Daydream Believing: Visionary Formalism And The Constitution, Allan C. Hutchinson, Andrew Petter

The failure of traditional strands of legal formalism to provide a satisfactory account of law's relation to material conditions, and its distinction from political practice, has given rise to a new variant of formalist theory: visionary formalism. In this essay, the authors examine visionary formalism through the work of one of its leading exponents, William E. Conklin. They contend that, far from rescuing legal formalism, the visionary account of constitutional adjudication put forward in Conklin's recent treatise, Images of the Constitution, exposes formalism for what it is: an effort to romanticize and legitimize a peculiarly regressive mode of political practice. …

What Shelter Remains For Builder/Vendors Under Rcw 4.16.300-320 After Pfeifer V. Bellingham?, Peter Sandomire

This Note criticizes Pfeifer's incomplete resolution of the apparent conflict between Wash. Rev. Code §§ 4.16.300-.320 and § 353 of the Restatement (Second) of Torts and calls for a reconsideration of the case. The Note is premised on the general validity of statutes of repose and the merit of the policies that they promote. The Note first reviews briefly the development of statutes of repose generally, how they operate, and how courts in Washington and in other jurisdictions have applied them. It then analyzes the development of the Restatement's § 353 and its policy. Next, it examines the Pfeifer court's …

Duplicative Litigation: Issue Estoppel, Abuse Of Process And The Death Of Mutuality, Garry D. Watson

The traditional requirement of Anglo-Canadian law, that issue estoppel applies only as betwen those who were parties to both the earlier and subsequent litigation, is fast disappearing. However, the disappearance of this requirement of mutuality is presently confused by the courts' invocation of the rubric of 'abuse of process', rather than a straight abandonment of the requirement of mutuality. This article describes the abandonment of mutuality in American law and the emergence of the doctrine of non-mutual issue estoppel, and critically examines the movements in Canadian and English law in the same direction. Technological change and overlapping social, environmental. educational and political issues have increased the need for understandable communications among the different countries of the world. Because English is wldely used. many Americans have no other language capability and are at a disadvantage in many situations. In addition, changes in the ethnic composition of the United States have intensified the need for skills in other languages. The need for second-language skills is perhaps greater among agriculturalists than it is for other areas. The Cooperative Extension System has Important roles to play in expanding these communication skills.

Listening To Mozart: Perceptual Differences Among Musicians, Rita Aiello, J. S. Tanka, Wayne C. Winborne

Journal of Music Theory Pedagogy

An exploratory study examining musicians' perceptual styles was conducted. Musicians described the musical elements they heard while listening to a movement of a symphony by W. A. Mozart. Hierarchical clustering was used to analyze the data. The descriptions revealed individual differences in perceiving the richness and complexity of the music. Different perceptual styles emerged. Some musicians listen to music holistically, reporting on entire phrases and sections, while others listen analytically, giving detailed descriptions as the music unfolds. Some of the major features of the classical musical style (i.e., tonality, rhythm, chords) show little variability among individuals, thus serving as landmarks …

Use Of Storytelling By Iowa Elementary Library Media Specialists, Frances E. Lachance

Seventy-five percent of 41 randomly selected Iowa public school library media specialists who answered a storytelling questionnaire in November, 1990, indicated that they used one or more storytelling activities with students in grades prekindergarten to six. Eleven of the 12 storytelling activities were used more with students in grades three or below than they were with students in grades four to six. Just 22% of the library media specialists indicated that they taught students to do storytelling, and this activity was done about equally with upper and lower elementary students.

As a teacher of the deaf, I am a teacher of language. Written language is difficult for the deaf to comprehend because they do not understand the structures of a story such as character, plot, and setting. The goal of this study is to be more familar with teaching deaf children these structures. I worked with ten 9-11 years old children who functioned at first or second grade level. These students were "Community-Based" where they develop functional skills for living in a community. The children did not have enough reading skills to be able to read a simple unknown story …

My honors capstone project consists of a macro-driven Lotus loan amortization program and a dBASE III+ file structure and loan amortization program for the use of Pat Yocum at SwedishAmerican Hospital in Rockford, Illinois. Pat will use these files and programs in order to computerize the principal and interest breakdown of loan payments made by employees of the hospital on loans of their Saver Plan and Incentive Saver Plan balances. Done manually, this breakdown process is very time consuming.

A Mineralogical And Geochemical Analysis Of Basaltic Lavas From The Zion National Park Region, Southwestern Utah, Jason R. Price

In the Transition zone of southwestern Utah, basaltic lavas are geochemically defined as a subduction suite and a plume suite. These predominantly basic lavas are late Cenozoic (<17 Ma) in age, with the two suites related in time and space. This paper suggests a two layer upper mantle model, an upper metasomatized lithospheric layer underlain by an asthenospheric layer, with both alkali basaltic and olivine tholeiitic magmas being generated by varying degrees of partial melting of spinel lherzolite in each individual layer. Due to the greater depth at which asthenospheric magmas are derived, mixing occurs between the alkali basaltic and the olivine tholeiitic magmas during ascent through the lithosphere. Since lithosphere-derived magmas ascend to the crust soon after generation, significantly less mixing occurs, if at all. Time-space relations support such a model.
