The Personal Responsibility And Work Opportunity Act Of 1996: Poison Pills For Legal Immigrants, Meredith Barton, Deborah M. Chandler Jan 1997

The Personal Responsibility And Work Opportunity Act Of 1996: Poison Pills For Legal Immigrants, Meredith Barton, Deborah M. Chandler

Richmond Journal of Law and the Public Interest

Former president Ronald Reagan's vision of America as this shining city ended Thursday, August 23, 1996, when President Bill Clinton signed his name to the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (PRWORA, considered the most farreaching welfare reform package in history. Although the Congressional Budget Office (CBO) estimates that the federal government will save over $57 billion between fiscal year 1997 and fiscal year 2002, this welfare reform package profoundly impacts immigrants, particularly legal immigrants. Overall 44% of federal savings (approximately $23.8 billion) stems from denying public assistance benefits to legal immigrants. This new welfare legislation directly …

Britain And The French Resistance 1940-1942 : A False Start, Laurie West Van Hook Jan 1997

Britain And The French Resistance 1940-1942 : A False Start, Laurie West Van Hook

Master's Theses

During the Second World War, the French Resistance failed to unify or work effectively with Charles de Gaulle, the movement's symbolic leader. The Resistance maintained a troublesome relations with Great Britain. Neither side overcame a series of conflicts, battling egos, and internal confusion. As a result, Britain and the Resistance never developed a mature relationship that could aid the Allied invasion of French North Africa in November 1942 (Torch) and Normandy in June 1955 (Overlord). The British lacked a unified policy toward the French Resistance. Acting out a sense of desperation and isolation, the British clung …

Legislative Approaches To Reducing The Hegemony Of The Priestly Model Of Medicine, Nancy K. Kubasek Jan 1997

Legislative Approaches To Reducing The Hegemony Of The Priestly Model Of Medicine, Nancy K. Kubasek

Michigan Journal of Gender & Law

This Article presents the case that the legal culture in many ways undergirds the priestly model's hegemony over the therapeutic relationship between a woman and her doctor. To the extent that law provides this fundamental support, it legitimizes the mistreatment of women, especially with respect to their reproductive health. The implications are that the movement toward a more just legal culture necessitates the extirpation of this support.

The Sanctity Of Life And The Right To Die: Social And Jurisprudential Aspects Of The Euthanasia Debate In Australia And The United States, Roger S. Magnusson Jan 1997

The Sanctity Of Life And The Right To Die: Social And Jurisprudential Aspects Of The Euthanasia Debate In Australia And The United States, Roger S. Magnusson

Washington International Law Journal

This paper reviews social and legal issues in the current euthanasia debate. Focusing on Australia and the United States, the author argues that the legalization of physician-assisted suicide ("PAS") and/or active voluntary euthanasia ("AVE") is inevitable within the short to medium term, given recent developments which have undermined the sanctity of life ethic. Legal factors supporting this assessment include the changing definition of death, the growth of a legallyrecognized right to self-determination extending to the withdrawal of life-support, and the recognition by some courts that life support may be withdrawn without consent because life is considered to be futile. The …

The Taiwan Consumer Protection Law: Attempt To Protect Consumers Proves Ineffective, Carol T. Juang Jan 1997

The Taiwan Consumer Protection Law: Attempt To Protect Consumers Proves Ineffective, Carol T. Juang

Washington International Law Journal

Consumer protection is a relatively new social issue in Taiwan. With the passage of the Taiwan Consumer Protection Law ("CPL"), the government of Taiwan has taken a tremendous step towards the protection of its consumers' rights. However, industry leaders as well as consumers have voiced concerns over many of the provisions and terms in the CPL. Consumers have not taken advantage of the CPL as a means of legal recourse for product-related injuries, and industry groups have asked the government to reexamine particular aspects of the CPL. Such reaction has essentially rendered the CPL an unproductive piece of legislation.

