Brian, a first grader, glanced up and muttered, "don't know what to write about yet. "His teacher just smiled. Before anything else was said, his face lit up, and his pencil started moving as he wrote "A book. "Then he stopped and read over what he had written, whispering the words "a book. "Next he started laboriously working on writing the sounds and letters he heard in the word" about, ''coming back again and again to portions of the word to vocalize the next sound and write down his representation of what he had said. The Development Of Sense Of Humor As A Characteristic Of Giftedness In Young Children, Jill M. Uhlenberg Jan 1990

The Development Of Sense Of Humor As A Characteristic Of Giftedness In Young Children, Jill M. Uhlenberg

Graduate Research Papers

The definition of "humor" and "sense of humor" has changed drastically since the Roman Empire. At some points in history, having a sense of humor was a positive aspect of life, and at other times, humor was considered unnecessary and undesirable. The word "humor" comes from a Latin word, "humor" which means "moisture." The term referred to the fluids of the body: blood, phlegm, choler (yellow bile), and melancholy (black bile) (Cornett, 1986; Weaver & Cotrell, 1987). Variant mixtures of these fluids (humours) was said to determine an individual's temperament. If the proper balance was evident, a person was in …

Developing A Literature-Based Theme Study To Extend The Whole Language Concept, Sue L. Pettit Jan 1990

Developing A Literature-Based Theme Study To Extend The Whole Language Concept, Sue L. Pettit

Graduate Research Papers

Language is a process through which humans create meaning. Language as a process begins with a function and then develops as the user experiments with the language form necessary to meet the needs of that function. Students use language and learn its functions at the same time (F. Smith, 1983). As a result, children learn language naturally as they interact with others in their environment (Goodman, 1986).

Positive Effects Of Humor: No Laughing Matter In The Education Of Students, Edward C. Poynar Jan 1990

Positive Effects Of Humor: No Laughing Matter In The Education Of Students, Edward C. Poynar

Graduate Research Papers

Frequent] y, responses from student surveys identify "has a sense of humor" among the characteristics of a good teacher. Unfortunately, this is not a quality that is emphasized in teacher education programs so apparently it is not deemed worthy of consideration by teacher educators. Yet, the thought of humor in the classroom does have a certain appeal and possibly raises a few questions. What purpose can a teacher's sense of humor serve for a student? Does educational research indicate any cause and effect relationship between humor and cognitive development? How does humor affect the thinking processes? If the theory of …

Population Characteristics And The Effects Of Hunting On Blackbears In A Portion Of Northwestern Montana, Timothy Joseph Thier

Graduate Student Theses, Dissertations, & Professional Papers

Prior information regarding the status of black bears (Ursus americanus) in Hunting District 100 in extreme northwestern Montana was confusing and oftentimes conflicting. To gather information on the population and the effects of hunting, especially during the spring hunting season, 13 black bears were radio-collared and monitored during 1986 and 1987. An additional 15 bears were marked and released. Information was gathered on the age and sex structure of the capture sample, survival and mortality rates of marked bears, reproduction, home range sizes, and hunter technique and effort. A density estimate of 1 black bear/15.4 km2 for the study area …

Respecting State Judicial Articles, Jeffrey A. Parness Jan 1990

Respecting State Judicial Articles, Jeffrey A. Parness

Faculty Articles, Papers, and Other Scholarship

Differences in the establishment and empowerment of American judicial systems should trigger variations in the ways in which cases are handled and law is practiced. Such differences are found in the sections of state constitutions dealing with the judiciary and known as judicial articles. Unfortunately, those differences are often overlooked. Perhaps the oversight is partially attributable to the widely held view that any variations in the constitutional foundations of judicial systems are meaningless, in that no practical consequences flow from them. In effect this view parallels the popular notion that all seemingly comparable branches of state governments actually have comparable …

Jurisdiction Over Telecommunications: Alberta Government Telephones V. Crtc, Peter W. Hogg Jan 1990

Jurisdiction Over Telecommunications: Alberta Government Telephones V. Crtc, Peter W. Hogg

