And The Truth Shall Make You Free: Trust As A First Amendment Defense In Tortious Interference With Contract Cases, Robert L. Tucker Jan 1997

And The Truth Shall Make You Free: Trust As A First Amendment Defense In Tortious Interference With Contract Cases, Robert L. Tucker

UC Law Constitutional Quarterly

This Article traces the development of the tort of tortious interference with contract from its early English antecedents through the first and second Restatements. The Article discusses the case law that has generally established a "privilege" for the communication of truthful information. This "privilege" was recognized by the American Law Institute in § 772(a) of the Restatement (Second) of Torts.

The article then considers whether the recognition of a "privilege" for the communication of truthful information is required under the First Amendment to the United States Constitution. It concludes that, under applicable United States Supreme Court precedents, the communication of …

'Judith' And The Rhetoric Of Heroism In Anglo‐Saxon England, Christopher R. Fee Jan 1997

'Judith' And The Rhetoric Of Heroism In Anglo‐Saxon England, Christopher R. Fee

English Faculty Publications

The Old English Judith differs from the Liber Judith of the Vulgate at several crucial points, and in one particularly important way. In the Vulgate version of the story, Judith is a heroine in every sense of the word: she is a tropological symbol of Chastity at battle with Licentiousness, an allegorical symbol of the Church in its constant and eventually triumphant battle with Satan, and an inspirational figure who infuses her warriors with much needed courage and confidence; but the Vulgate Judith is also, in a very real sense, the agent by which God's will is executed and the …

Abraham Lincoln And The Doctrine Of Necessity, Allen C. Guelzo Jan 1997

Abraham Lincoln And The Doctrine Of Necessity, Allen C. Guelzo

Civil War Era Studies Faculty Publications

Abraham Lincoln was a fatalist. That, at least, was what he told many people over the course of his life. "I have all my life been a fatalist," Lincoln informed his Illinois congressional ally, Isaac Arnold. "Mr. Lincoln was a fatalist," remembered Henry Clay Whitney, one of his Springfield law clerks, "he believed ... that the universe is governed by one uniform, unbroken, primordial law." His Springfield law partner William Henry Herndon, likewise, affirmed that Lincoln "believed in predestination, foreordination, that all things were fixed, doomed one way or the other, from which there was no appeal." Even Mary Todd …

Leadership Challenges Encountered By Elementary School Principals In The Process Of Creating, Implementing, And Sustaining Shared School Visions In Clark County, Nevada, Elementary Schools, David Allen Price Jan 1997

Leadership Challenges Encountered By Elementary School Principals In The Process Of Creating, Implementing, And Sustaining Shared School Visions In Clark County, Nevada, Elementary Schools, David Allen Price

UNLV Retrospective Theses & Dissertations

Creating, implementing, and sustaining a shared vision is a complicated task for any leader. The Elementary School Division of the Clark County School District (CCSD) expects elementary school principals not only to develop a shared vision for their schools, but also to implement and sustain this shared vision with the aid of their constituencies--other administrators, staff, students, parents, and the community-at-large. Leaders, in this case principals, generally are responsible for developing a shared vision; The concept of visionary leadership has been defined in the literature, and principals can be tested to determine the degree to which they align themselves with …

Statistical Evaluation Of Motorist And Pedestrian Behavior At Signalized Intersections In Las Vegas, Sivashankar Subramani

UNLV Retrospective Theses & Dissertations

This study examines the effect of a law enforcement program implemented to check illegal and unsafe motorist and pedestrian behavior. A case study involving eight selected intersections in Las Vegas (four control and four treatment) was carried out over a period of seven months in conjunction with the pedestrian law enforcement program conducted during March and April of 1996. Pedestrian and motorist behaviors were video taped in 120 minute segments. The tapes were then reviewed to count vehicle violations, pedestrian violations, conflicts, total vehicles and total pedestrians. Violations and conflict rates for pre and during enforcement, and pre and post …

Lossless Motion Compensation Of Images With Large Volumes Of Movement, Michael Aaron Ducharme Jan 1997

Lossless Motion Compensation Of Images With Large Volumes Of Movement, Michael Aaron Ducharme

