Confronting Expectations: Women In The Legal Academy, Christine Haight Farley

A seemingly insurmountable barrier to women's success in legal academia is the way they are perceived. Numerous studies have shown that women are perceived as less competent than men and that the same work is evaluated more critically when it is thought to have been done by a woman than by a man. This problem exists in all aspects of life, but it is especially acute for women in professional roles, such as academics. Legal academia, however, seems to be particularly resistant to viewing women as equally competent. The article presents original empirical research that shows that student evaluations of …

On Behalf Of The Fool: G.E. Moore And Our Knowledge Of The Existence Of Material Objects, Edward N. Martin

In this paper I argue that G.E. Moore’s naturalism (combined with his sense-data theory) falls prey to the charge, leveled recently by Plantinga, that Moore doesn’t know whether his belief-forming mechanisms are functioning properly when he says he knows a pencil (or his hand) exists. Help from Alston may be sought in response to criticisms, but these are not sufficient to vindicate Moore’s form of naturalism.

This Article discusses the current predominance of natural rights theory in the area of intellectual property and of patents in particular. Due to the alleged problems of international theft and pirating of patents, the recent GATT negotiations saw intellectual property law come to center stage in the debate over trade. These negotiations concluded that trade-related aspects of intellectual property law can no longer be left to the public policy of individual countries, but require new international minimum standards.

Goodbye To All That--A Reluctant (And Perhaps Premature) Adieu To A Constitutionally-Grounded Discourse Of Public Interest In Copyright Law, Peter A. Jaszi

Vanderbilt Journal of Transnational Law

In this Article, Professor Jaszi suggests that there is a need to develop new, policy-grounded arguments against expansionist legislative and judicial tendencies in copyright that diminish the traditional public domain. In recent years, he contends, a new understanding of the purposes of a copyright system has emerged, which has changed the U.S. copyright discourse in support of increased proprietary rights. According to Professor Jaszi, the objective of this new understanding is to improve the competitive position of companies that have significant investments in Inventories of copyrighted works. Not long ago, the welfare reform debate took a provocative turn. New Jersey welfare recipients challenged the state's Family Cap rule, which denied additional cash aid to parents who conceive children while on welfare. Welfare rights activists argued that the rule "with[held] benefits to see if [this would] alter human behavior." They insisted that the innovative, but stern, Family Cap rules were effectively experiments on welfare recipients without their consent.

This is a powerful argument. After all, consent enjoys talismanic—if not sacramental—status in modem life and thought; it is our "master concept." But why? Why should consenting mean so much …

Unraveling An Ancient Peruvian Tapestry Sampler: A Study Of Weaver Education In The Ica Valley, Peru, Elizabeth Sara Lewis

A tapestry from the Ica Valley of Peru (A.D. 900-1476), in the collection of the Virginia Museum of Fine Arts, Richmond, Virginia, is the subject of this study. This thesis is an attempt to demonstrate that the tapestry is an example of a textile form known as a "sampler." Woven as a learning tool and template by an apprentice and an expert weaver within the style and reflecting the iconography of Ica art.

A three-part approach is taken to examine the Ica tapestry. First, it is necessary to prove that the piece is a sampler, woven in an apprenticeship situation, …

Identifying The Harm In Racial Gerrymandering Claims, Samuel Issacharoff, Thomas C. Goldstein

Michigan Journal of Race and Law

This Article proceeds along two lines. First, it reviews the theories of harm set forth in the Justices' various opinions, i.e., the articulated risks to individual rights that may or may not be presented by racial gerrymandering. What is learned from this survey is that Shaw and its progeny serve different purposes for different members of the Court. Four members of the Shaw, Miller v. Johnson, and United States v. Hays majorities-Chief Justice Rehnquist, along with Justices Scalia, Kennedy, and Thomas- are far more concerned with "race" than "gerrymandering." In particular, they consider all race-based government classifications to be inherently …

In this Note, the author steers away from the current substantive debates surrounding the Voting Rights Act, its various amendments, and the "correct" way of interpreting its intended benefits and constitutionally accepted mandates. Instead, indirectly joins the many "radical" voices advocating for a departure from the majoritarian stranglehold-the decision-making process where fifty percent plus one of the voting population carry the election. The author does so not by suggesting yet another mechanism by which representatives may be elected, but by critiquing the perceived underpinnings of our democratic system of government. Muscular Basis Of Buccal Pressure: Inflation Behavior In The Striped Burrfish Chilomycterus Schoepfi, Peter C. Wainwright, Ralph G. Turingan

We examined the relationship between commonly measured features of cranial muscle activity and the magnitude of sub- and superambient pressure measured inside the buccal cavity of the striped burrfish Chilomycterus schoepfi during inflation behavior. Buccal pressure was recorded simultaneously with electromyographic (EMG) records of activity from three expansive-phase muscles (levator operculi, levator pectoralis and hyohyoideus abductor) and three compressive-phase muscles (adductor mandibulae, protractor hyoideus and protractor pectoralis) in eight individuals. We quantified EMG activity in approximately 30 inflation cycles per fish by measuring the burst duration, rectified integrated area, intensity of activity (area divided by duration) and onset time relative …
