ln his Michigan Law Review article, "The Failed Discourse of State Constitutionalism," Professor James A. Gardner examines the responses to Justice Brennan's invitation to state high courts "to seize control of the protection of constitutional rights by looking to state constitutions as potentially more generous guarantors of individual rights than the U.S. Constitution." He finds the responses in the "voluminous body of commentary" by "distinguished state jurists" and "prolific academics" to be "extraordinarily optimistic about the prospects for state constitutional law . . . not only to meet Justice Brennan's challenge, but to fulfill the promise of a genuinely federal …

The discovery and understanding of the photoelectric effect led to the study of photoemissive materials fall into two major categories: classical photoemitters and negative-electron-affinity (NEA) materials. Classical photoemitters usually involve an alkali metal, a group-V element such as phosphorus, silver, and/or oxygen. An example is the Ag-O-Cs (S1) photoemitter. NEA photocathodes consist of a photoconductive single crystal semiconductor covered with a thin layer of cesium and oxygen. This layer lowers the work function of the photocathode. A dipole layer is formed at the surface, and band bending occurs. This lowers the effective work function. An example is the GaAs(CsO) photocathode …

Professor Baker gives his prescription for the Long-Range Planning Committee of the Judicial Conference. First, he considers the "mission" of the federal courts, explaining that there should be no single, objectively correct conception of the role of the federal courts. Second, he discusses his conception of long-range planning, in terms of a relatively short event horizon and the absolutely wide-open scope of the range of proposals that are relevant to the work of the Committee. Legal theory has traditionally taken the use of sanctions to be a characteristic feature of any legal order. Positivists like John Austin take the notion of commands backed by threats to be the essence of law. Yet even those who scorn positivism, like Immanuel Kant, are equally committed to the view that the sovereign must enforce positive legal rules by punishing those who violate them.

This emphasis on sanctions has always struck me as a bit curious. It is not irrelevant to the understanding of legal phenomena, but it does seem to have been exaggerated in philosophical efforts to understand …

Of all the dreams that drive men and women into the streets, the "rule of law" is the most curious. We have a pretty good idea of what we mean by "free markets" and "democratic elections." But legality and the "rule of law" are ideals that are opaque even to legal philosophers. Codependency is defined in this study as a disease characterized by individual adult inability to function in everyday life, in particular regards to personal relationships with others, in a healthy and self-loving manner. The study points to the works of several prominent theorists and practitioners in this field, such as John Bradshaw, Sharon Wegscheider-Cruse, Anne Wilson Schaef, and John and Linda Friel, as authoritative resource material on the subject. The dissertation research examined four research questions. First, the question of whether or not imagery processing could be measured was addressed. It was assumed that mental imagery does exist and can be measured in three dimensions: quality, quantity, and elaboration. Support for this assumption is provided by the psychometric properties of the scale developed to measure imagery processing in concert with the support toward nomological validity of the construct that was provided by applying the scale in an experiment. Bovine herpesvirus-1 (BHV-1) is the pathogenic agent for infectious bovine rhinotracheitis. Current vaccines to protect against infection have serious disadvantages to producers and have been implicated in epizootic outbreaks. The virus has also been shown to cause suppression of the immune system. BHV-1 vaccines could be improved by identifying and genetically deleting those aspects of the virus responsible for immunosuppression and providing a marker within the genome which would distinguish the vaccine strain from wild types in the case of disease outbreaks. Theoretical sampling was used to select 30 high school biology and college zoology students who examined a simulation involving island biogeography. The literature base for the study was scientific reasoning, problem solving, and prescientific conceptions. The research questions were answered using qualitative and quantitative methods. The first research question was: What number and what type of variables would be used to evaluate biological data? The students used 19 categories of variables, and the most frequently used were size, distance, and food. Parenchyma cell death (PCD) in stalk internodes of maize (Zea mays L.) is related to stalk rot. Spread of stalk rotting fungi is restricted by living parenchyma cells. A previously reported correlation coefficient of 0.70 between leaf midrib cell death (LMCD) and PCD indicated that selection for LMCD might result in low PCD, thus improving stalk quality. Inheritance of PCD and LMCD in maize possessing the leafy (Lfy) gene needs to be investigated. Wave driven pressure variations in reef porewater were used to investigate the physical processes that affect early marine carbonate cementation in a bank-barrier reef. Cores taken along a transect, and porewater geochemistry sampled from wells were used to characterize sedimentary and geochemical environments. The cores show an Acropora palmata framework with a patchily cemented sandy matrix composes the forereef and reef crest, with dominantly loose sediments in the backreef. Hydraulic conductivities are approximately 1 $\times$ 10$\sp{-4}$ m/s. The wave climate is moderate, with up to 75 % wave height attenuation across the reef crest. Hydrology is the primary forcing function in wetlands. Therefore, alterations to hydrology, which can result from either natural or anthropogenic causes, can have dramatic effects on wetland structure and function. Structural marsh management, one type of anthropogenic alteration, employs levees and water control structures to reduce or reverse wetland loss and enhance the productivity of natural renewable resources. The purpose of this study was to investigate the concepts prevalent among students in specific physical science related classes and to identify what classroom teachers would do when confronted with this knowledge. A 40 item instrument, Misconception Identification in Science Questionnaire (MISQ), was developed to identify certain concepts in the areas of force, heat, light, and electricity and administered to 509 students. Interviews were conducted with a stratified sampling of 27 students to validate the instrument. The udoteacean alga Eugonophyllum is well-preserved in the Virgilian Holder Formation, Sacramento Mountains. Original aragonite occurs as a felt-like mesh of needles in algal thalli, mollusc fragments, sponge walls, botryoidal, and isopachous marine cements. In the basal, heavily calcified portion of Eugonophyllum the interior of the thallus is composed of aragonitic felt punctuated by 20 $\mu$m diameter, parallel siphons. In the distal, less calcified portion of the thallus, irregularly arranged siphons are larger. This study substantiates suggested similarities between Pennsylvanian/Permian phylloid algal mounds and Holocene Halimeda mounds. The Permian dasyclad Mizzia is important for paleoecological study in the Guadalupe Mountains, …
