The Watergate scandal-and the crisis in public confidence in government it spawned-left us many legacies, one of which is the Independent Counsel ("IC") statute. Over twenty years after the fact, the "lessons" of the scandal itself continue to be the dominant reference. It is time to evaluate the "lessons" of Watergate's legacies and, in particular, the IC mechanism.

An Electronic Surveillance And Control System For The Management Of Traffic On The Borman Expressway, Part Ii: Calibrating A Simulation Model, Mu-Han Wang, Michael J. Cassidy

The purpose of this project was to calibrate a freeway simulation model to emulate traffic operating conditions on the Borman Expressway in Northwest Indiana. To replicate Borman operating conditions, the project adopted Integrated Traffic Simulation (INTRAS), a microscopic, stochastic freeway simulation model. Appropriate input data were developed on geometric, traffic and driver behavior information, based on physical measurements and other available data. The model was calibrated and statistical analysis were conducted to validate the accuracy of the results.

Leaking underground storage tanks are widespread throughout the United States. It is estimated that there are 1.4 million underground gasoline storage tanks in the United States, with as many as 75,000 to 100,000 that may be leaking. In Indiana alone, more than 3,500 of the 15,000 registered underground storage tank facilities have reported leaks. Conventional remediation methods often involve pump-and-treat schemes for contaminated water, and excavation and burial of contaminated soil in hazardous waste landfills. Results of the load tests of two steel through truss bridges were used to evaluate the assumptions used by BARS for the rating of this type of bridge. Based on the results from this study it is recommended that the Indiana Department of Transportation use the load distribution factors in the 1994 LRFD Specifications in the rating of these bridges. This will imply replacing the load distribution factors currently in BARS. The implementation of the new distribution factors will result in a less conservative rating of the longitudinal beams in this type of bridge. The increase in the allowed moments …

Motor vehicles are one of the largest emitters of ground-level ozone precursors – volatile organic compounds (VOCs) and nitrogen oxides (NO1) – into the atmosphere. Consequently, the Clean Air Act Amendment of 1990 requires the implementation of transportation control measures in order to reduce ground-level ozone precursor emissions and alleviate the ozone air quality problems. This research investigates the relative effects of motor vehicle emissions of VOCs and NO1 on hourly average concentrations of ground level ozone in the Indiana Airshed Model (UAM-IV). Constructability can be defined as incorporating knowledge into the design product or designing so it is easier to construct. Transportation facilities have suffered from this problem, with INDOT no exception. The most important feature of any constructability program is capturing field examples, commonly referred to as “lessons learned,” and archiving and retrieving them into future projects that are either similar or have similar conditions in order to eliminate or prevent the same mistakes from occurring again. Millions of scrap tires are discarded annually in the United States, the bulk of which are currently landfilled or stockpiled. This consumes valuable landfill space, or, if improperly disposed, creates a fire hazard and provides a prolific breeding ground for rats and mosquitoes. The use of tire shreds as lightweight fill material can sharply reduce the tire disposal problem. The present study, based on laboratory testing and numerical modeling examines the feasibility of incorporating tire shreds and rubber-sand mixtures as lightweight geomaterial in embankments and backfills. The weakening of the traditional management hierarchy, the hollowing out of corporations, and an increasing management emphasis on boundarylessness have created a new mind set concerning external stakeholders. Increasingly, organizations are moving beyond traditional stakeholder management techniques to partnering tactics that lead to the achievement of common goals. In spite of these trends, there has been very little effort in the management literature to tie stakeholder management and partnering tactics. Effects Of International Diversity And Product Diversity On The Performance Of Multinational Firms, Stephen Tallman, Jiatao Li

A study examined the relationships among international diversity, product diversity, and firm performance. For a sample of large American industrial multinational enterprises (MNE), it showed a consistent quadratic relationship between product diversification and MNE performance but minimal performance differences across different measures of international diversity. Analysis of the interactions of international diversity and product diversity indicates a weak effect from increasing internationalization on the performance effect of product diversity.

L.H. LaRue demonstrates in his book, Constitutional Law as Fiction, that, at least in the realm of constitutional law, there is no simple correspondence between fiction and falsehood, or fact and truth. Partial or fictive accounts of our constitutional history, even when they are riddled with inaccuracies, may state deep truths about our world, and accurate recitations of historical events may be either intentionally or unintentionally misleading in the extreme. According to LaRue, the Supreme Court engages in a form of storytelling or myth-making that goes beyond the inevitably partial narratives of fact and precedent. The Supreme Court also tells …

Beyond Autonomy: Coercion And Morality In Clinical Relationships, Maxwell Gregg Bloche

This article considers the problem of line-drawing between autonomy-preserving and autonomy-negating influence in clinical relationships. The author’s purpose is not to propose particular boundaries, either with respect to reproductive decisions by HIV-infected women or for other clinical choices. Rather, he attempts to shed some light on what drives our disputes about whether one or another influence method is compatible with autonomous choice.

The author argues that such disagreements reflect underlying conflicts between normative commitments, and that resolving these conflicts is essential to settling controversies over whether particular influences unduly interfere with autonomous choice. For many years, the United States has granted political asylum to victims of persecution who come to our country and seek our protection. Now, however, Congress is on the verge of abolishing the right of political asylum.

Congress is not proposing to repeal the asylum provisions of the Refugee Act of 1980. An outright repeal would probably never pass, because many in Congress, recalling America's sorry treatment of refugees during the Holocaust, accept the humanitarian premises underlying asylum.
