People often fight for their homes. Once established, homes are vital centers of life, and their threatened loss generates predictable resistance. This Article shows how the human desire not to be moved is protected by the law. Such protection can be found in both U.S. domestic and international law, although the two systems of law vary widely in their approach. Since World War II, international scholars and lawmakers have been deeply concerned with promoting the legal rights of people to leave and return to their own countries. Extra-Statutory Discovery Requirements: Violating The Twin Purposes Of 28 U.S.C. Section 1782, Christopher W. Sanzone

This Note analyzes Section 1782 of United States Code Chapter 28 and its role in the realm of international judicial assistance. The twin aims of Section 1782 are: (1) to provide efficient means of assistance to participants in foreign litigation, and (2) to encourage foreign countries by example to provide similar assistance to U.S. litigants in court. This Note posits that these goals are violated when a district court, considering a request for documents, imposes a threshold, extra-statutory requirement that the material requested be discoverable in the foreign jurisdiction where the litigation is pending.

In July 1995, the House of Representatives established a Corrections Day procedure for fixing statutory mistakes. This article traces the history of the corrections day idea, beginning with suggestions offered by Justices Cardozo and Ginsburg many years apart. The article also recounts the early applications of Correction Day by the House. This article describes the problem of statutory mistakes: what they are, and who makes them. It explains that statutory mistakes do exist, regardless of how one defines mistake. In October 1994, the Strategic Studies Institute sponsored a roundtable on democratization in Sub-Saharan Africa. Particular attention was paid to the role the U.S. military and Department of Defense played in democracy support. This study developed from a paper presented at the roundtable. Dr. Butts and Dr. Metz reject the notion that the political culture of African states allows or even encourages military intervention in politics. This article outlines three explanations for why states seek migrants and tests them by references to 1985-90 interstate migration flows. On race-for-the-top theories, states compete for value-increasing migrants by offering them healthy economies and efficient laws. On vote-seeking theories, states compete for clienteles of voters, with some states seeking to attract and some to deter welfare- or tax-loving migrants. On deadbeat theories, states compete for high human capital debtors by offering them a fresh start from out-of-state creditors. Our findings support vote-seeking and deadbeat theories.

A Study Of The Relationship Between Use Of Technology In Math And Higher Test Scores, Mary Ann Grooters

This thesis explored the relationship of a technology enhanced curriculum to higher test scores and higher student motivation. This thesis involved two seventh grade math classes in Kentwood, Michigan. A control class received instruction including lectures, written assignments, and projects. The test group received similar assignments and projects and in addition were given technology supported exercises. A survey given to the test group examined motivation levels, and end of chapter tests compared achievement scores of both groups. The findings indicate that a technology enhanced curriculum does not lead to higher test scores but does impact student motivation to learn math.

The Detection And Reporting Of Elder Abuse And Neglect: A Training Video For Prehospital Personnel, Jason P. Seamon

The Emergency Medicine Residency Program at Butterworth Hospital in Grand Rapids, Michigan developed an instructional video for prehospital personnel in hopes of broadening their awareness about elder abuse and neglect. A sample of 60 EMS personnel were asked to complete a pretest in order to assess current knowledge of the subject matter, view the educational video, and then complete the posttest. This session was used to evaluate the video as a potential training device. While the study population reported seeing 256 suspected cases of abuse or neglect in their careers, only 11 (4%) were reported. Furthermore, 60% of the respondents …

This replication study was designed to compare emergency and medical/surgical registered nurses' actual and perceived knowledge of the pharmacological and nonpharmacological aspects of pain and its management. A modification of the original tool that consisted of a combination of multiple choice, short answer and open-ended questions was utilized. A convenience sample representing beginner and expert medical/surgical and emergency nurses was obtained.; No difference was found between specialty or experience and current pain knowledge. Trauma is a major cause of death and disability in the United States. Approximately 4% of victims incur life-long debilitating alterations in physical and personal integrity. The purpose of this study was to determine the relationship between initial neurological status following traumatic brain injury and adaptation. The study used a retrospective single group repeated measures design. Subjects were patients admitted to an acute care rehabilitation program and completed in patient and outpatient rehabilitation regimes (N=49). All had traumatic brain injuries with Glasgow Coma Scale Scores documented on admission to acute inpatient hospitalization. The Glasgow Coma Scale was used to assess …

