Women's Rights In The 1789 French Revolution: Conflict Within Liberalism, Alex Paul Jan 1997

Women's Rights In The 1789 French Revolution: Conflict Within Liberalism, Alex Paul

Lawrence University Honors Projects

On 20 September 1792, the newly formed French Legislative Assembly, spurred
by rapidly developing women's political clubs, passed two laws that enhanced women's rights. The first made twenty-one the age of majority for entering into marriage; once a woman reached that age, her father had no power over who she decided to marry. Paternal power over marriage, which had been limitless in the Old Regime, was significantly curtailed. The second law enabled women to divorce their husbands for a variety of reasons, including, mutual consent, incompatibility, "mental illness, condemnation to an infamous punishment, cruelty or serious injury, notorious disorder of …

Protection Of Famous Trademarks In Japan And The United States, Kenneth L. Port Jan 1997

Protection Of Famous Trademarks In Japan And The United States, Kenneth L. Port

Faculty Scholarship

The concepts of trademark jurisprudence in Japan and the United States differ drastically. This difference is apparent in many aspects of trademark protection in both countries and is most evident in the treatment of famous marks. Although Japan and the United States share elements of trademark law that cause some observers to claim that Japan is legally the fifty-first State, the conceptual differences at the foundation of trademark law in each country are so significant that such a claim seems inaccurate and misleading.

Evaluation Of Accessibility Of Urban Transportation Networks, Nanda N Srinivasan Jan 1997

Evaluation Of Accessibility Of Urban Transportation Networks, Nanda N Srinivasan

UNLV Retrospective Theses & Dissertations

This thesis examines accessibility of urban networks to serve the transportation needs of a community. The term accessibility is dealt with qualitatively and quantitatively, giving it a form and structure readily adaptable for implementation by metropolitan planning organizations. Accessibility has been defined from the point of view of the network. This definition helps in interfacing the network with the traditional travel demand models. A methodology was enunciated to develop accessibility indices for urban areas and implemented by means of automated software. The trip generation stage in the traditional urban transportation planning process (UTPP) is used along with a geographic information …

Feasibility Of Integrating Photovoltaic Cells In Low-Rise Office Building Design, Kevin Russell Thompson Jan 1997

Feasibility Of Integrating Photovoltaic Cells In Low-Rise Office Building Design, Kevin Russell Thompson

UNLV Retrospective Theses & Dissertations

This research is an investigation of integrating photovoltaic solar collecting cells into a low-rise office building design providing a sustainable power source meeting or exceeding peak energy demands. The data focuses on roof-mounted installations examining the costs of collecting and transferring solar energy into the existing power grid using U.S. government statistics and projected costs. In addition, the possibility of exporting surplus power for revenue as an alternative energy supplier was explored. Studies of similar research were documented to demonstrate feasibility of alternative PV installations. The purpose of the study examines whether a self-reliant building can be economically feasible using …

Deconstructing The Ideology Of White Aesthetics, John M. Kang Jan 1997

Deconstructing The Ideology Of White Aesthetics, John M. Kang

Michigan Journal of Race and Law

In this Article, the author provides a discussion on the dynamic between race and aesthetics. The author states that because Whites are the dominant group in America, they dictate what is beautiful. The consequence of this power dynamic is that the dominant group, Whites, can exercise preferences in deciding how to look or express themselves, whereas people of color are limited to either conforming to an imposed White standard or rejecting it. The author starts by laying out some of the features to what he terms the "ideology of White aesthetics." He then commences to examine how this ideology has …

Race-Conscious Diversity Admissions Programs: Furthering A Compelling Interest, Marty B. Lorenzo Jan 1997

Race-Conscious Diversity Admissions Programs: Furthering A Compelling Interest, Marty B. Lorenzo

Michigan Journal of Race and Law

This Article argues that narrowly tailored, race-conscious admissions programs can be employed to achieve a more diverse student body and consequently a more enlightened and egalitarian society. An admissions body which looks beyond traditional academic indicators and explores the whole person of each applicant will matriculate a group of students with a wide variety of race, gender, class and other backgrounds, thereby fostering a robust exchange of ideas among these students. Pointing to the enduring precedential value of Bakke as well as the ideological makeup of the Supreme Court, this Article asserts that the Courts would likely uphold a program …

Cultivating A Seedling Charter: South Africa's Court Grows Its Constitution, Margaret A. Burnham

Michigan Journal of Race and Law

As South Africa emerges from the vestiges of apartheid, its Constitutional Court struggles to develop a jurisprudence that reflects the lasting ideals of a constitutional democracy. This Article examines the Court's use of international and foreign law in developing a unique form of constitutional jurisprudence. It argues that the Constitutional Court is in the process of developing an innovative form of decision-making that effectively combines domestically derived principles of justice with those developed in the international forum. This Article concludes that reliable methods of adjudication are firmly entrenched in the South African legal system and that its constitutional jurisprudence should …

Watching The Watchdog: Security Oversight Law In The New South Africa, Christopher A. Ford Jan 1997

Watching The Watchdog: Security Oversight Law In The New South Africa, Christopher A. Ford

Michigan Journal of Race and Law

This Article attempts to assess the experiences of post-apartheid South Africa in the realm of national security law by examining key issues from constitutional, statutory, and policy perspectives. It observes that South Africans now have a great "window of opportunity" that allows them to establish the habits and mores necessary to a working security oversight regime, and argues that the way in which South Africa strikes a balance between the requirements of national security and the preservation of personal liberties is of enormous importance to the Republic's future. It further contends that South Africa's choices in this arena could have …

"Vox Populi, Vox Dei" - A Discussion Of Dissent Within The Modern Catholic Church, Sleven W. Suomi Jan 1997

"Vox Populi, Vox Dei" - A Discussion Of Dissent Within The Modern Catholic Church, Sleven W. Suomi

Honors Theses

The final question is: what happens in the meantime? Is it effective to dissent while conservatives hold power and clearty are not about to make any major changes? What good does it do to repeatedly bang one's head against the wall when progress is not being made? There is no one simple answer to this question, but rather several applicable ones. The first possible answer is that dissent currently does little good. The conservative hierarchy is still the dominant force within Catholicism. This hierarchy has made a habit, evidenced by the birth control debate, of pressing its conservative agenda despite …
