Food Dispersion And Foraging Energetics: A Mechanistic Synthesis For Field Studies Of Avian Benthivores, James R. Lovvorn, Michael P. Gillingham Mar 1996

Food Dispersion And Foraging Energetics: A Mechanistic Synthesis For Field Studies Of Avian Benthivores, James R. Lovvorn, Michael P. Gillingham

Publications

Much effort has focused on modeling and measuring the energy costs of free existence and the foraging strategies of animals. However, few studies have quantitatively linked these approaches to the patch structure of foods in the field. We developed an individual—based model that relates field measurements of the dispersion of benthic foods to search costs and foraging profitability of diving ducks. On Lake Mattamuskeet, North Carolina, Canvasback ducks (Aythya valisineria) eat only the belowground winter buds of the submerged plant Vallisneria americana. We measured and modeled the patch structure of winter buds at the level of potential …

Law And Undecidability: A New Vision Of The Proceduralization Of Law, Jacques Lenoble Mar 1996

Law And Undecidability: A New Vision Of The Proceduralization Of Law, Jacques Lenoble

Cardozo Law Review

As a leading citizen of the Age of Reason, Pierre Simon Laplace liked to remark that there never could have been two Isaac Newtons for there was but a single world to be discovered. Laplace's aphorism neatly captured a fundamental assumption that has underlain the classical unity of science and reason under modernity. Today, in the wake of challenges posed by intellectual developments such as unstable systems and chaotic structures, the classical presupposition of a stable, objective, and physical world that serves as the horizon of scientific knowledge has begun to teeter. New cracks in the grand edifice of modem …

Short-Circuit: A Critique Of Habermas’S Understanding Of Law, Politics, And Economic Life, William E. Forbath

Developing A Coherent Theory Of The Structure Of Federal Rule Of Evidence 703, Edward J. Imwinkelried

Mercer Law Review

Some commentators have suggested that the American judicial hearing is becoming trial by expert. As recently as 1974, the Jury Verdict Reporter for Cook County, Illinois, listed only 188 regularly testifying experts? Today, there are more than 3,100-a 1,540 percent increase. In the late 1980s, the Cook County state courts averaged one expert per trial. In some areas, the trend is even more pronounced. In the early 1990s, the Rand Corporation released a study of the use of experts in trials in California courts of general jurisdiction. Expert witnesses appeared in eighty-six percent of the trials studied, an average of …

Isn't It A Crime: Feminist Perspectives On Spousal Immunity And Spousal Violence, Malinda L. Seymore Mar 1996

Isn't It A Crime: Feminist Perspectives On Spousal Immunity And Spousal Violence, Malinda L. Seymore

Faculty Scholarship

Much has been written about the reluctance of police to arrest in domestic violence cases and the reluctance of the state to prosecute such cases. Part of that reluctance may be caused by prevalent societal attitudes that diminish the importance of spousal violence. In a number of jurisdictions, the reluctance to pursue criminal sanctions against married abusers is caused by the difficulty of procuring the battered spouses' testimony.5 In those jurisdictions, the prosecutor cannot compel a reluctant spouse's testimony because of the spousal privilege not to testify against a defendant spouse. Even in jurisdictions that have some exceptions to the …
