Innocent Until Presented, Aristo Pangaribuan May 2023

Innocent Until Presented, Aristo Pangaribuan

Jurnal Hukum & Pembangunan

This paper analyzes a practice of presenting suspects, which is a ritual that displays a suspect before the media. Until now, although it is frequently used by the police, there has been no attempt to examine such practices in Indonesia. In the criminal procedure scholarship, there is no standard term to describe it. This article will refer to such ritual as a presentation of suspects. This ritual has also been practiced around the world with different methods and has a long history, especially in the United States. This article discusses the presentation of suspects and question whether such a ritual …

The Archangel Fragment And C. S. Lewis’S World-Building Project, Brenton D. G. Dickieson, Charlie W. Starr May 2023

The Archangel Fragment And C. S. Lewis’S World-Building Project, Brenton D. G. Dickieson, Charlie W. Starr

Sehnsucht: The C. S. Lewis Journal

In this article, we argue that, from a few hints in the Bodleian archive and elsewhere, we have discovered C. S. Lewis’s singular attempt at an Archangelic sequel to The Screwtape Letters. By analyzing this small fragment and its contextual clues, we can hear the heaven-scented voice of this anti-Screwtape world. Through this discovery we can unlock hidden links among Lewis’s fiction project of the late 1930s and early 1940s and the ways he created the speculative worlds of those stories, including a spirit of playfulness and discovery, themes critical to his theological perspective, and potential links that draw his …

Simulation Of Wave Propagation Used For The Detection Of Submerged Stone Age Artifacts, Gage Plott, Christopher Cox, Boris Belinskiy, Morgan Smith May 2023

Simulation Of Wave Propagation Used For The Detection Of Submerged Stone Age Artifacts, Gage Plott, Christopher Cox, Boris Belinskiy, Morgan Smith

UTC Spring Research and Arts Conference

With the expansion of industrial digging in the sea for construction of traditional and alternative energy sources, there is a growing need to quickly identify submerged indigenous archeological sites. The two main methods used outside of this research are insufficient: 1) The use of high-frequency (600 – 2000 kHz) sound waves by way of side-scan sonar; 2) Using geophysics to identify landmarks that could have attracted pre-contact (indigenous) people. Morgan Smith and his team are using a sub-bottom profiler (SBP) to more accurately identify submerged cultural artifacts, as the SBP allows for lower-frequency (4 – 24 kHz) sound waves that …

The Nigerian Tiv Concept Of Ya Na Angbian As A Corrective To The Misinterpretation Of Subdue And Have Dominion In Genesis 1:26, Christopher Terhemen Bologo May 2023

The Nigerian Tiv Concept Of Ya Na Angbian As A Corrective To The Misinterpretation Of Subdue And Have Dominion In Genesis 1:26, Christopher Terhemen Bologo

Jesuit School of Theology Dissertations

The Tiv people of Nigeria have a social-political philosophy, Ya na angbian, which they have been practicing since the pre-colonial period. The social-political philosophy promotes justice, fairness, harmony, and peace through a fair and equitable distribution of what belongs to the Tiv people. This thesis argues that the Ya na angbian concept of the Tiv people can be applied to the relationship between human and non-human beings. This work maintains that it can lead to human beings’ care for non-human nature.

The first outstanding conclusion of this research is that the Ya na angbian social-political philosophy can correct misunderstanding …

Reworking Hospitality: The Social Practices Of Arab Immigrants In Granada, Spain, Sarah Falknor May 2023

Reworking Hospitality: The Social Practices Of Arab Immigrants In Granada, Spain, Sarah Falknor

World Languages, Literatures and Cultures Undergraduate Honors Theses

“Right now, you and me sitting here, this is hospitality.” My eyes darted left and right to the surrounding street for a moment as I took in the feeling of a sticky, metal chair against my legs and thirst settling in my throat. This was not the kind of Arab hospitality I had read about in books -- the extravagant kind that absolutely involves food and three days of accommodations before the hosts can ask the reason a guest is in their home. This felt to me like exactly what it was, a random interview with a stranger conducted in …

