Litigation Across Space And Time: Courts, Conflict, And Social Change, David M. Engel Jan 1990

Litigation Across Space And Time: Courts, Conflict, And Social Change, David M. Engel

Journal Articles

One of the problems facing researchers who have studied courts across time and space has been the cultural variability of seemingly uniform analytic categories, including conceptions of time and space themselves. This article proposes that we take such variations in meaning as a starting point for comparative studies of courts and social change rather than viewing them as were "noise" in the system. Litigation in Chiangmai, Thailand, is presented as an example. Changing conceptions of "space" in Thailand from the nineteenth century to the present illustrate the transformation of legal and political authority as well as the proliferation of normative …

The Union At Risk: Jacksonian Democracy, States Rights And The Nullification Crisis, Gerard V. Bradley Jan 1990

The Union At Risk: Jacksonian Democracy, States Rights And The Nullification Crisis, Gerard V. Bradley

Journal Articles

Richard E. Ellis, The Union at Risk. Jacksonian Democracy, States Rights and the Nullification Crisis, Oxford: Oxford University Press, 1987. Pp. xi, 279. $32.50 (ISBN: 0-19-503785-5).

From the Review

In a widely reported address at Tulane University in October 1986, Attorney General Edwin Meese chastised the Supreme Court for its habitual conflation of constitutional law and the Constitution.

Meese is no intellectual, and his remarks were not intended as academic musings; thus, the speech may have been appropriately judged from a political perspective, condemned by liberals and applauded by conservatives for roughly the same reasons. Unfortunately obscured by the …

Legal Ethics After Babel, Thomas L. Shaffer Jan 1990

Legal Ethics After Babel, Thomas L. Shaffer

Journal Articles

Legal ethics owes as much to Richard M. Nixon as it does to philosophy. The rebirth of legal ethics in the last decade is one of many consequences, although possibly the most obscure, of the burglary at the Watergate Hotel in 1972. The criminal politics that destroyed Mr. Nixon's presidency summoned American lawyers to a serious, systematic examination of the morals of their craft.

Concluding Reflections, John M. Finnis Jan 1990

Concluding Reflections, John M. Finnis

Journal Articles

A symposium to which one person contributes three extended papers is no unmixed pleasure for readers. This third contribution of mine will interest only those curious to see my response to other symposiasts' comments on my earlier efforts (in the symposium and elsewhere). To enable this curiosity to be satisfied as costlessly as possible, I divide these concluding reflections by authors rather than themes, though with priorities suggested by themes rather than authors.

On Thinking Theologically About Lawyers As Counselors, Thomas L. Shaffer Jan 1990

On Thinking Theologically About Lawyers As Counselors, Thomas L. Shaffer

Journal Articles

Professor Morgan is more than gracious to me, his colleague in legal ethics. He understands, I think, that our little sub-discipline is an academic youngster—open, as children are, to insight and persuasion, willing to listen to almost anybody. I am grateful to him for his kind reference to my work. Along with other American law teachers, I am grateful for his leadership, critical thought, scholarly discussion, and example as one of the American legal profession's principal teachers of ethics.

My usefulness among commentators on Morgan's Thinking About Lawyers as Counselors, is probably that I write about legal ethics in reference …

Assessing Beliefs About Depression And Its Treatment, Eliezer Tzvi Margolis Jan 1990

Assessing Beliefs About Depression And Its Treatment, Eliezer Tzvi Margolis

Open Access Dissertations

This dissertation is motivated by the clinical problem of determining which of two comparably effective modes of treatment (pharrnacotherapy and psychotherapy) a depressed individual would be most likely to benefit from. A cognitive variable, illness beliefs about depression, is proposed as a promising guide for making such patient-treatment mode matches.

A broad area of literature is reviewed in order to learn how beliefs about depression are and have been conceptualized, and to learn what methods, if any, have been previously used to measure them. The review begins with an examination of the prevailing cognitive paradigm and it's failure to consider …

Teaching In A Liberal Arts College: How Foreign Language Courses Contribute To "Writing Across The Curriculum" Programs, Ilona Klein Jan 1990

Teaching In A Liberal Arts College: How Foreign Language Courses Contribute To "Writing Across The Curriculum" Programs, Ilona Klein

Faculty Publications

This essay shares some thoughts about the need for interaction between foreign language instructors and English teachers, both in high schools and at the university level. As a foreign language teacher for the past nine years (the last four in a liberal arts college), I have encountered several problems and difficulties that could be overcome, I believe, if English, Writing, and Foreign Language departments addressed them together. I do not claim to be able to give definite answers, since many pedagogical concepts concerting L2 acquisition/learning and their possible application to writing programs remain misunderstood or are presently debated by teacher …

Gender Construction in Prime-Time Sitcoms: Roseanne and Murphy Brown analyzes gender portrayal in the highest rated situation comedies on network television in the United States in 1992. The research is constructed to examine whether gender, as presented in Roseanne and Murphy Brown, continues to be based on confining stereotypes or if female characters are being portrayed in an increasingly egalitarian manner. Findings from previous decades of media research on gender portrayal in network television are used as a standard for compariSon Variations in gender portrayal because of social class differences are also examined; The main research methodology employed is content …