UNLV Retrospective Theses & Dissertations

The majority of compression algorithms developed today contain some degree of image loss. While this is acceptable for certain types of image viewing, such a loss can interfere with applications that require the scientific analysis of an image. In this paper a lossless motion compensation compression algorithm is introduced and tested on a series of medical images which contain a high degree of motion. This motion compensation technique compensates for translation, scaling, rotation and the movement of multiple objects. This is accomplished be recursively dividing an image into a series of blocks, starting with a set of sixteen by sixteen …

Organizational Citizenship Behavior: A Study In The Quick Service Industry, Lu Hou Tsai Jan 1997

Organizational Citizenship Behavior: A Study In The Quick Service Industry, Lu Hou Tsai

UNLV Retrospective Theses & Dissertations

Organizational Citizenship Behavior (OCB) is a class of job related behaviors which have been suggested as a fruitful addition to traditional conceptions of job performance. OCB is defined as those behaviors which are discretionary, are not formally recognized by the organizational reward system, and in the aggregate, promotes organizational effectiveness; There were several questions that were examined. The first question asked if OCB have a direct relationship with company task performance. The second question asked if OCB have a direct relationship with company conceptual performance, the third question examined if OCB had a direct relationship with additional service performance. The …

The Muddy Creek Formation: Depositional Environment, Provenance, And Tectonic Significance In The Western Lake Mead Area, Nevada And Arizona, Allan J. Scott Jan 1997

The Muddy Creek Formation: Depositional Environment, Provenance, And Tectonic Significance In The Western Lake Mead Area, Nevada And Arizona, Allan J. Scott

UNLV Retrospective Theses & Dissertations

In the River Mountains, the Muddy Creek Formation is informally divided into four members; the River Mountain conglomerate, the Boulder Basin conglomerate, the lakeshore member, and The Cliffs member; Clasts in the Muddy Creek Formation are composed of andesite, dacite, basalt, rhyolite, quartz monzonite, and granite. Paleocurrent data for the basal River Mountain conglomerate suggest that the transport direction was to the southeast, parallel to the regional strike of high-angle normal faults. The River Mountain conglomerate may have been transported along the axes of basins that were controlled by these faults; The River Mountain conglomerate was probably deposited during a …

Consent, Contract, And The Responsibilities Of Insurance Defense Counsel, Robert H. Jerry Ii Jan 1997

Consent, Contract, And The Responsibilities Of Insurance Defense Counsel, Robert H. Jerry Ii

Faculty Publications

This paper examines some of the assumptions on which many contemporary assessments of defense counsel's relationship with the insurer and the policyholder rest, contends that some of the current turmoil in this area is traceable to shaky assumptions, and argues that the drafting of clearer liability insurance contracts would add stability to the relationships. Part I briefly describes the current uncertainty confronting policyholders and defense counsel. Part II explores what the most widely-used liability insurance contracts say about the responsibilities of insurance defense counsel, examining both the context in which these policies are sold and the texts themselves. It contends …

Dreams And Expectations: The Paris Diary Of Albert Brisbane, American Fourierist, Abigail Mellen Jan 1997

Dreams And Expectations: The Paris Diary Of Albert Brisbane, American Fourierist, Abigail Mellen

The Courier

IN 1828 Albert Brisbane (1809-1890) persuaded his wealthy father to send him to Europe in order to find out "what is the work of man on this earth? What was he put here for and what has he to do?"1 In Europe Brisbane became interested in French utopianism, especially the ideas of Claude-Henri de Rouvroy (Comte de Saint-Simon, 1760-1825) and Charles Fourier (1772-1837). Brisbane returned to the United States in 1834 and, until his death in 1890, devoted his wealth and energies to establishing an American Fourierist movement.

Webflow - A Visual Programming Paradigm For Web/Java Based Coarse Grain Distributed Computing, Dimple Bhatia, Vanco Burzevski, Maja Camuseva, Geoffrey C. Fox

Northeast Parallel Architecture Center

We present here the recent work at NPAC aimed at developing WebFlow---a general purpose Web based visual interactive programming environment for coarse grain distributed computing. We follow the 3-tier architecture with the central control and integration WebVM layer in tier-2, interacting with the visual graph editor applets in tier-1 (front-end) and the legacy systems in tier-3. WebVM is given by a mesh of Java Web servers such as Jeeves from JavaSoft or Jigsaw from MIT/W3C. All system control structures are implemented as URL-addressable servlets which enable Web browser-based authoring, monitoring, publication, documentation and software distribution tools for distributed computing. We …
