief
that parents are entitled to custody and control of their children's lives, regardless of
what others may think of their parenting behavior, absent severe harm to the children.
This belief is morally untenable, and the legal doctrine of parental rights that is its
concrete embodiment is inconsistent with other well-established legal principles and
should be abandoned. Children alone should have legal rights in connection with their
upbringing, and those rights should include an entitlement to much higher standards …

Popular education is a form of adult education that encourages learners to examine their lives critically and take action to change social conditions. It is "popular" in the sense of being "of the people." Popular education emerged in Latin America in the 1960s-1970s; Paulo Freire is its best known exponent. However, its roots may be found in the French Revolution, in workers' education of the 1920s-1930s, and in such movements as the Highlander Folk School in Tennessee (Beder 1996; Jeria 1990). This qualitative study developed a model for an alternative education program for disruptive students in grades 6 through 8 in Franklin and Williamson Counties in Southern Illinois. It was facilitated by the issuance of grant funds to the Regional Offices of Education by the Illinois State Board of Education under the Safe Schools Act of 1995.

The desire of the researcher was to develop a program that would lead to changes in behaviors, promote academic achievement, and return students to the regular school environment with fewer incidents of misbehavior. The outcomes of this qualitative study resulted in a comprehensive resource …
