Disaproving The Military As An Effective Paradigm Of Leadership: A Critical Analysis, Alison M. Sestina Jan 1996

Disaproving The Military As An Effective Paradigm Of Leadership: A Critical Analysis, Alison M. Sestina

Honors Theses

In the study of leadership, there are many existing paradigms which address the different contexts and abilities of leadership. The example of the military is often used as a leadership paradigm; however, while the organization and internal development included in the military can be respected as an effective machine, in reality, the military cannot be considered an effective leadership paradigm.

The Judiciary And Presidential Power In Foreign Affairs: A Critique, David Gray Adler

Richmond Journal of Law and the Public Interest

The aim of the first section is to examine the judiciary's contribution to executive hegemony in the area of foreign affairs as manifested in Supreme Court rulings regarding executive agreements, travel abroad, the war power, and treaty termination. In the second section of this article, I provide a brief explanation of the policy underlying the Constitutional Convention's allocation of foreign affairs powers and argue that those values are as relevant and compelling today as they were two centuries ago. In the third section, I contend that a wide gulf has developed in the past fifty years between constitutional theory and …

Jones V. Clinton And Presidential Immunity, Braxton Hill Jan 1996

Jones V. Clinton And Presidential Immunity, Braxton Hill

Richmond Journal of Law and the Public Interest

On May 6, 1994, Paula Corbin Jones set in motion events that could alter the legal status of the office of the President of the United States. Ms. Jones filed a lawsuit against William Jefferson Clinton, the sitting President, because of sexual improprieties he allegedly committed while serving as Governor of Arkansas. As of January 1996, the case had already worked its way up the judicial ladder from the trial court to the first appellate level. Jones v. Clinton is poised to come before the United States Supreme Court, which could address unexplored areas of presidential jurisprudence--the body of legal …

The U.S. Presidency: Fostering Global Free Trade Through Minilateral Free Trade Agreeements With Germany And Japan, J.R. Smith Jan 1996

The U.S. Presidency: Fostering Global Free Trade Through Minilateral Free Trade Agreeements With Germany And Japan, J.R. Smith

Richmond Journal of Law and the Public Interest

The U.S. Presidency: Fostering Global Free Trade Through Minilateral Free Trade Agreements with Germany and Japan argues that global free trade will be better served by agreements of substance among fewer countries than by agreements of form among many countries. Specifically, the article addresses problems with the General Agreement on Tariffs and Trade (GATT) and argues that the goal of global free trade is more easily achieved through bilateral agreements between the United States and Germany, and the United States and Japan. The article concludes that such bilateral agreements, and the ultimate goal of global free trade, can be realized …

Irs Form 8300: The Attorney-Client Privilege And Tax Policy Become Casualties In The War Against Money Laundering, Matthew P. Harrington, Eric A. Lustig

Hofstra Law Review

This Article examines the current controversy surrounding the use of IRS Form 8300 in the context of the attorney-client privilege. It argues that there is no justification in the case law for permitting attorneys to avoid disclosing client identity or fee information. It also shows that theIRS’s regulations promulgated pursuant to the statute are generally consistent with the statutory language, even if they are not fully in accord with congressional intent. It is argued, therefore, that while section 6050I has a detrimental effect on attorney-client relations, the only available remedy at this point is for Congress to reconsider the statute …

Employment Arbitration And Voluntary Consent, Stephen J. Ware Jan 1996

Employment Arbitration And Voluntary Consent, Stephen J. Ware

Hofstra Law Review

The boom in non-union employment arbitration has caused great concern about protecting employees' access to courts. Virtually every commentator agrees that employment disputes should be litigated, rather than arbitrated, unless the employee has voluntarily consented to arbitration. While courts and commentators agree that an employee's voluntary consent is a prerequisite to employment arbitration, they do not agree on what constitutes voluntary consent. This article proposes a method of determining what constitutes voluntary consent to employment arbitration. The method proposed is simply application of ordinary contract law doctrines. The article develops the theoretical underpinnings of the contractual approach to arbitration and, …

