Development Of Site Characterization Simulator Specifications, Jeffrey L. Heiderscheidt

The purpose of this study was to develop a tool for evaluating data quality when characterizing a potentially contaminated groundwater aquifer, and to provide a basis for developing a simulator to allow environmental managers and engineers to practice and learn about the site characterization process. Specifically, this study characterized the uncertainty, estimation block size, and cost for the various methods of determining the value of each geological, hydrological, and contaminant parameter necessary to characterize a site. Research entailed identifying site characterization objectives and identifying parameters necessary to obtain those objectives. A Highly Sensitive Plant Hybrid Protein Assay System Based On The Spm Promoter And Tnpa Protein For Detection And Analysis Of Transcription Activation Domains, Michael Schläppi, Ramesh Raina, Nina V. Fedoroff

TnpA is a multifunctional DNA binding protein encoded by the maize Suppressor-mutator (Spm) transposable element. TnpA is required for transposition and is a repressor of the unmethylated Spm promoter. While analyzing protein domains using a yeast GAL4-based hybrid system in transiently transformed tobacco cells, we found that TnpA represses the >10-fold transcriptional activation observed when the GAL4 DNA-binding domain is used alone. By contrast, compared to the backgroundless TnpA DNA-binding domain alone, 33- to 45-fold activation of the Spm promoter was observed when the VP16 activation domain was fused to it. Balancing The Equities: Is Missouri Adopting A Progressive Rule For Relocation Of Easements, Douglas B. Harris

Missouri Law Review

The Missouri law of easements might not be the place one would expect to find a progressive development of the law. Over the past four decades, some courts have begun to shake up Missouri's approach to relocation of easements, while still paying lip service to the old rules. Although Missouri courts have neither openly nor uniformly recognized the new approach, it nonetheless guides some courts' decisions. With a few distinctions, Missouri courts have experimented with what amounts to adoption of the Restatement (Third) of the Law of Property's progressive stance.' Business Standing Under The Illinois Consumer Fraud Act: An Attempt To Resolve The Confusion, Edward X. Clinton Jr.

Northern Illinois University Law Review

This article analyzes the standard for when a business has standing to pursue an action under the Illinois Consumer Fraud Act. The article contends that several decisions addressing this issue are in conflict. The article proposes a new test to resolve the conflicts in the decisions. Under that test, which is used in other states, a business has standing to raise a claim under the Act when the business is acting in a manner similar to an ordinary consumer.

Restoring Free Exercise Protections By Limiting Them: Preventing A Repeat Of Smith, James M. Donovan

Northern Illinois University Law Review

This article addresses the concerns involved with the recently enacted Religious Freedom Restoration Act and how this sets the stage for a revisiting of Employment Division, Department of Human Resources of Oregon v. Smith. This article suggests that full Free Exercise protections can be extended to most contexts if they are withdrawn from others. The goal is to accomplish a principled approach that does not contravene the spirit of the First Amendment. The proposed limiting principles argue collectively that full protections should be reserved for personal, central beliefs and actions about personal conduct whose accommodation does not raise Establishment issues, …

The rise of youth involvement in crime and the increase in crime associated with schools has prompted growing national concern and evoked serious scholarly attention. Traditionally, research involving youth and crime centers on offender rather than environmental characteristics. The purpose of this work is to shift the emphasis from the individual to the environment by replicating and extending the work of Roncek and associates which was based, in part, on Cohen and Felson’s Routine Activities theory.
