An Interpretive Theory Of International Law: The Distinction Between Treaty And Customary Law, Hiram E. Chodosh

Vanderbilt Journal of Transnational Law

The author begins with an explanation of the importance of the distinction between treaty and customary law. The author then presents six alternative principles currently used to inform that distinction (dichotomy, overlap, relativity, interdependence, equivalence, and indeterminacy) and evaluates the application of these principles according to their theoretical coherence, practicability, reconcilability, and resolving power. The author concludes that each of the alternative principles is unsatisfactory in at least one respect and proposes a superior interpretive approach that does not define customary law in terms of treaty, but rather according to its own independently defining attributes. This document is a cultural anthropological overview and assessment of the Niobrara/Missouri National Scenic Riverways (NIMI). It represents the first formal planning step taken by the National Park service (NPS) to identify the different ethnic and religious groups of people that have historical and/or contemporary ties to the NIMI region. It primarily focuses on American Indian groups that used the NIMI region for various purposes in past historical times. The discussion of American Indian peoples emphasizes the three Federally-recognized tribes that reside in the NIMI region today, the Poncas, Santee Sioux, and Yankton sioux. Cluster Analysis Of The Coprolites From Antelope House: Implications For Anasazi Diet And Cuisine, Mark Q. Sutton, Karl Reinhard

This paper reports on a cluster analysis of 155 coprolites from Antelope House, a prehistoric Anasazi site in Canyon de Chelly, Arizona. The analysis revealed three primary clusters; whole kernel maize, milled maize, and nonmaize, which we believe to represent seasonal- and preference-related cuisine. Protein residue analysis on a subsample of the specimens added depth to the analysis.

Foucault's "power-knowledge" is a controversial concept. Brought into English-speaking theoretical circles less than two decades ago, its meaning and range of applicability are still in dispute. While no one denies that some fields of social scientific knowledge (such as criminology) intersect institutionally with mechanisms of power, these intersections do not seem, to many, to constitute any essential relation of "mutual reinforcement" between knowledge and power. If, in rare cases, politics and scientific research are admitted to be mutually constitutive, the results of their mingling are typically dismissed as propaganda or pseudo-science. The American Indian Religious Freedom Act has proven to be a terrible disappointment for the Indians all across the country. This act presupposed an analogy between Native American ceremonial practices and Euro-American religions, but Native American ceremonies involve a broader range social institutions than Euro-American "religion." Hence, the analogy between Indian ceremonies and Euro-American religions broke down after passage of the act, and Indians failed to receive the legal remedies sought under its provisions. Three sets of material and ideological data from East Baltic Neolithic pre-Corded Ware culture sites c. 6500-3500 B.P. are compiled and compared in order to reasonably interpret certain aspects of these prehistoric people's ideology, specifically as it relates to their faunal environment and gender-based patterns in their social system. Approaches taken consist of (1) statistical analyses of a symbolic data base comprised of anthropomorphic and zoomorphic art data, and grave good inventories as they relate to gender, (2) a comparison of frequencies of faunal types represented in economy and zoomorphic symbols, and (3) a cross-cultural comparison of contexts of the …

Vegetal remains from radiocarbon-dated ancient packrat middens were used to develop an early and middle Holocene paleoclimate sequence from the Mojave Desert. Identified species from both modern and ancient middens were tabulated by elevation range based on modern analogs to estimate the modern equivalent of the elevations of ancient middens. Differences of these reconstructed vegetation elevations relative to modern elevations of vegetation are ordered chronologically, after correction for modern midden data, creating a paleoclimate reconstruction. The reliably-dated history of human occupation at four sites on Fort Irwin in the Mojave desert are compared with the paleoclimate reconstruction for an evaluation …

Each interaction between teachers and students is a reflection of the theory that these professionals, sometimes unknowingly, posit about what should be occurring in their classrooms. The purpose of this study is to explore the differences between middle school language arts teachers' beliefs about how children actually read a text, and how these teachers translate these beliefs into classroom practices. The beliefs we hold about reading comprehension are essential to our understanding about how we should instruct and assess our students in our classes. A significant change in China since late 1978 is the development of rural industry (also township-village enterprise, or TVE). Rural industry is particularly important in light of China's current policy of socio-economic decentralization. Rural industry not only absorbs surplus labor and pushes the increases of agricultural productivity, it also revitalizes China's previously lethargic economy. There is a need to eliminate the least accurate of the existing equations for anthropometrical body density prediction and support for the use of specific prediction equations over generalized equations. The purpose of the investigation was to examine the accuracy of the Jackson-Pollock (JP) and Durnin-Womersley (DW) generalized anthropometrical body density prediction equations in relation to indices of overall fatness, regional fat distribution and body proportionality. Trends in winter extratropical anticyclonic weather type frequencies (1961-1989) were examined for New Orleans, Louisiana, in order to identify the effects of global climatic change on regional-scale circulation changes over the central Gulf Coast. The number of days dominated by surface continental anticyclones (CH days) was found to have decreased significantly over time, while Pacific anticyclone (PH) frequency showed significant temporal increase. Therefore, 50 kPa geopotential height variability, 50 kPa geostrophic flow, and surface atmospheric variables were examined to determine whether changes in these features have accompanied the frequency changes in weather types. Performing The Community, Telling The Self: Storytelling By Members Of A Group Home For Men With Mental Retardation., Sharon Elizabeth Croft

This study uses an ethnographic approach to examine the stories told by members of a group home for men with mental retardation. The author contends that the culture of the group home works to constrain how group home members interact within this community. The author argues, however, that despite the cultural constraints, the men use storytelling to establish their individuality, even though the stories themselves, in their content and in the performance of their telling, often reify cultural constraints and their cultural constructions. Building upon the scholarly tradition that performance is a valuable pedagogical tool, I documented how six performers developed personal awareness, critical consciousness, and the ability to take action as a result of participating in a performance process. I designed a three-stage performance process. During the first phase of the process, focus group discussions, participants exhibited little awareness of their specific eating habits or the cultural constructedness of those habits. As they completed the first phase, they became more aware of their behaviors, and they began to identify food's social function. At the second stage, rehearsal sessions, six performers began to …

The purpose of this study was to derive a deeper understanding of one successful kindergarten teacher, her behaviors, and her effect on students as they develop early literacy skills.
