The Paradox Of Punishment, Paul Campos

Publications

Retribution demands reciprocity. In this Essay, Professor Campos contends that classic retributive theory encounters a logical paradox when it attempts to equalize the status of criminal and victim through the institution of punishment. This paradox arises out of a clash between the deontological requirements of equality and justice. He concludes by speculating on the historical relationship between rationalist justifications for vengeance and the elimination of punishment as public spectacle.

Les statistiques de la CSST démontrent que près de 30 % des lésions impliquant un arrêt de travail ont comme siège les membres supérieurs et plus particulièrement les mains. Ces lésions sont causées principalement par la manipulation des pièces métalliques et des outils. L'utilisation des gants de protection résistant à la coupure et à la perforation peuvent diminuer le nombre et la gravité de ces lésions.

La manipulation de produits chimiques peut entraîner des contacts dont il faut se protéger. Le contact direct d'un produit chimique (ou un mélange de produits) avec la peau peut provoquer des effets variés tels que brûlures, irritations, dermatoses ou intoxications. Le produit peut également pénétrer à travers la peau sans effet apparent, et être transporté par le sang aux divers organes. Pour protéger la peau d'un éventuel contact avec des produits chimiques, l'utilisation des vêtements de protection est souvent nécessaire.

Cette étude porte sur la méthode de collecte selon laquelle un seul répondant fournit des informations sur la santé des personnes avec lesquelles il forme ménage. Elle montre l'existence d'une morbidité plus importante pour les personnes interviewées directement, qui se révèlent systématiquement plus malades que les personnes au nom de qui elles répondent, indépendamment de leur sexe, de leur statut d'activité ou de leur catégorie professionnelle.

Compte tenu de la très forte participation des femmes aux interviews dans les enquêtes auprès des ménages, la surmorbidité des femmes, observée dans plusieurs enquêtes de santé, pourrait s'expliquer partiellement par cet effet.

Collecter les déchets c'est travailler sur une machine dangereuse qui se déplace au milieu de la circulation, par tous les temps. Par ailleurs, l'efficacité des opérations repose sur des facteurs de vitesse et de rythme. America's founding fathers drew up the U.S. Constitution to ensure fundamental rights for American citizens. The First Amendment asserts one of these basic rights: freedom of speech and expression. Under the First Amendment of the Constitution such rights as the freedom of speech and assembly and other basic rights are set forth. People often feel that unpopular groups such as flag-burners or skinheads should have their First Amendment rights limited. Often individuals find it hard to tolerate the radical opinions of these groups. Nevertheless, their rights can only be restricted if, in the course of their actions, they directly infringe upon the rights of others. This point can be better illustrated by discussing a hypothetical situation in which a group's rights would have to be limited.

A study examined the linguistic forms in the discourse of speakers during a language test to indicate why they use certain specific forms over others. Ten children were given the Grammatical Analysis of Elicited Language--Simple Sentence Level Test (GAEL), a language proficiency test for hearing-impaired children in the age group of 4 to 8 years. Three students were videotaped during administration of the test, and the other students' final responses (omitting the intermediate discourse) were recorded. A study investigated whether imitation plays a significant role in the acquisition of grammar. Three 6- to 8-year-old hearing-impaired children were administered the Grammatical Analysis of Elicited Language--Simple Sentence Level Test (GAEL), which is designed to evaluate hearing-impaired children's use of grammatical aspects of spoken and/or signed English. Subjects' verbal responses to the "imitated" component (in which subjects were asked to say just what the tester said) of the GAEL were transcribed and analyzed. Results indicated that imitated speech is neither longer nor grammatically more advanced than non-imitated, spontaneous speech. Findings suggest that the children produced "unique" language structures to …

The analysis of the stock market developed in this Article agrees with the view that trading in the stock market by public investors is a zero sum game in which no one investor gains without a corresponding loss to another. It also agrees that in this zero sum game, an inside trader "plays with percentage dice." Since the prohibition against insider trading can only limit and not eliminate insider trading, the obvious question is "why would investors consent to play in a crooked game?" Biased evidence rules, those that permit one party to use a kind or class of evidence while prohibiting the other from using it, give adversaries unequal weapons. Truth seems less likely to emerge from an adversarial testing when participants do not have the same devices to demonstrate strengths and weaknesses in the competing claims. Since a good evidence law should aid the determination of truth, neutral evidence rules should be required. In reality, however, all evidence principles are not impartial between the parties. Recently, in Grundberg v. Upjohn Co.1 the Utah Supreme Court adopted a broad formulation of comment k to section 402A of the Restatement (Second) of Torts ("comment k").2 In so doing, the court placed Utah in the small group of jurisdictions providing immunity from strict liability design defect claims to all prescription drugs approved by the Food and Drug Administration. By precluding a cause of action in strict liability for injuries arising from dangerously designed drugs, the Grundberg decision unduly restricts the scope of strict products liability claims. In 1985, Utah revised its constitution to grant the Utah Supreme Court power to make rules of procedure and evidence for the courts of the State. The new article eight, section four of the Utah Constitution ("Section Four") provides in part: "The Supreme Court shall adopt rules of procedure and evidence to be used in the courts of the state and shall by rule manage the appellate process" Prior to 1985 and the adoption of Section Four, the legislature possessed authority to adopt rules of procedure and evidence, but delegated that aiithority to the supreme court.
