Rejuvenating Copyright, David Vaver Jan 1996

Rejuvenating Copyright, David Vaver

Articles & Book Chapters

The law of copyright has, especially when combined with other legal mechanisms, become a potent and wide-ranging instrument - some say too much so for protecting and establishing markets in a wide range of products. This paper argues for a fundamental reassessment of domestic and international law. The protectionists' rallying cry of "to each cow its calf" has produced an incoherent system many ordinary people find unacceptable. Questions such as what specific activities deserve encouragement, what stimulus should be offered, and who should benefit and in what proportions need to be asked and answered. A recontoured copyright system may then …

Modeling Diseased Oyster Populations. Ii. Triggering Mechanisms For Perkinsus Marinus Epizootics, Eric N. Powell, John M. Klinck, Eileen E. Hofmann Jan 1996

Modeling Diseased Oyster Populations. Ii. Triggering Mechanisms For Perkinsus Marinus Epizootics, Eric N. Powell, John M. Klinck, Eileen E. Hofmann

CCPO Publications

Densities of Crassostrea virginica remain high enough to support substantial fisheries throughout the Gulf of Mexico despite high mortality rates produced by the endoparasite Perkinsus marinus. The infrequency of epizootics in these populations suggests that controls exist on the disease intensification process. The progression of epizootics in oyster populations, the factors that trigger epizootics, and the factors that terminate epizootics once started were investigated with a coupled oyster population—P. marinus model.

The time development of a simulated epizootic was triggered by environmental conditions that occurred and disappeared as much as t8 months prior to the onset of mortality in …

Religious Expression In The Public Square – The Building Blocks For An Intermediate Position, Kent Greenawalt Jan 1996

Religious Expression In The Public Square – The Building Blocks For An Intermediate Position, Kent Greenawalt

Faculty Scholarship

The problem of religious expression in the public square is not primarily legal in a narrow sense. We are not talking about whether people are allowed to voice certain kinds of opinions or to vote on certain kinds of grounds. The problem is about how citizens and officials in liberal democracies should act. My own position on this problem is an intermediate one, in a sense I shall shortly explain. Its plausibility depends on some sense of the strengths and weaknesses of positions at each end of the spectrum. I shall begin with a thumbnail sketch of these.

Captive Environmental Influences On Behavior In Zoo Drills And Mandrills (Mandrillus), A Threatened Genus Of Primate, Erik Terdal Jan 1996

Captive Environmental Influences On Behavior In Zoo Drills And Mandrills (Mandrillus), A Threatened Genus Of Primate, Erik Terdal

Dissertations and Theses

Drills (Mandrillus leucophaeus) are an endangered species of African monkey (Cercopithecidae), and their sole congener the mandrill (Mandrillus sphinx) is vulnerable to extinction. Both species are threatened in the wild by deforestation and hunting.

Drills have a poor record of captive reproduction. Many individuals appear to have behavioral deficiencies which interfere with reproduction. Thus, the zoo population of drills does not serve as a “hedge” against the species’ total extinction: drills are endangered in captivity as well as in the wild. Mandrills, by contrast, reproduce well in captivity. Information on the behavior of mandrills in captivity may help zoo managers …

Determining The Factors Influential In The Validation Of Computer-Based Problem Solving Systems, Leslie Anne Morehead Jan 1996

Determining The Factors Influential In The Validation Of Computer-Based Problem Solving Systems, Leslie Anne Morehead

Dissertations and Theses

Examination of the literature on methodologies for verifying and validating complex computer-based Problem Solving Systems led to a general hypothesis that there exist measurable features of systems that are correlated with the best testing methods for those systems. Three features (Technical Complexity, Human Involvement, and Observability) were selected as the basis of the current study. A survey of systems currently operating in over a dozen countries explored relationships between these system features, test methods, and the degree to which systems were considered valid. Analysis of the data revealed that certain system features and certain test methods are indeed related to …

Student Perceptions Of Riots And Boycotts In Secondary Schools In Kenya's Kirinyaga District, Margaret Wangeci Gatimu Jan 1996

Student Perceptions Of Riots And Boycotts In Secondary Schools In Kenya's Kirinyaga District, Margaret Wangeci Gatimu

Dissertations and Theses

In recent years, a number of secondary schools in the Kirinyaga district of Central Province of Kenya have experienced riots and boycotts. The major objective of this study was to understand why students disrupt the normal processes of schooling. Students' perceptions were obtained by examining their attitudes, ideas, opinions, morals, and myths about these uprisings. The study was phenomenological in nature and was informed by the symbolic interactionism (Bogdan & Biklen, 1992). Data were collected from six diverse secondary schools: three all boys schools, two all girls schools, and one co-educational school. Multiple sources of data and methods of collection …

A Biologic Argument For Gay Essentialism-Determinism: Implications For Equal Protection And Substantive Due Process, E. Gary Spitko Jan 1996

A Biologic Argument For Gay Essentialism-Determinism: Implications For Equal Protection And Substantive Due Process, E. Gary Spitko

Faculty Publications

Classifications, like race, that historically have been used to saddle certain people with disabilities on the basis of a characteristic that otherwise would be irrelevant to an individual's ability to contribute to society are inherently suspect as more likely to have been the product of irrational prejudice and, thus, are deserving of heightened equal protection scrutiny. Thus, in adjudicating whether a sexual orientation classification is deserving of heightened equal protection scrutiny, a court should ask only whether gay people have suffered a history of discrimination and whether their sexual orientation says anything about their ability to contribute to society.