Disturbance Regimes And Management Strategies Of Mountain Ash Forest Ecosystems In Victoria, Australia; A Literature Review, Zoe Plumb May 2023

Disturbance Regimes And Management Strategies Of Mountain Ash Forest Ecosystems In Victoria, Australia; A Literature Review, Zoe Plumb

Sustainability and Social Justice

This paper discusses the ecology of mountain ash forests, the disturbances regimes that currently exist in these ecosystems, and finally addresses the current management practices and future management practices. Mountain ash forests are subjected to a wide range of research in the Central Highlands of Victoria, an area approximately 14,000 hectares in range. These forests are dominated by montane ash trees (Eucalyptus regnans F. Muell), which are critically endangered and at risk of collapse, attributed to the decline in large hollow-bearing trees throughout the region. Management of these forests are controlled by the Department of Environment, Land, Water, and …

Religious Political Arguments, Accessibility, And Democratic Deliberation, Paul Billingham May 2023

Religious Political Arguments, Accessibility, And Democratic Deliberation, Paul Billingham

Notre Dame Law Review

Christian critics of liberalism, and especially of contemporary public-reason liberalism, often argue that it objectionably excludes religious voices form the public square, by requiring citizens to bracket their religious convictions when they engage in democratic deliberation. In response, liberals often deny that their views have this implication. Many public-reason liberal theorists are “inclusivists,” who permit religious contributions to deliberation.

Yet even inclusivists provide little reason to think that religious political arguments can be persuasive or fruitful. After all, they tend to see religious reasons as inaccessible to others, due to relying on beliefs, values, and methods of reasoning that others …

Whose Liberalism, Which Christianity?, Jonathan Chaplin May 2023

Whose Liberalism, Which Christianity?, Jonathan Chaplin

Notre Dame Law Review

The papers in this intriguing Symposium all face the perplexing challenge of negotiating a way through the thicket of divergent definitions of both “liberalism” and “Christianity.” At a time when “Christianity” is thought to be, for some, fundamentally at odds with “liberalism,” or for others, liberalism’s enthusiastic cheerleader, we cannot avoid delving into the finer grain of these complex traditions. The clarificatory challenge in regard to “liberalism” has been lent greater urgency of late because of the comprehensive nature of assaults on “liberalism” by, especially, Catholic integralism. Christians who seek at least partially to defend liberalism against such assaults (as …

"Can These Bones Live?": The Relationship Between Transformational Leadership And Church Revitalization, Gerald Gifford May 2023

"Can These Bones Live?": The Relationship Between Transformational Leadership And Church Revitalization, Gerald Gifford

Dissertations

This study examined the relationship between Transformational Leadership Theory and church revitalization. The researcher attempted to answer two questions. (1) To what extent do pastors who led Kentucky Baptist Convention churches through a successful revitalization exhibit the characteristics of Transformational Leadership? (2) What, according to the pastors, were the primary causes of the revitalization? The MLQ survey by Mind Garden, Inc. was used to investigate the first question by comparing a target sample with a comparative group who did not lead a revitalization. Scoring on the MLQ confirmed that those in the target sample were transformational leaders. The comparative group, …

The Manito Topos Project: Place Naming And Toponymic Silencing In The Sierras Of Northern Nuevo México And Southern Colorado, Len N. Beké May 2023

The Manito Topos Project: Place Naming And Toponymic Silencing In The Sierras Of Northern Nuevo México And Southern Colorado, Len N. Beké

Spanish and Portuguese ETDs

This dissertation reports on documentary research on vernacular toponymies in Manito communities in Nuevo México and Colorado. These toponymies are erased, obscured and delegitimized in official maps. Within the study area, vernacular antecedents for 49.5% of official names for natural features were documented, along with 280 previously unmapped names. These data were compared to the state-sanctioned toponymy to determine a typology of linguistic mechanisms of toponymic silencing. While a majority of official toponyms are based on Manito oral tradition, only 15.4% of the labels for natural features represent unaltered versions of names in that tradition. This dissertation theorizes the conceptual …

“Everything And Nothing”: Exhibiting Irishness At The Chicago World Fair Of 1893, Jessica Bocinski May 2023

