Preventive Detention And The Judicial Prediction Of Dangerousness For Juveniles: A Natural Experiment, Jeffrey Fagan, Martin Guggenheim

A study was conducted to examine the validity of judicial predictions of dangerousness inherent in preventive detention of juvenile offenders. Data were drawn from juveniles remanded in custody under the preventive detention statute of the New York Family Court Act during 1981 and 1984 and subsequently released within hours of the detention order pursuant to an injunction obtained in a federal district court. It is argued that there are reasonable and constitutional arguments to incapacitate a presumptively innocent individual when it is certain that he or she is dangerous. The Violence Against Women Act After United States V. Lopez: Will Domestic Violence Jurisdiction Be Returned To The States, Stacey L. Mckinley

Recent judiciary and media events have put a national focus on the overlooked problem of domestic violence. Federal lawmakers admirably responded to this attention in an aggressive manner when Congress passed the Violence Against Women Act (VAWA). Although little doubt exists that this country needs to reduce domestic violence, this sweeping federal legislation may not be the most effective means. The hasty response by federal lawmakers is unconstitutional in consideration of the Supreme Court's recent holding in Lopez. Although initial court challenges to the VAWA on Lopez grounds have resulted in split decisions, this Note argues that portions of the …

Administrative License Suspensions, Criminal Prosecution And The Double Jeopardy Clause, Carlos F. Ramirez

This Note argues that revocation of a driver's license under ALS proceedings is not a bar to subsequent criminal prosecution by the state. It discusses the potential double jeopardy implications surrounding ALS that is followed by criminal proceedings, as well as the reasoning employed by a majority of the courts that hold that an ALS is remedial and, therefore, not punishment for purposes of the Double Jeopardy Clause. It argues that with regard to determining whether an ALS is punitive, the appropriate test should balance the effect of the statute on the driver against the state's interest in protecting the …

On November 4, 1997, the question "Shall there be a convention to revise the [state] constitution and amend the same?" will be submitted to the New York state electorate pursuant to the provision in the state constitution requiring that every twenty years the voters be given the opportunity to call for a constitutional convention. A longstanding constitutional concern in New York is local government and the relations between local governments and the State. With an eye to the upcoming vote on whether to hold a constitutional convention, this paper examines the place of local government and state-local relations in the …

Public finance issues with significant consequences for American federalism have been at the top of the political agenda for the last several years. Indeed, much of the current debate about American federalism has been explicitly about questions of public finance: Which level of government should pay for which programs? What is to be the relationship between financial responsibility and policy-making authority? Should there be some overall limitation on government outlays and receipts?

Recent geologic research has shown that earthquakes more destructive than formerly expected are likely to occur in the Pacific Northwest. To mitigate catastrophic loss, planners are gathering information to make decision on implementing regional seismic retrofit programs. This research develops a model to estimate regional earthquake losses for existing buildings, and determine optimal retrofit priorities and budgets. Fragility curves are developed to provide earthquake damage estimates for a range of seismic intensities. The published earthquake damage estimates of a large group of prominent earthquake engineering experts are extended to include the combined effect of structure type, earthquake-sensitive variations in building …

Unrelated business enterprises have been an appropriate way for nonprofit organizations to generate income since the first income tax was enacted into law. The Internal Revenue Act of 1950 clarified this opportunity and enacted the Unrelated Business Income Tax to ensure that fair competition existed between nonprofits and for profit organizations. Nonprofit organizations conducting unrelated business enterprises are faced with a dilemma: it is legal for them to conduct such enterprises but if they do so they face potential litigation from for profit business for unfair competition and/or potential loss of tax-exempt status for operating outside of their exempt function. …

This report seeks to describe and analyze that dysfunction as it manifests itself in three low-income neighborhoods in San Francisco and Oakland. It does not examine the causes nor scope of poverty in those communities nor does it intend to estimate or describe the prevalence of hunger. These measures are amply documented in a 1995 report on hunger and the problem of food "insecurity" commissioned by the California Senate Office of Research and, in 1993 and 1994, reports on hunger from the Alameda County Community Food Bank and San Francisco Food Bank, respectively. The purpose of this descriptive study was to conduct a secondary analysis of the data set obtained from the Trauma and Emergency Center Violence Project (Dorsey, 1994). It was noted during the original 6 month study of 33,098 emergency department visits that some patients threatened or carried out real violence on multiple visits.; This study (a) identified the percentage of incidents in the initial sample that were perpetrated by repeat offenders, (b) described the types of violent behaviors, (c) explored the relationship between current substance and psychiatric history and the number of threatened or real violence incidents.; A descriptive research …

Traumatic injury prevention and treatment is an increasingly important focus for the nursing profession as trauma tops the list for causes of death among young people in the United States. The specific purpose of this study was to explore whether a pre-existing state of low basic need satisfaction and low social support contribute to traumatic injury in adults. A descriptive correlational design was used. The theoretical frameworks of Erickson, Tomlin, and Swain (1983) and Lazarus (1964) formed the foundation for this study. Seminole Tribe v. Florida is the 1995 Term's illustration of the importance that a narrow, but solid, five-Justice majority of the Supreme Court attaches to the constitutional underpinnings of "Our Federalism." In Seminole Tribe, this majority declared that Congress lacks authority under its Article I, Section 8 regulatory powers to subject unconsenting states to suits initiated in federal court by private persons. The very same majority had previously made clear its intention to implement the original constitutional understanding of a national government of limited powers, especially when the national government attempted to "commandeer" state legislative and administrative processes. Application of composted municipal waste to agricultural lands has potential benefits to improve soil fertility and crop yield. It may lead to accumulation of heavy metals within soils and leaching of nutrients and heavy metals into the ground water. The objectives of this study were to investigate: (1) the effects of composted municipal waste and fertilizer on soil chemical properties and sugarcane elemental uptake and yield; and (2) the leachability of elements in compost amended soils. Results of three field experiments from a Baldwin silty clay loam and a Memphis silt loam showed that compost application at $\ge$33.6 Mg/ha increased …

The purpose of this descriptive research study was to determine the existence of predictors for success of nursing students who are granted appeals, based on special circumstances, by the University Progression and Retention Committee of Southeastern Louisiana University. This study investigated demographics (age, marital status, gender, race, residence, semester of appeal, and educational background) of 302 nursing students from Southeastern Louisiana University (January 1988, to May 1995) that appealed to the Progression and Retention Committee of the university to continue in the nursing program.
