Some Effects Of 30 Years Of Weir-Management On Coastal Marsh Aquatic Vegetation And Implications To Waterfowl Management, John A. Nyman, Robert H. Chabreck Jan 1996

Some Effects Of 30 Years Of Weir-Management On Coastal Marsh Aquatic Vegetation And Implications To Waterfowl Management, John A. Nyman, Robert H. Chabreck

Faculty Publications

Aquatic vegetation was compared between weir-managed and unmanaged brackish marsh ponds at Marsh Island, Louisiana, parts of which have been weir-managed since 1958. Coverage by aquatic vegetation was greater in weir-managed ponds than in unmanaged ponds, but weir-management affected individual species differently. Eleocharis parvula was more common in unmanaged ponds than in managed ponds during the early 1960s but has not occurred in any ponds sampled since then. Ceratophyllum demersum and the dominant plants Myriophyllum spicatum and Ruppia maritima were more common in weir-managed ponds than in unmanaged ponds, although the magnitude of the difference varied greatly among sample dates. …

Humankind's Greatest Gift: On The Innateness Of Language, Tina Brown Jan 1996

Humankind's Greatest Gift: On The Innateness Of Language, Tina Brown

Nebraska Anthropologist

Although the environment has an effect on the quality of language development, the fact that language is limited to the human species, that neurological structures of the brain specialize in language functions, and that universal characteristics of language and language development occur independently of environmental factors suggests that human language has a definite biological component.

Busy Corporations: The Effects Of Corporations On The Environment And The Public, Markus Craig Jan 1996

Busy Corporations: The Effects Of Corporations On The Environment And The Public, Markus Craig

Nebraska Anthropologist

This paper is the result of one semester's research into the external costs of corporate structure, detailing some of the corporate business practices, their inherent implications, and effects on the environment and on people. This paper helps unravel the adversarial relationship between modem corporations and the environmental and labor movements in the US, concentrating on a survey of the literature of the last two decades and isolates some major themes fundamental to an understanding of this important debate.

Overgrazing: Is A Solution Available?, Brian Osborn Jan 1996

Overgrazing: Is A Solution Available?, Brian Osborn

Nebraska Anthropologist

Overgrazing is a growing problem which results in land degradation and a loss of habitat for local wildlife. This paper reviews overgrazing and reviews the degradation it causes, comparing the Sahel region in Africa to the Great Plains of the United States. Both areas have an enormous problem with overgrazing, a problem unlikely to be solved by technology. The only solution lies in a change of attitude and practice by the human population.

A Pragmatic Approach To Decision Making In The Next Era Of Oil And Gas Jurisprudence, Laura H. Burney Jan 1996

A Pragmatic Approach To Decision Making In The Next Era Of Oil And Gas Jurisprudence, Laura H. Burney

Faculty Articles

A pragmatic approach to oil and gas law is the most effective way for the judiciary to address arising issues in that area of law. As in the Great Era of the Oil and Gas Industry, new and recurring questions will continue to confront courts in this next era of oil and gas jurisprudence. Because policies have shifted and technology has evolved, it is imperative to reassess the approaches used by courts in answering these questions. In order to respond effectively to questions posed by shifting policies and new technologies in the next era of oil and gas jurisprudence, courts …

Solidarity And Suffering: Toward A Politics Of Relationality, By Douglas Sturm (Book Review), Emily A. Hartigan Jan 1996

Solidarity And Suffering: Toward A Politics Of Relationality, By Douglas Sturm (Book Review), Emily A. Hartigan

Faculty Articles

In his latest book, Douglas Sturm reveals himself as almost predictable. In Solidarity and Suffering: Toward a Politics of Relationality, here he is again in the guise of the knowledgeable scholar forever moving to include more: more spirit, more people, more difference, more tension, more justice. His movement of inclusion draws the reader always outside the framework of the conventions of discourse he last inhabited. Yet something about that movement itself has an integral, almost definable theme, a theme of relation and connection permeating the incisive distinctions his fine mind navigates for the reader.