“Everything And Nothing”: Exhibiting Irishness At The Chicago World Fair Of 1893, Jessica Bocinski

English (MA) Theses

This project employs a cultural studies approach to investigate the overlapping productions of Irish identity at the Irish Villages of the Chicago World’s Fair of 1893. Conceptualized and designed by two British philanthropists and businesswomen, the Irish Villages presented an Irishness shaped by Ireland’s long history of colonial rule. For Irish Americans living in the United States during the late nineteenth century, the Irish Villages offered a particularly well-suited opportunity to present an identity that would facilitate their acceptance into American society. Rather than challenging or negating the colonial representations of Irishness that existed at places like the Chicago World’s …

An Evaluation Of The Effect Of Degradation On Irisplex Snps, Maria Gruber May 2023

An Evaluation Of The Effect Of Degradation On Irisplex Snps, Maria Gruber

Master's Theses

The information from short tandem repeats (STRs), the current standard forensic DNA typing technology, does not always result in identification. In these cases, there are other informative markers in DNA that can be used to help generate investigative leads, one of which is single nucleotide polymorphisms (SNPs). One of the uses of SNPs is for phenotype determination. Among the phenotypic characteristics that can be predicted is eye color. A commonly used tool for eye color prediction is the free, online statistical prediction model IrisPlex, which includes 6 SNPs known to control eye color.

While SNPs can be useful, they, like …

Of Humans, Machines, And Extremism: The Role Of Platforms In Facilitating Undemocratic Cognition, Julia R. Decook, Jennifer Forestal May 2023

Of Humans, Machines, And Extremism: The Role Of Platforms In Facilitating Undemocratic Cognition, Julia R. Decook, Jennifer Forestal

Political Science: Faculty Publications and Other Works

The events surrounding the 2020 U.S. election and the January 6 insurrection have challenged scholarly understanding of concepts like collective action, radicalization, and mobilization. In this article, we argue that online far-right radicalization is better understood as a form of distributed cognition, in which the groups’ online environment incentivizes certain patterns of behavior over others. Namely, these platforms organize their users in ways that facilitate a nefarious form of collective intelligence, which is amplified and strengthened by systems of algorithmic curation. In short, these platforms reflect and facilitate undemocratic cognition, fueled by affective networks, contributing to events like the …

Life And The Renewal Of The Christian Community: Infant Baptism And Inculturation In The Context Of The Democratic Republic Of The Congo, Héritier Ofabwe Kinzamba May 2023

Life And The Renewal Of The Christian Community: Infant Baptism And Inculturation In The Context Of The Democratic Republic Of The Congo, Héritier Ofabwe Kinzamba

Jesuit School of Theology Dissertations

This thesis is part of the liturgical inculturation process that has been taking place in the local Church of the Democratic Republic of the Congo since the 1960s, one of whose treasured expressions is the Roman Missal for the Dioceses of Zaïre, an inculturated ritual of Mass. In this work, I aim to contribute to extending the special rite for the Dioceses of Zaïre to include the celebration of infant Baptism. I use a hermeneutical method and an anthropological model of contextual theology to interpret and analyze the foundations of the Roman Rite for the Dioceses of Zaire, the Church’s …

Expanding Catholic Social Teaching On Wealth, Money, And Entrepreneurship, Jean Claude Havyarimana May 2023

Expanding Catholic Social Teaching On Wealth, Money, And Entrepreneurship, Jean Claude Havyarimana

Jesuit School of Theology Dissertations

Catholic Social Teaching on integral human development and the Preferential Option for the Poor has not yet given due attention to money, wealth creation, entrepreneurship or poverty eradication. Yet all of the four are presupposed by integral human development and the Preferential Option for the Poor in a market-based world. In addressing these gaps, within the New Humanistic Synthesis framework promoted by Pope Benedict XVI, this thesis has recommended looking at entrepreneurship—the engine of money and wealth creation—as a Christian vocation. A close analysis of the Scriptures reveals that God has acted in history entrepreneurially. Therefore, since humans are created …