Most scholars who have addressed voter initiatives suggest only that the Guarantee Clause requires that the Supreme Court take a more active role in reviewing the constitutionality of state initiative measures. In contrast, we argue in this Essay that the Guarantee Clause establishes a per se prohibition against state initiatives. Part I of this Essay briefly examines the historical origins of the Guarantee Clause and the Founders’ apprehensions of direct democracy. Part II observes how modern state initiatives provide contemporary illustrations of the Founders’ philosophical concerns about direct democracy. The Effects Of Environment Dynamism And Heterogeneity On Salespeople's Role Perceptions, Performance And Job Satisfaction, Ravipreet S. Sohi

This article develops a structural equations model which examines the effects of environmental dynamism and heterogeneity on salespeople’s role conflict, role ambiguity, performance and job satisfaction. The model is tested with EQS, using data collected from 230 salespeople in multiple companies and industries. Indicates that environmental dynamism reduces satisfaction and performance, and increases role conflict and ambiguity. Notes that environmental heterogeneity also reduces performance and increases role conflict, but does not have a significant effect on role ambiguity.

Population Genetics And Gene Variation In Screwworms (Diptera: Calliphoridae) From Brazil, David B. Taylor, Richard D. Peterson Ii, Gonzalo E. Moya-Borja

Allozyme variation in New World screwworm, Cochliomyia hominivorax (Coquerel), populations from Brazil was examined. Variability was observed in 8 of 13 enzyme loci and the frequency of the most common allele was <0.95 for seven loci. Observed and expected heterozygosities were 0.159 and 0.165, respectively. Comparisons of the Brazilian populations with previously studied populations from Costa Rica resulted in Nei's genetic distances of between 0.000 and 0. 006, with the greatest distance being between populations within Brazil. Comparisons with Mexican populations using only three loci resulted in genetic distances ≤0.031. Goodness-of-fit statistics for Hardy-Weinberg equilibrium and Wright's F statistics indicated small deviations from expected equilibrium genotype frequencies and low levels of differentiation between populations within Brazil. Differentiation among screwworm populations from Brazil, Costa Rica, and Mexico was minimal.

Upper Cretaceous Calcareous Nannofossil Biostratigraphy And Paleoceanography Of The Southern Ocean, David K. Watkins, Sherwood W. Wise Jr., James J. Popsichal, Jason Crux

Nannofossil data from the Naturaliste Plateau (DSDP Legs 26 & 28), Falkland Plateau (DSDP Legs 36 & 71), Maud Rise (ODP Leg 113), Northeast Georgia Rise (ODP Leg 114), and Kerguelen Plateau (ODP Leg 120) yield a set of consistent, reliable biohorizons that form the basis of a revised calcareous nannofossil zonation for the Southern Ocean Upper Cretaceous. Analysis of this zonation indicates significant changes in the circum-Antarctic climatic regime during the Campanian and Maastrichtian that foreshadow the more dramatic climatic shifts of the Palaeogene. Calcareous nannofossils from the Turonian through the Lower Campanian of the studied sections are characterized …

Cycle Time Estimation For Simulating A Tandem Queueing Systems Using Aggregation Techniques, Paul Savory, Gerald Mackulak

One approach to simulating a single-server tandem queuing system is to explicitly model each of the production stages. In this paper, we apply queueing theory, a recursive algorithm, and composite random number sampling to develop an equivalent aggregate representation consisting of only a single production stage. Preliminary test results indicate that the aggregation works well for estimating the mean and variability of the total cycle time.
