Viewpoint: Hindu-Christian "Studies": Some Confessions From The Boundaries, Fred W. Clothey Jan 1996

Viewpoint: Hindu-Christian "Studies": Some Confessions From The Boundaries, Fred W. Clothey

Journal of Hindu-Christian Studies

There are times I think the term Hindu-Christian "studies" or even Hindu-Christian "dialogue" is a misnomer and a fantasy. This is so for several reasons. For one thing, there is a long history in which such "study" or conversation has been a monologue, a one-way street or an interpretation by imposition. There has been too much shouting at each other from caves and not enough honesty, negotiation, and mutual respect of personhood on the boundaries between where peoples live. For another, such engagements are not and never again can be merely one on one discourses between persons with single identities. …

Forest And Village: Popular Hindu-Christian Encounter, David C. Scott Jan 1996

Forest And Village: Popular Hindu-Christian Encounter, David C. Scott

Journal of Hindu-Christian Studies

The realization that what is commonly spoken of as Hinduism is in reality an elite Brahmanical religion is so ubiquitous that there is no need to argue the point here. Similarly, Christianity has generally been understood in terms of classical Western theological and philosophical thought. This being the case, it is hardly surprising that until relatively recently what has been understood as the encounter and interaction of Christianity and Hinduism has been, in fact, an encounter and interaction of what we might speak of as the elite great traditions in both religious systems. Yet the fact remains that in India …

Myths, Realities, And The Political World: The Anthropology Of Insanity Defense Attitudes, Michael L. Perlin Jan 1996

Myths, Realities, And The Political World: The Anthropology Of Insanity Defense Attitudes, Michael L. Perlin

Articles & Chapters

The author presents the case that society's efforts to understand the insanity defense and insanity-pleading defendants are doomed to intellectual, moral, and political gridlock unless we are willing to take a fresh look at the doctrine through a series of filters-empirical research, scientific discovery, moral philosophy, cognitive and moral psychology, and sociology-in an effort to confront the single most important (but rarely asked) question: why do we feel the way we do about "these people" (insanity pleaders)? He examines this question finally through a model of structural anthropology and concludes that until we come to grips with the extent to …

On Seeing Chinese Law From A Chinese Point Of View: An Appreciative Look At The Scholarly Career Of Professor William Jones, Janet Ainsworth Jan 1996

On Seeing Chinese Law From A Chinese Point Of View: An Appreciative Look At The Scholarly Career Of Professor William Jones, Janet Ainsworth

Faculty Articles

In this appreciative review, Professor William Jones's work is used to demonstrate that sensitivity to issues of methodology are indispensable for comparative law scholars. Professor Jones's work is valuable because (1) it is marked both by an awareness of the methodological difficulties faced by the comparativist and a confidence that it is nonetheless possible to transcend these difficulties and (2) it makes a meaningful contribution to the development of an understanding of a foreign legal order. The article concludes by stating that Professor Jones's work will influence future generations of scholars trying to answer the why, what, and how of …

Romantic Perception: A Kierkegaardian Re-Formation Of The Appearances Via Existential Arrest Towards Conscious Imaginative Relation, Christoph Franz Dobrowolski Jan 1996

Romantic Perception: A Kierkegaardian Re-Formation Of The Appearances Via Existential Arrest Towards Conscious Imaginative Relation, Christoph Franz Dobrowolski

School of Theology and Seminary Graduate Papers/Theses

The focus of this paper is to attempt to analyze how, in Kierkegaard's paradigm of what constitutes "a self", the representations of the phenomena change in the eyes of the perceiver from a state of "no self" - lacking this consciousness and active engagement of spirit-, to the moment of existential arrest, to a state of being "a self" - new and ever-growing consciousness as a result of this arrest. The primary source for this endeavour is Kierkegaard's text, The Concept of Anxiety. Methodology for this endeavour will involve explication of the text itself with nuances from other post-enlightenment literature …

International Human Rights Law, Feminist Jurisprudence, And Nietzsche's "Eternal Return": Turning The Wheel, Barbara Stark Jan 1996

International Human Rights Law, Feminist Jurisprudence, And Nietzsche's "Eternal Return": Turning The Wheel, Barbara Stark

Hofstra Law Faculty Scholarship

Part I explains how human rights law enables those denied their rights to assert claims against their own States. Part II relies on the recent work of feminist historian Gerda Lemer to describe how women have repeatedly reinvented "feminist consciousness" during the past 300 years of Western civilization and how feminist consciousness has repeatedly waned and disappeared. It then explains how international human rights law supports that consciousness. Part III draws on Nietzsche's theory of the "eternal return' to show how American feminists can claim international human rights law as their own. Part IV uses Adrienne Rich's powerful poem Turning …

Response To Professor Woodhouse, Janet L. Dolgin Jan 1996

Response To Professor Woodhouse, Janet L. Dolgin

Hofstra Law Faculty Scholarship

In her Afterword to Solomon's Dilemma: Exploring Parental Rights, Professor Barbara Bennett Woodhouse asserts that I advocate judicial reliance on the notion of intent to determine parenthood in certain cases occasioned by reproductive technology. I do not, and in the paper to which Professor Woodhouse referred did not, advocate such a position. In my paper, I did analyze the implications of such reliance by a number of courts. Professor Woodhouse confused my analysis with advocacy. In so doing, Professor Woodhouse weakened the effects and potential benefits of both analysis and advocacy. Analysis does not necessarily imply advocacy, though obviously analysis …

Use Of Geographic Information System Technology To Assess Vulnerability To Shallow Groundwater Contamination., Brenda G. Bruner Jan 1996