Once again, in Solidarity and Suffering, …

1 | The Akeldama Tombs: Three Burial Caves In The Kidron Valley, Jerusalem, Gideon Avni, Zvi Greenhut

IAA Reports—Monograph Series of the Israel Antiquities Authority

The Kidron Valley was one of the main burial grounds of First Temple-period Jerusalem, and numerous tombs were also hewn here during the Second Temple period. During road works in the valley, three large, elaborate Second Temple-period tombs were exposed, which contained an abundance of rich and intact finds, some still in situ, including pottery, glass, jewelry, a sarcophagus and many ossuaries, some inscribed. The finds also provided evidence that the tombs were reused during the Roman and Byzantine periods. This volume describes the architecture, burial customs, finds and chronology, as well as an analysis of the bones from …

Democracy And Feminism , Tracy E. Higgins Jan 1996

Democracy And Feminism , Tracy E. Higgins

Faculty Scholarship

Although feminist legal theory has had an important impact on most areas of legal doctrine and theory over the last two decades, its contribution to the debate over constitutional interpretation has been comparatively small. In this Article, Professor Higgins explores reasons for the limited dialogue between mainstream constitutional theory and feminist theory concerning questions of democracy, constitutionalism, and judicial review. She argues that mainstream constitutional theory tends to take for granted the capacity of the individual to make choices, leaving the social construction of those choices largely unexamined. In contrast, feminist legal theory's emphasis on the importance of constraints on …

Toxicity Of Aspen Wood Leachate To Aquatic Life: Laboratory Studies, Barry R. Taylor, J. Stephen Goudey, N. Bruce Carmichael Jan 1996

Toxicity Of Aspen Wood Leachate To Aquatic Life: Laboratory Studies, Barry R. Taylor, J. Stephen Goudey, N. Bruce Carmichael

Aspen Bibliography

Trembling aspen (Populus tremuloides Michx.), a common hardwood tree throughout Canada, is being harvested at increasing rates for use in paper and building materials. Piles of aspen logs have been observed to produce a dark, watery, acutely toxic leachate. A laboratory study was undertaken to elucidate the nature, strength, and persistence of aspen leachate toxicity and the chemical composition of the leachate. Leaching from aspen chips in the laboratory was rapid, with 1% mass loss in the first 24 h. Another 2 weeks of immersion was necessary to remove all remaining leachable material (3% total)> Fresh aspen leachate derived …

Fictional Case Of Landmine Company And The Town Of Mudville Jan 1996

Fictional Case Of Landmine Company And The Town Of Mudville

Brigham Young University Prelaw Review

Landmine Company owns some land near a national forest amid the Rocky Mountains. The company does a lot of logging, mining and resource refinement in a factory on that land. They also mine and log on the national forest land, for the Department of the Interior (DOI) granted them special mining and logging permits. Naturally, their operations create a considerable amount of pollution and inconvenience to the general area, which includes the National Forest and, Mudville, a fairly large town bordering the forest for which the company provides several hundred jobs and a large slice of the tax base. Founded …

City Of Mudville Vs. State Department Of Environmental Quality, Andrew Christensen

Brigham Young University Prelaw Review

The City of Mud ville, having witnessed an increase in childhood cancer and other illnesses coincident with a rise in levels of toxins in the area's watershed, believes that the State Department of Environmental Quality (DEQ) has failed to fulfill its statutory mandate to "ensure a safe and healthy environment for all residents (and) maintain healthy ecosystems needed for the development of tourist activities." Specifically, the city is suing the DEQ to force it to demonstrate that the DEQ has fulfilled its mandate by either a) confirming the EPA's compliance with the Safe Drinking Water Act (SDW A), orb) exercising …

Defining Responsibility: The Citizens Of Mudville V. Epa, Jenny Rebecca Oman Jan 1996

Defining Responsibility: The Citizens Of Mudville V. Epa, Jenny Rebecca Oman

Brigham Young University Prelaw Review

A logging, mining, and resource refinement company called Landmine, which operates near national forest land by the Rocky Mountains, has created a severe water pollution problem to the surrounding area, especially for a large town called Mudville. The company does a great deal of its mining and logging inside the national forest, for which Landmine Company possesses special permits to do so from the Department of the Interior (DOI). In addition, the wells that are used in the area share a common aquifer with both the company and the national forest. The wells have increasingly become tainted with elements and …

Anita Hill Meets Godzilla: Confessions Of A Horror Movie Fan, Wendy B. Scott

Journal Articles

The cases and events discussed in this Essay involve African- American women who have confronted oppression in the civil and criminal courts, and other arenas, in both celebrated and unsung victories: victories not only for Black women, but for women and men of all hues who seek social justice. I will use these cases and events to illustrate the relationship between stereotypes and myths, born during the antebellum and Jim Crow era, and contemporary manifestations of sexual harassment and other forms of sex-based exploitation. I will go on to discuss the means used by women, in the workplace of chattel …