Plastic Fiber Rolling For Concrete Reinforcement, Jeffery S. Thomas Jan 1996

Plastic Fiber Rolling For Concrete Reinforcement, Jeffery S. Thomas

Masters Theses

"Fiber reinforced concrete is gaining in acceptance and usage as its strength and toughness benefits are realized. Polypropylene fibers are currently the most commonly used fibers. However, the cost of virgin plastics limits the percent content that can be economically added to concrete. One would first believe that recycled plastics could offer a viable alternative to virgin-plastic fibers, but at present time extra selection and cleaning steps required to reprocess the recycled plastic into fibers makes it more expensive than virgin-plastic fibers. A fiber rolling process conceived and developed at the University of Missouri-Rolla has the potential of making recycled …

Segmental Motion Of Surface-Bound Swollen Poly(Methyl Acrylate)-D, Minghua Liang Jan 1996

Segmental Motion Of Surface-Bound Swollen Poly(Methyl Acrylate)-D, Minghua Liang

Masters Theses

"Poly (methyl acrylate)-da (PMA-da) was prepared and adsorbed on silica then swollen with toluene and carbon tetrachloride. Comparisons of deuterium NMR spin-lattice relaxation time, T1, and spin-spin relaxation time, T2, for the adsorbed polymer at different temperatures were made to obtain information about the backbone motion of the surface-bound polymer. The results suggest that the local fast motions may be similar to those in the corresponding solution, but the longer-range molecular motions were more restricted than those in solution. The log-normal distribution yielded mean correlation times which were 4-10 times slower for the …

Plenary Power And Constitutional Outcasts: Federal Power, Critical Race Theory, And The Second, Ninth, And Tenth Amendments , Nicholas J. Johnson Jan 1996

Plenary Power And Constitutional Outcasts: Federal Power, Critical Race Theory, And The Second, Ninth, And Tenth Amendments , Nicholas J. Johnson

Faculty Scholarship

Rights and power in modern American constitutionalism are conceptually interdependent: "We have no way of thinking about constitutional rights independent of what powers it would be prudent or desirable for government to have." In an era where substantive boundaries on federal power seem ephemeral, this suggests that what we call rights may be primarily fair weather or illusory barriers to the exercise of power. From a majoritarian perspective, the shifting boundary between rights and powers, and the capacity of power to consume rights, may be unproblematic and even attractive. If the exercise of plenary power reflects majority will, then this exercise …

International Copyright: An Unorthodox Analysis American Association Of Law Schools' Intellectual Property Section's Symposium On Compliance With The Trips Agreement, Hugh C. Hansen Jan 1996

International Copyright: An Unorthodox Analysis American Association Of Law Schools' Intellectual Property Section's Symposium On Compliance With The Trips Agreement, Hugh C. Hansen

Faculty Scholarship

Professor Hansen reviews the development of copyright from its traditional domestic orientation to the modern emphasis on globalization and harmonization. His commentary analogizes modem trends in international copyright to religious equivalents. He notes that the current players include a "secular priesthood" (the traditional copyright bar and academics), "agnostics and atheists" (newer academics and lawyers, particularly those concerned with technology and the culture of the public domain) and "missionaries" (whose task it is to increase copyright protection around the world and who are primarily driven by trade considerations). The copyright "crusade" has been driven by this last group. The author compares …

Herland, By Charlotte Perkins Gilman, Michael R. Hill Jan 1996

Herland, By Charlotte Perkins Gilman, Michael R. Hill

Department of Sociology: Faculty Publications

Herland is the first half of a witty, sociologically astute critique of life in the United States. This story concentrates ostensibly on three men-Van, Jeff, and Terry-who discover a small, uncharted country called Herland which, by force of an unusual accident of nature, has been governed and populated for two thousand years solely by women. Biological reproduction occurs miraculously by parthenogenesis (that is, without insemination). Charlotte Perkins Gilman exploits this contrived situation in order to contrast and compare the social features of a hypothetical woman-centered society to the harsh realities and crushing inequalities of everyday life found pervasively in male-dominated …