Trace Element Analysis Of Bighorn Sheep Horns, Peter Gordon Weigel Jan 1990

Trace Element Analysis Of Bighorn Sheep Horns, Peter Gordon Weigel

UNLV Retrospective Theses & Dissertations

A total of 249 samples of horn material from bighorn sheep was collected from nine locations. The concentrations of eight elements were determined in all samples by inductively coupled argon plasma spectroscopy. Year of horn growth was determined for 154 of the samples. All elements of concentrations varied significantly with respect to location. Some elements varied similarly to other elements with respect to location, but most locations exhibited unique element concentration profiles. Six of eight elements exhibited significant variation with respect to year of horn growth. A general pattern of annual element concentration fluctuation appeared to emerge. Generally, for a …

A Window To The Past: Analysis Of Flat Glass Recovered From West Point, Nevada, William G White Jan 1990

A Window To The Past: Analysis Of Flat Glass Recovered From West Point, Nevada, William G White

UNLV Retrospective Theses & Dissertations

This thesis presents a comparative archeological analysis of window glass collections recovered from five historic archeological sites located in southern Nevada spanning the years from 1866 to the 1960s. The comparative analysis is used to test the validity of the chronological scheme created by other researchers. The analysis also establishes the frame work by which two specific research questions concerning the abandoned Mormon pioneer colony of West Point are evaluated; Additionally, this study presents, in a descriptive and temporal fashion, the history of West Point and its subsequent use and reuse by later upper Moapa Valley settlers. The archeological and …

Accounts Of The Homeless, Linda Darlene Foreman Jan 1990

Accounts Of The Homeless, Linda Darlene Foreman

UNLV Retrospective Theses & Dissertations

This thesis traces the dominant themes found in the literature explaining homelessness. A discussion of differing types of homeless found in America historically and the categories of homeless living in America today follows. Another aspect of this research is an examination of the accounts given by numerous homeless individuals currently residing in Las Vegas. These accounts are divided into several categories that emerged from the data which reflect some of the experiences and perspectives of those who live without the benefit of shelter. The final part of this research outlines a basic program of action designed to fill the existing …

A Computerized Analysis Of Anterior Teeth As A Possible Indicator Of Age, Race And Sex, Jay A Johnson Jan 1990

A Computerized Analysis Of Anterior Teeth As A Possible Indicator Of Age, Race And Sex, Jay A Johnson

UNLV Retrospective Theses & Dissertations

Various systems of anthropometry have been developed through the years in an attempt to elucidate important characteristics of the human dentition. Few methods are currently relied upon as valuable indicators of age, race or sex; The computerized study of anterior tooth positions is an attempt at further elucidation of age, race and sex characteristics. Bite marks in wax from a general population sample of known age, race and sex are the basis for this computerized study. The computerized procedure allows for the examination of minute variation in tooth position. Twelve teeth in total are analyzed for every specimen.

Constitutional Privacy: The Evolution Of A Doctrine, Helena Ann Mandarino Jan 1990

Constitutional Privacy: The Evolution Of A Doctrine, Helena Ann Mandarino

UNLV Retrospective Theses & Dissertations

Although the right to privacy is not actually enumerated in the Constitution, over a century of common law precedent and judicial interpretation has authorized certain personal activities as being outside the scope of governmental regulation. The constitutional defense of such freedoms have been regarded as Fourteenth Amendment due process guarantees to life, liberty, and property. In Griswold v. Connecticut, the Supreme Court ruled that proscribing the use of contraceptives to married couples was unduly burdensome. Judicial acknowledgment of the right to privacy invited further challenges which involved intensely personal situations and choices, the most controversial of which is the right …

A Phenomenological Criticism: A Phenomenologically Based Methodology For Analyzing Theatrical Works, Roberta Sterman Sabbath Jan 1990

A Phenomenological Criticism: A Phenomenologically Based Methodology For Analyzing Theatrical Works, Roberta Sterman Sabbath

UNLV Retrospective Theses & Dissertations

The thesis, using Husserlian phenomenology, presents a descriptive, analytical approach for theatrical works. The methodology consists of two parts: "feeling" and "meaning." "Feeling" covers the reader/viewer's experience of the work; "meaning" covers the source of that experience in the work. An introductory portion asks the analyzer to describe the autonomous aspects of the work. The evaluative conclusion asks the reader/viewer to describe change or lack thereof in the personal perspective; Abraham Maslow's hierarchy of needs, Edith Stein's treatment of empathy, and Ernst Cassirer's paradigms of cultural expression are all used to enrich the analytical approach. Two plays, Caryl Churchill and …

Intrinsic Intertextuality:A Methodology For Analyzing The Seamless Intertext., Karen Sue Mitchell Jan 1990

Intrinsic Intertextuality:A Methodology For Analyzing The Seamless Intertext., Karen Sue Mitchell

LSU Historical Dissertations and Theses

This study argues for a methodology that applies contemporary theories of literature and performance to a certain kind of performance script I call a seamless intertext. Working deductively from theory to dramatic text, I explore what selected portions of extant performance and textual theory have to offer in examining, describing, and explaining these seamless intertexts. Working inductively from dramatic text to theory, I extend and offer further clarification and an extension of current theory through a more detailed explanation of the scripting explicit in each dramatic text. In the study I synthesize existing theory in intertextuality and define and describe …
