Metaphor And Metonym As Legend In Experience: Magic Does Make Our World Work, Megan Rachael Elliott Jan 1992

Metaphor And Metonym As Legend In Experience: Magic Does Make Our World Work, Megan Rachael Elliott

Honors Capstones

When Sir James Frazer unraveled the intricacies of magic in the early twentieth century/ he defined the sympathetic processes of contagion and homeopathy in magical acts. Almost contemporaneously, Lucien Levy-Bruhl analyzed native thinking in primitive cultures and discovered differences of associative and logical thought. Logical and associative thought processes/ originally thought to be culture dependent and exclusive, are now known to co-exist worldwide. The sympathetic processes of Frazer's magical acts further show themselves to be analogous to associative thinking through metaphoric and metonymic cognition that allows us to negotiate our everyday life. From these associative processes, we also extrapolate an …

A Seven Year Reaction To The Single Audit Act Of 1984, Douglas M. Haywood Jan 1992

A Seven Year Reaction To The Single Audit Act Of 1984, Douglas M. Haywood

Honors Capstones

The Single Audit Act of 1984 attempted to provide a sense of uniformity amongst governmental audits. It provided strict regulations and procedures the auditor must follow when conducting the audit. Having only one audit provides efficient use of resources, rather than having many audits instituted by each relevant federal agency. The auditors must follow generally accepted governmental auditing standards when performing the audit. Controls and compliance with proper regulations have to be examined to ensure they are being utilized effectively. Reactions from all of the relevant parties have been positive and supportive, so the Single Audit Act should be around …

What Can You Say, Where Can You Say It, And To Whom?: A Guide To Understanding And Preventing Unlawful Sexual Harassment, David Allen Larson Jan 1992

What Can You Say, Where Can You Say It, And To Whom?: A Guide To Understanding And Preventing Unlawful Sexual Harassment, David Allen Larson

Faculty Scholarship

After an increase in visibility for sexual harassment cases in 1991, employers have had to treat allegations of sexual misconduct more seriously now that juries have the authority to award both compensatory and punitive damages. Many employers and employees remain confused, however, as to what conduct is considered unlawful sexual harassment. This article explains how courts have analyzed allegations of unlawful sexual harassment under Title VII of the Civil Rights Act of 1964 by discussing what a court must find before it will impose liability. In response to the very real and immediate demand for a straightforward discussion of the …

Evaluating The Effectiveness Of Group Leader Trade Shows, James L. Watson Jan 1992

Evaluating The Effectiveness Of Group Leader Trade Shows, James L. Watson

Theses

The purpose of this study was to develop a system for evaluating the costs and benefits of exhibiting in a group leader trade show, while additionally determining the return on investment for the host destination. The population was defined as the 39 tour operators from North America, and the 13 6 exhibitors from New York State, who were in attendance at Travel Expo '90 held in Sullivan County, New York. An initial survey was distributed to all the attending tour operators and exhibitors from New York State. A follow-up evaluation was distributed to all tour operators and exhibitors who returned …

Context Sensitive Optical Character Recognition Using Neural Networks And Hidden Markov Models, Steven C. Elliott Jan 1992

Context Sensitive Optical Character Recognition Using Neural Networks And Hidden Markov Models, Steven C. Elliott

Theses

This thesis investigates a method for using contextual information in text recognition. This is based on the premise that, while reading, humans recognize words with missing or garbled characters by examining the surrounding characters and then selecting the appropriate character. The correct character is chosen based on an inherent knowledge of the language and spelling techniques. We can then model this statistically. The approach taken by this Thesis is to combine feature extraction techniques, Neural Networks and Hidden Markov Modeling. This method of character recognition involves a three step process: pixel image preprocessing, neural network classification and context interpretation. Pixel …

On Integrated Pollution Control, James E. Krier Jan 1992

On Integrated Pollution Control, James E. Krier

Articles

Integrated pollution control, or IPC, can be defined for now as an approach to environmental regulation that "seeks particularly to link air, water, and waste programs. Its concern is institutional changes that reduce total risk to the environment from pollutants." 8 This sounds remarkably appealing, which perhaps explains IPC's recurring popularity. As we shall see, it enjoyed a brief celebrity about twenty years ago, and it is once again in vogue-especially within the U.S. Environmental Protection Agency (EPA).

Is the Agency's recent interest in IPC a good thing? We worry that it is not. First of all, IPC has an …

Legal Lore: Sin, Scandal, And Substantive Due Process, Wendy Collins Perdue

For students of civil procedure, the names Pennoyer and Neff evoke these dry facts: In an initial suit, one J.H. Mitchell sued Neff in Oregon state court. Because Neff could not be found within Oregon, he was served by pub- lication. Neff never appeared, and a default judgment was entered against him. To satisfy the judgment, Mitchell attached Neff's Oregon real estate. The property was sold at auction, and Pennoyer later acquired it. Nearly a decade later, Neff returned to Oregon and brought suit in federal court to evict Pennoyer from the land, claiming that the original judgment was invalid. …

Infinite Strands, Infinitesimally Thin: Storytelling, Bayesianism, Hearsay And Other Evidence, Richard D. Friedman Jan 1992

Infinite Strands, Infinitesimally Thin: Storytelling, Bayesianism, Hearsay And Other Evidence, Richard D. Friedman

Articles

David Schum has long been one of our keenest commentators on questions of inference and proof. He has been particularly interested in, and illuminating on, the subject of "cascaded," or multi-step, inference.' This is a subject of importance to lawyers, because most evidence at trial can be analyzed in terms of cascaded inference. Usually, the proposition that the fact finder2 might immediately infer from the evidence is not itself an element of a crime, claim, or defense. Most often, an extra inference would be required to jump from that proposition to a proposition that the law deems material. Thus, inference …

Reforming The Law Of Gratuitous Transfers: The New Uniform Probate Code, John H. Langbein, Lawrence W. Waggoner Jan 1992

Reforming The Law Of Gratuitous Transfers: The New Uniform Probate Code, John H. Langbein, Lawrence W. Waggoner

Articles

In the mid-1980s the Uniform Law Commission undertook a landmark revision of the American law of gratuitous transfers. These reforms culminated in a drastically revised Uniform Probate Code ("UPC"). The revisions inspired the Albany Law Review to organize this symposium issue for the purpose of examining the 1990 UPC. In this introductory paper, we point to the main themes of the reform movement, discuss some of the traits and constraints of the uniform law process, and comment on some of the suggestions and insights that appear in the symposium articles.

Tax Policy And Panda Bears, Douglas A. Kahn, Jeffrey S. Lehman Jan 1992

Tax Policy And Panda Bears, Douglas A. Kahn, Jeffrey S. Lehman

Articles

In this article. Professors Kahn and Lehman argue that the concept of tax expenditure is flawed as a tool for measuring the propriety of tax provisions. It assumes the existence of on true and correct standard of federal income taxation that applies to all circumstances. To make that a assumption, the proponents of the concept implicitly make a particular moral claim about the relative importance of a wide range of values, including efficiency, consumption/savings neutrality, privacy, distributional equity, administrabiliy, charity, and pragmatism. They then measure a tax provision's "normalcy" exclusively by how it conforms to their Platonic concept of income. …