Joan Huber, Irving Louis Horowitz, And The Ideological Future Of Objectivity In American Sociology, Michael R. Hill Jan 1996

Joan Huber, Irving Louis Horowitz, And The Ideological Future Of Objectivity In American Sociology, Michael R. Hill

Department of Sociology: Faculty Publications

The occasion of this essay is an unsolicited but welcome invitation to comment on Irving Louis Horowitz's (1993) most recent book, The Decomposition of Sociology, a work that is generating considerable discussion (e.g., Bauer Mengelberg 1995; Chriss 1994; Goldman 1994; Horowitz 1994, 1995; Pizzorno 1994; Wagner 1994). An invitation to discuss a book by Horowitz in a public forum-to which he is invited to respond-is a genuine honor eagerly accepted here with what is undoubtedly a too small twinge of apprehension, a twinge of the minimally regarded kind that allows proverbial fools to rush into intellectual tight spots from which …

New County Records Of Botrychium Lunarioides In Texas., L. H. Do, R. D. Gooch, Jeffrey R. Stevens, W. C. Holmes, J. R. Singhurst

Department of Psychology: Faculty Publications

Recent collections of B. lunarioides in east-central Texas indicate that the species is more widespread within the state (Fig. 1). Other than for Navarro County, the new records are in the Post Oak Savannah Region of the state, with the Navarro County location classified as being within the Blackland Prairie Region or in part of an extension of the Post Oak Woods/Forest in the Blackland Prairie Region. All specimens previously cited by Thomas (1979) and Thomas et al. (1981) were from the eastern part of the Pineywoods Region. The San Augustine site is about 32 km from the state line …

Timing Of First Sexual Intercourse: The Role Of Social Control, Social Learning, And Problem Behavior, Lisa J. Crockett, C. Raymond Bingham, Joanne S. Chopak, Judith R. Vicary Jan 1996

Timing Of First Sexual Intercourse: The Role Of Social Control, Social Learning, And Problem Behavior, Lisa J. Crockett, C. Raymond Bingham, Joanne S. Chopak, Judith R. Vicary

Department of Psychology: Faculty Publications

Prior research has pointed to several distinct processes that may affect the timing of first intercourse among adolescents. In the present study, the role of six hypothesized processes was assessed in a sample of 289 rural adolescent boys and girls. Results support the importance of family socialization and problem behavior for both sexes, the role of biological factors for boys, and the role of social control processes for girls. Two other hypothesized influences--social class and poor psychosocial adjustment--were not supported in either gender. These results indicate that multiple processes influence the timing of first intercourse; thus, they underscore the need …

A Cross-National Study On The Relations Among Prosocial Moral Reasoning, Gender Role Orientations, And Prosocial Behaviors, Gustavo Carlo, Silvia H. Koller, Nancy Eisenberg, Marcia S. Da Silva, Claudia B. Frohlich Jan 1996

A Cross-National Study On The Relations Among Prosocial Moral Reasoning, Gender Role Orientations, And Prosocial Behaviors, Gustavo Carlo, Silvia H. Koller, Nancy Eisenberg, Marcia S. Da Silva, Claudia B. Frohlich

Department of Psychology: Faculty Publications

This research examined the correlates of prosocial moral reasoning (PMR) in 2 studies. Study I investigated age, gender, and culture group differences in PMR in Brazilian children and adolescents (n = 265) and U.S. adolescents (n = 67). Relations between PMR and both prosocial behaviors and gender role orientations in Brazilian adolescents (n = 136) were explored in Study 2. Self-reflective, internalized reasoning was positively related, and hedonistic reasoning was negatively related, to peer ratings of prosocial behaviors. Femininity was associated with more self-reflective, internalized concerns and with less concerns regarding gaining others’ approval. In general, age …
