The Jurisprudence Of Non-Proliferation: Taking International Law Seriously, David A. Koplow Jan 1992

The Jurisprudence Of Non-Proliferation: Taking International Law Seriously, David A. Koplow

Georgetown Law Faculty Publications and Other Works

This essay is about the power of the international law of nonproliferation- its mounting power in the world today and its properly augmented power in an enlightened future. The article focuses on three primary areas in which international law may play a greater role than is commonly appreciated in affecting the behavior of potential proliferators, their suppliers, and their resolute opponents. The three topics-areas in which the essay pleads for law to be taken even more seriously, and by a wider audience of governments and the international public-are: (a) treaties (especially the provisions of those treaties that commit the parties …

Problems With The International Definition Of A Refugee And A Possible Solution, Toby D.J. Mendel Jan 1992

Problems With The International Definition Of A Refugee And A Possible Solution, Toby D.J. Mendel

Dalhousie Journal of Legal Studies

The Convention Relating to the Status of Refugees' definition of a refugee is no longer viable. It was originally designed to deal with the limited refugee situation that existed forty years ago. Both the passage of time and the internationalization of refugee problems have weakened the effect of the definition to the point where a majority of de facto refugees do not even come within its ambit. Many of those who should be covered by the definition are not afforded protection under the national schemes designed in accordance with the Convention's provisions. The UNHCR tries to deal with refugee situations …

Anatomy Of A Trade Dispute: The Question Of Softwood Lumber, Peter Piliounis Jan 1992

Anatomy Of A Trade Dispute: The Question Of Softwood Lumber, Peter Piliounis

Dalhousie Journal of Legal Studies

It has been called "the longest and messiest trade war Canada and the United States have ever had." Without a doubt, the issue of softwood lumber pricing has long been a major irritant in Canada-United States trade relations. On three separate occasions, the United States has launched a countervailing duty investigation into Canadian timber pricing practices. Softwood lumber plays a key role in the economies of several Canadian provinces and American states. The stakes are not only high for softwood lumber products, but any decision made on softwood lumber could also have an enormous impact on other forest products and …

When Is A Corporate Executive "Substantially Unfit To Serve"?, Jayne W. Barnard Jan 1992

When Is A Corporate Executive "Substantially Unfit To Serve"?, Jayne W. Barnard

Faculty Publications

The recently enacted Securities Enforcement Remedies and Penny Stock Reform Act of 1990 provides that, in an SEC enforcement action, a federal court may enjoin or "disbar" the defendant from serving in the future as an officer or director of a public company. A court may enter such an order if it finds that the defendant is "substantially unfit" to serve as a corporate executive; the Act, however, does not define "substantial unfitness." In this Article Professor Jayne Barnard provides a framework for defining this term and identifying the defendants to which the Remedies Act should apply. Professor Barnard begins …

"With Holy Importunitie, With A Pious Impudencie": John Donne's Attempts To Provoke Election, Raymond-Jean Frontain

Quidditas

Donne's use of the imperative when addressing God in the Divine Poems is a maneuver designed to resolve a particularly Protestant dilemma, the same dilemma confronted by the speaker of Elegy 19 under another guise. As C. L. barber and Richard P. Wheeler have pointed out, the reformers' dismantling of "much of the Catholic apparatus of worship in order to isolate the individual worshiper in direct rapport with God through faith...put worshippers at risk in new ways. In areas where the Reformation triumphed, extraordinary anxiety could be generated by the absolute importance conferred upon the individual's faith in the grace …

The Mystic As Pilgrim: Margery Kempe And The Tradition Of Nonfictional Travel Narrative, James P. Helfers Jan 1992

The Mystic As Pilgrim: Margery Kempe And The Tradition Of Nonfictional Travel Narrative, James P. Helfers

Quidditas

Margery Kempe, fifteenth-century pilgrim and female mystic, stirred up controversy in her own day and continues to do so in the present. This controversy, then and now, centers on both Margery's spiritual life and its social expression. While she was alive, her contemporaries disagreed over the validity of her mystical experience and the way that experience manifested itself; now this conflict continues in contemporary critical debates over the nature of her literary and spiritual significance. The Book of Margery Kempe has heretofore been analyzed as autobiography, mystical treatise, devotional manual, and feminist tract. Clarissa Atkinson, for instance, sees the book …

The Artist As Entrepreneur: Long-Term Professional Bonds In Quattrocento Florence, Yael Even Jan 1992

The Artist As Entrepreneur: Long-Term Professional Bonds In Quattrocento Florence, Yael Even

Quidditas

A number of comparatively recent publications on collaboration in Quattrocento art attest to the renewed interest in reassessing the nature of professional exchange among artist. These studies continue to shed more light on the prevalence and extent of collaborative artistic undertakings in Florence during this period. Originating in archival research, the studies reject the romanticized, traditional view of Early Renaissance painters, sculptors, and architects as solitary geniuses, suggesting instead that these creative talents operated as entrepreneurs who collaborated to establish profitable careers.

Moral Lessons For Women Readers Of Jean Lemaire De Belges's Les Illustrations De Gaule Et Singularitez De Troye, Judy Kem

Quidditas

Jean Lemaire de Belges (1473-1525), poet and historiographer of the French and Burgundian courts of the early Renaissance, wrote his epic history of Troy, Les Illustrations de Gaule et singularitez de Troye (1511-1513), at the request of his patron, Margaret of Austria, to offer an "occupation voluptueuse, et non pas inutile" [sensual yet useful occupation] to the ladies of France (1:11). Lemaire dedicated each of the three books of his epic to a different noblewoman. Mercury, who narrates the prologues of all three volumes, identifies each noblewoman with one of the three goddesses of the Judgment of Paris: Margaret of …