The …

The Relationship Between Dissociation And Object-Relations Impairment In Adult Female Incest Survivor Clients With And Without Personality Splitting, Linda Jean Stuppy Jan 1996

The Relationship Between Dissociation And Object-Relations Impairment In Adult Female Incest Survivor Clients With And Without Personality Splitting, Linda Jean Stuppy

Dissertations

Problem. Childhood incest appears to play a role in the formation of Dissociative Identity Disorder (DID) (formerly Multiple Personality Disorder). This study investigated whether a relationship exists between dissociation and object-relations impairment in incest survivors and whether DID incest survivors have higher levels of these characteristics than non-DID incest survivors.

Method. The Dissociative Experience Scale, Bell Object Relations Reality Testing Inventory and Childhood Maltreatment Interview Schedule-Short Form were completed by a sample of 60 adult female incest survivor clients. 29 who met the diagnosis for DID and 31 who did not.

The Results. All three hypotheses were supported …

Wapato For The People : An Ecological Approach To Understanding The Native American Use Of Sagittaria Latifolia On The Lower Columbia River, Melissa Cole Darby Jan 1996

Wapato For The People : An Ecological Approach To Understanding The Native American Use Of Sagittaria Latifolia On The Lower Columbia River, Melissa Cole Darby

Dissertations and Theses

Sagittaria latifolia Willd. was an important root food and trade commodity for the Indians who lived along the Lower Columbia River in early historic times. This plant was prolific in the extensive wetlands of the Lower Columbia from about the great Cascades to the Kalama River. The tubers of this plant were called "wapato" in Chinook Jargon, the local trade language. The wetlands, and this plant that grew there, occupied a vast extent of the Lower Columbia territory; so much so that this valley was named 'Wapato Valley' by Lewis and Clark in 1805. This thesis will provide pertinent information …

Human Kind In Literature: The Ideals Of Fiction - The Fiction Of Ideals, Lawrence Kimmel Jan 1996

Human Kind In Literature: The Ideals Of Fiction - The Fiction Of Ideals, Lawrence Kimmel

Philosophy Faculty Research

The prophets of suspicion have done their work. Ours is a time of profound skepticism and open cynicism with respect to both the profession and promise of ideals. Too often in the name of some seemingly worthy ideal, we have been led individually and collectively to the deepest and most devastating evils. Religious ideals of the sanctity of life and universal charity sour into zeal and foster self-righteous exclusion and persecution of the non-believer; political ideals of social and economic freedom calcify into operational ideologies which justify enslavement and genocide; moral ideals which acclaim a healthy community authorize censorship, repression, …

The Foraging Behavior Of Peromyscus Leucopus In A Tallgrass Prairie, Cara Jane Joos Jan 1996

The Foraging Behavior Of Peromyscus Leucopus In A Tallgrass Prairie, Cara Jane Joos

Honors Capstones

This experiment was conducted to discover what effect predation, food supplementation, microhabitat, season, and lunar light levels had on the foraging behavior of Peromyscus leucopus in a tall grass prairie. The research was conducted over four nights in the spring and fall of 1995. The pre-existing site contained four predator exclusion plots and four predator access plots. These were used throughout the experiment and the other variables were manipulated at this site. GUDs (giving up densities) were measured to determine the relative foraging levels for each variable. Live trapping census was conducted monthly for the duration of the experiment. Lunar …

The Rhythms Of Hope And Disappointment In The Language Of Judging (St. John's University School Of Law: Rededication Symposia), James Boyd White

Articles

I want to talk today about a certain aspect or dimension of the language of judging. From one point of view the quality I mean can be seen as a kind of idealism inherent in legal language; from another, as a kind of fundamental hypocrisy; from still another, as a simultaneously tragic and comic element in legal life.

Vegetative Filter Strip Design For Grassed Areas Treated With Animal Manures, Dwayne R. Edwards, Tommy C. Daniel, Philip A. Moore Jr. Jan 1996

Vegetative Filter Strip Design For Grassed Areas Treated With Animal Manures, Dwayne R. Edwards, Tommy C. Daniel, Philip A. Moore Jr.

Biosystems and Agricultural Engineering Faculty Publications

Vegetative filter strips (VFS) are a low-cost management option that have been demonstrated to be effective in reducing runoff transport of fertilizer constituents applied to grassed areas (pasture or meadow). Runoff quality studies involving fertilizers applied to grassed areas suggest that VFS can be designed by assuming that (1) only infiltration is responsible for pollutant removal, (2) the first post-application runoff event is most important from a water quality perspective (enabling a design event approach), and (3) no pollutant build-up that degrades VFS performance will occur. The purpose of this study was to develop a VFS design algorithm for grassed …

Simulation Of Runoff Transport Of Animal Manure Constituents, Yang Wang, Dwayne R. Edwards, Tommy C. Daniel, H. Don Scott Jan 1996

Simulation Of Runoff Transport Of Animal Manure Constituents, Yang Wang, Dwayne R. Edwards, Tommy C. Daniel, H. Don Scott

Biosystems and Agricultural Engineering Faculty Publications

Runoff losses of land-applied animal manure constituents can adversely affect the quality of downstream waters. Reliable mathematical simulation models can help estimate runoff losses of animal manure constituents and identify management measures to reduce these losses. The objective of this study was to develop and calibrate an event-based simulation model to describe the runoff transport of solids (soil and manure particles) and nutrients (nitrogen and phosphorus) from areas treated with animal manure. The resulting model, consisting of linked hydrology, soil/manure transport, and nutrient transport components, is process-oriented and uses measurable parameters to the greatest degree possible. The three components of …