Use Of Geographic Information System Technology To Assess Vulnerability To Shallow Groundwater Contamination., Brenda G. Bruner

LSU Historical Dissertations and Theses

Geographic Information System (GIS) technology was used to develop a local scale screening procedure for assessing shallow ground water's vulnerability to nitrate contamination. The procedure was based on the spatial distribution of ten key physical and chemical properties of soils. Both flow characteristics and attenuation capabilities of soils were incorporated into the assessment. Land surface areas were classified by the GIS to show the level of vulnerability present at a site as a result of existing natural conditions. The procedure produced a Vulnerability Index (VI), and resulted in VI ranging from 4.98 to 6.72 for the study area (with ten …

Scale, Resolution And Resampling: Representation And Analysis Of Remotely Sensed Landscapes Across Scale In Geographic Information Systems., Stephanie Jean Weigel Jan 1996

Scale, Resolution And Resampling: Representation And Analysis Of Remotely Sensed Landscapes Across Scale In Geographic Information Systems., Stephanie Jean Weigel

LSU Historical Dissertations and Theses

Earth system scientists are increasingly using the technologies of Geographic Information Systems (GIS) and Remote Sensing (RS) in their analyses of earth system processes and patterns. These investigations take place over a wide range of scales, from the local to the global. Global change researchers focus on both the physical and human dimensions of changes in the earth's landscapes, which occur across a range of scales and may be scale dependent. The way in which landscapes are represented in GIS and RS, using specific spatial data models and data spatial resolutions, affects the subsequent analyses that can be performed. Optimally …

Performance, Cultural Identity, And Feminist Practice In The Oral History Of An African-American Domestic Worker., Elondust Patrick Johnson Jan 1996

Performance, Cultural Identity, And Feminist Practice In The Oral History Of An African-American Domestic Worker., Elondust Patrick Johnson

LSU Historical Dissertations and Theses

This study analyzes the personal narrative of Mary Rhyne, an elderly African American domestic worker. The study describes the ethnographic process of collecting, transcribing and interpreting the informant's oral history. Interpretive and theoretical perspectives concerned with African American culture, domestic labor, and feminist practice are used to analyze the narrative. Further, the ethnographic process, the informant's oral "telling," and the events that she recalls and recounts are viewed as, and in terms of, performance. Performance foregrounds the collaborative and "fictional" aspects of the ethnographer-informant relationship. It directs attention toward the "performance event" as a site and situation where the teller …

Local Solidarity And Low-Income Families: Can A Clinical Approach Be Empowering?, Néréé St-Amand Jan 1996

Local Solidarity And Low-Income Families: Can A Clinical Approach Be Empowering?, Néréé St-Amand

Clinical Sociology Review

This article seeks to determine whether a clinical approach can break down some of the barriers that exist between researchers and lowincome families and individuals, and whether such an approach can be empowering and raise awareness. Research conducted in Canada on alternative resources for low-income families highlights some of the characteristics and limitations of the clinical approach. While the clinical approach can foster closer links between researchers and disadvantaged people, it does not necessarily challenge structural inequalities or promote empowering practices. A definition of the clinical approach is compared and contrasted with the approach discussed in this paper.

Sociopolitical Structure Of Transjordanian Societies During The Late Bronze And Iron I Ages (Ca. 1500-1000 B.C.), Paul Z. Gregor Jan 1996

Sociopolitical Structure Of Transjordanian Societies During The Late Bronze And Iron I Ages (Ca. 1500-1000 B.C.), Paul Z. Gregor

Dissertations

According to the biblical account the Transjordanian region was occupied with somewhat organized societies during the time of the Exodus (ca. 15th century B.C.). Unfortunately, archaeological excavations could not confirm this account, and as result, the biblical data have been dismissed as unreliable and historically inaccurate.

The purpose of this study was to provide the most recent archaeological data as well as to reinterpret the old data to see whether or not the biblical account bears any historical value. For this reason, this dissertation provides evidence from three fields: archaeological, anthropological, and biblical.

In spite of Glueck's claim that Transjordan …

The Empirical Development Of A Curriculum On Psalms Utilizing A Modified Form-Critical Approach, Ted Ewing Jan 1996

The Empirical Development Of A Curriculum On Psalms Utilizing A Modified Form-Critical Approach, Ted Ewing

Dissertations

Problem. The purpose of this study was to empirically develop a curriculum on the book of Psalms for readers of the English text that would bridge historical, theological, cultural, and linguistic distance, as well as overcome literary challenges associated with Hebrew poetry including figures of speech, parallelism, and psalm forms.

Method. The instructional product development methodology employed in this study was based on the work of Baker and Schutz (1971) and Naden (1993). The need for the product was established through a literature review, the specific learners were described, behavioral objectives were constructed, an identical pre-test and post-test were prepared, …

Comment On Moliterno, Legal Education, Experiential Education, And Professional Responsibility, Lance Liebman Jan 1996

Comment On Moliterno, Legal Education, Experiential Education, And Professional Responsibility, Lance Liebman

Faculty Scholarship

In attempting to predict and prescribe the future, my vision of the recent history of legal education differs from Professor Moliterno's in certain relevant ways.

I graduated from Law School in 1967. I learned largely through doctrinal courses that delivered steady training in thinking like a lawyer and information about areas of law. These courses exposed me and my classmates to legal lingo and to the standard types of legal arguments. We learned, largely by hearing the teacher and our fellow students, to make verbal moves and to see the strengths and limitations of others' argumentation skills and techniques. We …