European Constitutionalism And Its Discontents, J.H.H. Weiler, Joel P. Trachtman Jan 1997

European Constitutionalism And Its Discontents, J.H.H. Weiler, Joel P. Trachtman

Northwestern Journal of International Law & Business

Traditionally, the European Community has been set apart from all other international organizations, as well as from states, and Euro- pean Community law has been distinguished from both international law and from domestic law. This was so because of the supposed unique internal structure and processes of the European Community. This "splendid isolation" is no longer viable. Increasingly in the .be- havior - and study - of other transnational organizations, polities or regimes, the European transnational experience has come to provide a model, a yardstick and a set of analytical and critical tools, and per- haps erroneously, a desideratum. While …

From Diplomacy To Law: The Juridicization Of International Trade Relations, Arie Reich Jan 1997

From Diplomacy To Law: The Juridicization Of International Trade Relations, Arie Reich

Northwestern Journal of International Law & Business

This article deals with the development of law; i.e., the evolution of a legal regime in a field which prior thereto was not subject to law. It is my view that such a process took place in recent decades in the area of trade relations between sovereign nations. The period since World War II, and particularly recent years, is marked by the clear development of a conventional legal regime which regulates trade re- lations among the majority of countries of the world, as expressed by the multiplication of legal norms and the strengthening of the binding nature of these norms …

Does Russia Need A Securities Law?, Greg Lumelsky Jan 1997

Does Russia Need A Securities Law?, Greg Lumelsky

Northwestern Journal of International Law & Business

The question in the title of this article is not necessarily rhetorical. Perhaps a more appropriate inquiry is, does Russia need its current securi- ties law?' The response to the titular question is, as I will argue, clearly yes. The answer to the second question is to a large extent negative. Given the prevailing economic conditions in Russia, the course of enterprise pri- vatization, and the principal institutions shaping Russian capital markets, there is good reason to think that rather than assisting the growth and en- trenchment of a market in securities, much of the current Russian securities legislation will …

Reducing Malapportionment In Japan's Electoral Districts: The Supreme Court Must Act, William Somers Bailey Jan 1997

Reducing Malapportionment In Japan's Electoral Districts: The Supreme Court Must Act, William Somers Bailey

Washington International Law Journal

Japan's Constitution does not expressly mandate periodic census and reapportionment of electoral districts. The Election Law only suggests reapportionment. Consequently, rapid population shifts in postwar Japan created endemic voter imbalances. The Japanese Supreme Court has made some attempts to prod the national parliament to take ameliorative action, but the result has always been "too little, too late." Nevertheless, the evidence shows that the parliament does heed the Court's decisions. This Comment urges the Court to tighten the three to one ratio it has developed for allowable voter imbalances to two to one or better, and to abandon doctrines like the …

Indian Software Industry: A Diagnostic Analysis, Premchander Jan 1997

Indian Software Industry: A Diagnostic Analysis, Premchander

IIMB Management Review

With the introduction of stringent requirements relating to foreign ownership of businesses in India in the early seventies, the information technology boom began in the country with alert entrepreneurs capitalising quickly on this development. Aided by the international demand for software and among other things, the low-cost availability of skilled workforce, the Indian software industry grew rapidly. But today, several of the earlier competitive advantages are being eroded. A profile of the industry has been drawn up assessing its vulnerability through its strengths and weaknesses, the threats and opportunities it faces, and the value drivers in the industry.

Floristic Investigation Of Crooked Creek Community Of Juan Solomon Park, Indianapolis Indiana, Raelene M. Crandall, Rebecca W. Dolan

Scholarship and Professional Work - LAS

The protection of plant resources in urban areas is a growing conservation concern. Inventory activities that document species presence and stewardship plans that protect and enhance these areas are needed. The results of a botanical inventory of the Crooked Creek Community Juan Solomon Park in Indianapolis, Indiana, are reported in this paper. The 46-acre park contains three distinct habitats, supporting a wide variety of plants. One hundred seventy-nine vascular plant species from 64 families were identified, including 53 (29.6%) non-native species that are naturalizing within the park. Despite its high percentage of alien species and urban setting, the park is …

The Many-Headed Hydra Of Theory Vs. The Unifying Mission Of Teaching, Marshall W. Gregory Jan 1997

The Many-Headed Hydra Of Theory Vs. The Unifying Mission Of Teaching, Marshall W. Gregory

Scholarship and Professional Work - LAS

A persistent myth in departments of English posits a golden age when tweedy English professors humanized the world with thrice-weekly doses of literary instruction, exchanged witty conversation and recondite literary allusions at the Friday afternoon sherry hour, and generally agreed with each other about which books to teach, how to teach them, and the importance of teaching them. This golden age must have ended right before I entered the field. My whole history within the discipline suggests that getting English professionals to agree in large numbers about almost anything is nearly as difficult as herding cats or training king cobras …