Articles & Book Chapters

In Alberta Government Telephones v. Canadian Radio-television and Telecommunications Commission, the Supreme Court of Canada held that AGT was a federal undertaking, but that as an agent of the provincial Crown, it was not bound by regulations of the CRTC, made under the authority of the federal Railway Act. AGT is therefore presently unregulated. The author proposes that AGT was characterized as a federal undertaking on the basis of its membership within Telecom Canada and its border connections with neighbouring telephone companies, which allow it to provide interprovincial and international service. The AGT decision leaves open, however, the issue of …

Book Review: "Dancing In The Dark": A Review Of Gwen Brodsky And Shelagh Day's Canadian Charter Equality Rights For Women: One Step Forward Or Two Steps Back?, Brenda Cossman

Articles & Book Chapters

The following article argues that while Brodsky and Day's study of the first three years of equality litigation under the Charter of Rights and Freedoms is an important contribution in revealing the extent to which equality rights have been used by men rather than women and other disadvantaged groups, it fails to adequately interrogate the role of rights discourse in feminist struggles for social change. After reviewing the debates regarding rights discourse, the article argues that feminist litigation strategies must be informed by a more complicated understanding of the role of rights, and must be made accountable to the broader …

What Do We Mean By Law And Social Transformation?, Judy Fudge Jan 1990

What Do We Mean By Law And Social Transformation?, Judy Fudge

Articles & Book Chapters

In Canada the entrenchment of the Charter of Rights and Freedoms generated a good deal of debate about the possibility of using law in the struggle for social transformation. Although couched in general terms, the current debate is ultimately about the possibility of asserting liberal democratic legal rights in courts in order to transform existing relations of subordination and domination. Somewhat remarkably, the positive claim that litigating entrenched legal rights encourages social transformation tends to be made almost exclusively at the theoretical level. Theoretical possibilities, rather than concrete victories, are invoked to support the claim for the transformative capacity of …

Of Persons And Property: The Politics Of Legal Taxonomy, David Cohen, Allan C. Hutchinson Jan 1990

Of Persons And Property: The Politics Of Legal Taxonomy, David Cohen, Allan C. Hutchinson

Articles & Book Chapters

To talk of law without politics or history is nonsensical. All lawyers must concede that what they do takes place in historical circumstances and has political consequences. Every piece of law-making and law-application is a governmental act, it relies on political authority and claims binding force. Moreover, all legal activity occurs within a particular historical context, it is intended to respond to or influence a past, existing or anticipated state of affairs. This means that the study of law must concern itself with politics and history generally: it must not confine itself to only the politics and history of law. …

Conflict Of Laws - Foreign Tort - Not Justifiable By The Lex Loci Delicti - Residence Of Defendant - Interprovincial Comity - Judicial Creativity, Jean-Gabriel Castel

Articles & Book Chapters

The conflict of laws rule applicable in foreign tons contains two conditions. First, the wrong must be actionable under the law of the forum. Second, the wrong must not be justifiable by the law of the place where the tort occurred. Professor Castel welcomes a recent decision of the Ontario Court of Appeal further refining the second condition of the rule. However, he argues that the decision of the Court of Appeal is actually a disguised attempt to adopt the doctrine of the proper law of the tort dependent upon establishing which jurisdiction has the most significant relationship with the …

Making The Justice System Balance: Beyond The Zuber Report, Frederick H. Zemans Jan 1990

Making The Justice System Balance: Beyond The Zuber Report, Frederick H. Zemans

Articles & Book Chapters

The civil and criminal justice systems rely on a highly individualized dispute resolution process in which each litigant must both prosecute and present his or her own case with limited intervention by the court system and no direct involvement by the judiciary. Neil Brooks has noted that the adversarial system reflects the "political and economic ideology of classic English liberalism in three ways: by its emphasis upon self-interest and individual initiative; by its apparent distrust of the state; and, by the significance it attaches to the participation of the parties." Much of the current discussion of access to justice is …
