Tortious Interference: The Limits Of Common Law Liability For Newsgathering, Sandra S. Baron, Hilary Lane, David A. Schulz May 1996

Tortious Interference: The Limits Of Common Law Liability For Newsgathering, Sandra S. Baron, Hilary Lane, David A. Schulz

William & Mary Bill of Rights Journal

Media lawyers have recently been confronted with a relatively new source of litigation: the tort of intentional interference with contractual relations, which arises out of confidentiality agreements. In this Article, the authors identify the elements of tortious interference with contracts and examine the key issues presented when this tort is applied to newsgathering. The authors then consider a potential defense based on the First Amendment. In light of the public and constitutional interests at stake, the authors conclude that the breach of a confidentiality agreement should not sustain a tortious interference claim when the press is involved in newsgathering activity.

The Juvenile Curfew: Unconstitutional Imprisonment, Tona Trollinger May 1996

The Juvenile Curfew: Unconstitutional Imprisonment, Tona Trollinger

William & Mary Bill of Rights Journal

Faced with rising crime rates, many municipalities in recent years have enacted juvenile curfews. Professor Tona Trollinger uses an ordinance enacted in Dallas, Texas, as a framework for analyzing juvenile curfews. The author discusses various prudential and constitutional objections to these curfews, including both substantive and procedural due process challenges. The author concludes that the admittedly valid governmental objectives underlying such curfews do not override their constitutional infirmities.

Constitutional Civil Law, Albert Sidney Johnson May 1996

Constitutional Civil Law, Albert Sidney Johnson

Mercer Law Review

During the 1995 survey period, the United States Court of Appeals for the Eleventh Circuit ("Eleventh Circuit" or "Court") was influenced by the Supreme Court of the United States (the "Supreme Court"), application of the effect of its earlier decisions, and a number of cases of first impression. The Court was required to modify its long-standing practices of pendent appellate jurisdiction and scope of review in cases involving qualified immunity defenses. The Supreme Court's refinement of the definition of "deliberate indifference' influenced several of the Court decisions relating to the Cruel and Unusual Punishments Clause of the Eighth Amendment. The …

Waiver Of Sovereign Immunity: An Analysis Of Gilbert V. Richardson, Susan Hurt May 1996

Waiver Of Sovereign Immunity: An Analysis Of Gilbert V. Richardson, Susan Hurt

Mercer Law Review

In Gilbert v. Richardson, the Georgia Supreme Court addressed the issue of whether a county waives its sovereign immunity by purchasing liability insurance. On September 1, 1991, Deputy Kathy Richardson responded to an emergency call and collided with Emma and Tommy Gilbert's vehicle. Both Gilberts were injured. The Gilberts brought suit against the Walker County Sheriff's Department, the sheriff, and a deputy sheriff. Plaintiffs alleged that Sheriff Millard, as the employer of the deputy sheriff, was liable for the acts of the deputy while she was acting within the course of her employment. Walker County's Georgia Interlocal Risk Management …

School-To-Work And Service-Learning, The National School-To-Work Learning And Information Center May 1996

School-To-Work And Service-Learning, The National School-To-Work Learning And Information Center

School K-12

School-to-work systems show young people how their classroom experiences relate to their work and to their lives, typically through internships, apprenticeships, or other work-based learning experiences. Other methods of positive youth development, such as service-learning, can also provide opportunities for the real world application of classroom-developed skills. As a work-based learning component in a school-to-work system, service-learning extends learning beyond the classroom into real world contexts where young people acquire not only basic math, science, English, and communication skills, but also broader problem-solving and decision-making skills. However, instead of focusing primarily on occupational skills sought by employers, service-learning addresses community …

Design Review By Committee, San Mateo County, Eric A. Kishi May 1996

Design Review By Committee, San Mateo County, Eric A. Kishi

Master's Projects

Design review is recognized in the general plans, specific plans, and zoning ordinances of many jurisdictions throughout the state as a necessary procedure to ensure that new construction or an addition blends in well with the existing community, minimizes the impact on the natural environment, and maintains property values. Planning departments are given the responsibility of developing the procedure which implements the design review policies and regulations approved by the legislative body, the Board of Supervisors or the City Council.

Site Suitability Analysis For An Intermountain Solid Waste Facility: A Study For Cache County, Utah, Joseph B. Campo May 1996

Site Suitability Analysis For An Intermountain Solid Waste Facility: A Study For Cache County, Utah, Joseph B. Campo

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

The goal of this project was to analyze Cache County for potential sanitary landfill sites covering the period 2020 to 2120. The county population and per capita solid waste were estimated. The minimum landfill size was then calculated.

A geographic information system (GIS) was used for data storage and vii analysis. Relevant data were gathered. Areas which would not support a landfill were eliminated. Remaining sites were rated as having slight, moderate, or severe restrictions for use as an area method sanitary landfill based on the Natural Resource Conservation Service (NRCS) Sanitary Facility Report, and the NRCS Soil Interpretations Rating …

Environmental Mediation: An Assessment And Case Study Of The Logan Canyon Highway Controversy, Jared Glenn Parkinson May 1996

Environmental Mediation: An Assessment And Case Study Of The Logan Canyon Highway Controversy, Jared Glenn Parkinson

Undergraduate Honors Capstone Projects

For a little more than twenty years, alternative methods of dispute management have been employed to address various environmental conflicts in order to avoid the more traditional method of litigation. Mediation is a voluntary process which involves face-to-face negotiation among parties and the use of a neutral third-party negotiator. Environmental mediation has helped manage disputes related to land use, natural resource management, use of public lands, water resources, energy development, air quality and toxins (Bingham 1986).

Environmental Contamination By Trace Metals At The Inactive Pacific Mine Site, American Fork Canyon: Legal And Remediation Implications, Phyllis Ann Bustamante May 1996

Environmental Contamination By Trace Metals At The Inactive Pacific Mine Site, American Fork Canyon: Legal And Remediation Implications, Phyllis Ann Bustamante

All Graduate Plan B and other Reports, Spring 1920 to Spring 2023

Over the next decade, the environment will be the most important issue facing the minerals industry (Ary, 1990). Mining and its associated activities can be a source of considerable environmental damage (Table 1 ). Mining activities can cause surface and ground water pollution , damage the land and subsurface strata, and destroy terrestrial and aquatic habitat. While mining contributes to environmental degradation , it may be considered a necessary activity because it provides natural resources with a variety of commercial uses.

Opening Address, Stanley N. Katz May 1996

Opening Address, Stanley N. Katz

Cardozo Law Review

I am more moved by this occasion than any of you other than Owen Fiss can imagine, for it takes me back to my first days teaching law at the University of Chicago in the fall of 1971. It was then and there that I began two of the most important friendships of my life with Harry Kalven and Owen Fiss. We agreed to begin a series of seminars on the law of slavery, which in the end carried on for three years.

The Hermeneutic Of Acceptance And The Discourse Of The Grotesque, With A Classroom Excercise On Vichy Law, Richard Weisberg

Cardozo Law Review

As a nonspecialist on the laws of slavery, I can best contribute to this discourse by suggesting some reflection on the comparative nature of racial discrimination in constitutionally based and seemingly enlightened legal systems. To the American system under close scrutiny in this Symposium, my recently completed work on Vichy law may lend some degree of further understanding. For the legalized persecution of Jews in France during the period 1940- 44 stands as a classic twentieth-century example of what I believe to have been at work in antebellum America: the elaboration through traditional patterns of legal reasoning of a discourse …
