In the summer of 1995, the en banc Texas Court of Criminal Appeals in Flores v. State upheld a lower court’s ruling to give a drunk-driving (DWI) offender a year in prison as opposed to probation. The trial judge denied the defendant probation due to his inability to speak English. The county in which the defendant was arrested and convicted did not provide a DWI rehabilitation program in Spanish, leading the judge to determine the defendant would not benefit from probation. In his appeal, Mr. Flores claimed the lower court violated his equal protection and due process rights under the …

Justifying Employee Drug Testing: Privacy Rights Versus Business Interests, Douglas Isbister
Dalhousie Journal of Legal Studies
Mandatory drug testing in the workplace as a form of employee monitoring raises numerous questions. This paper will explore the extent to which employees can claim a right to privacy in employment situations. This will be followed by an exploration into the legal framework in which drug testing programs may be implemented. Finally, the paper will consider the competing interests of employers and employees with respect to drug testing. In the end, it will be argued that mandatory drug testing in the workplace is a justifiable form of monitoring employees, and that attempts to ban its use at this point …

Prostitution And The Law In Germany, Margarete Von Galen
Cardozo Journal of Equal Rights & Social Justice
The article examines the legal and social contradictions surrounding prostitution in Germany, highlighting how, despite its legal status, the practice is subject to discriminatory laws and regulations that create a hypocritical gap between legal frameworks and real-world enforcement. The author argues that while prostitution is legal, the surrounding legal provisions often criminalize related activities, leading to inconsistent enforcement and continued marginalization of sex workers.

Mandating Coverage For Maternity Length Of Stays: Certain Problems With The Good Idea, Kate E. Ryan

This paper will outline the issues influenced by the Newborns' Act and the Maternity Law, including federalism. Likewise, the paper examines certain shortcomings of the maternity legislation. Section II focuses on Ohio's Maternity Law and whether it will prove effective as exemplified by Cleveland's maternity health care standards. Section III addresses the Newborns' Act and how it will influence federalism. Additionally, section III compares the Newborns' Act to the Maternity Law Section IV explores how the concurrent regulations may affect maternity health care.

This monograph discusses the assessment of social and economic impacts for a Low-Level Radioactive Waste (LLRW) disposal facility siting. It examines how to maximize the possibility of locating a host site by actively involving stakeholders to obtain their input on site design. To realize a siting stakeholders may require extensive information sharing and education about the proposed land use. Negotiation and use of incentive can also be useful for developing optimal policy and generating opinion in favor of a siting.