Towards A Holistic Reconciliation In Africa, N’Guessan Kouacou Augustin Koffi May 2023

Towards A Holistic Reconciliation In Africa, N’Guessan Kouacou Augustin Koffi

Jesuit School of Theology Dissertations

Reconciliation is a relevant topic in the world and especially in Africa, which has a thirst for peace and justice, yet is plagued by ongoing crises. Many African countries have tried to build social trust for a living together. On the Church's side, Catholic Social Teaching, through Africae Munus, clearly articulates Africa's thirst for reconciliation, justice, and peace. Various African church leaders and laypeople have been engaged in the reconciliation and conflict transformation in Africa. Even though some progress has been made, people are still disappointed at the ongoing violence and social injustice in many parts of the continent. This …

Cultivating Social Media Technomoral Virtues: Toward A Moral-Character Education For African Youth, Tégawindé Basile Ouedraogo May 2023

Cultivating Social Media Technomoral Virtues: Toward A Moral-Character Education For African Youth, Tégawindé Basile Ouedraogo

Jesuit School of Theology Dissertations

Young Africans generally go on social media to socialize and make friends. Unfortunately, the misuse of social media leads to ethical issues among young people. Deterrent measures by governments, parents and educators remain ineffective. Therefore, the education of youth to cultivate the necessary virtues can help them to use social media for a flourishing life. I argue that virtues of self-control, respect, responsibility, empathy and integrity should be cultivated for the heathy use of social media. In fact, the ‘technomoral virtues’ developed by Shannon Vallor, can address the vices related to the use of social media.

To cultivate these virtues …

"It Is Tash Whom He Serves": Deneen And Vermeule On Liberalism, Andrew Koppelman May 2023

"It Is Tash Whom He Serves": Deneen And Vermeule On Liberalism, Andrew Koppelman

Notre Dame Law Review

I worry that some recent Christian criticisms of liberalism are the kind of fantasy that Murdoch warned about, caricaturing what they purport to oppose. They are also ominously vague about what would replace it. Both writers echo earlier Christian flirtations with Marxism: philosophical errors lead idealists to gullibly embrace authoritarian kleptocrats who do not give a damn about the people the idealists are trying to help.

I will focus on the work of Patrick Deneen, with some reference to the more abbreviated but similar critiques of liberalism by Adrian Vermeule. Both claim that liberalism’s relentless logic tends to destroy communities …

Natural Law, Parental Rights, And The Defense Of "Liberal" Limits On Government: An Analysis Of The Mortara Case And Its Contemporary Parallels, Melissa Moschella May 2023

Natural Law, Parental Rights, And The Defense Of "Liberal" Limits On Government: An Analysis Of The Mortara Case And Its Contemporary Parallels, Melissa Moschella

Notre Dame Law Review

This Article explores parallels between integralists’ defense of the Mortara case (in which Pius IX removed a child from his parents’ care in order to provide him with a Catholic education) and contemporary progressive arguments for overriding the authority of parents who do not want their gender-dysphoric children to undergo social or medical gender transition. In Part I, I offer an overview of the natural law case for limited government, then in Part II I turn more specifically to a natural law defense of parental rights as an essential aspect of limited government. In the following Part, I return to …

Liberalism And Orthodoxy: A Search For Mutual Apprehension, Brandon Paradise, Fr. Sergey Trostyanskiy May 2023

Liberalism And Orthodoxy: A Search For Mutual Apprehension, Brandon Paradise, Fr. Sergey Trostyanskiy

Notre Dame Law Review

This Article seeks to evaluate and contextualize recently intensifying Christian critiques of liberalism’s intellectual and moral claims. Much of this recent critique has been from Catholic and Protestant quarters. Christianity’s third major branch—Orthodox Christianity—has not played a prominent role in current critiques of liberalism. This Article seeks to help fill this void in the literature. In helping to fill this void, it contributes to understanding how liberalism fits with one of the world’s most ancient Christian traditions.

The Article begins by disambiguating the terms Orthodoxy and liberalism. After identifying each body of thought’s foundational commitments, it notes that Orthodoxy endorses …

A Zooarchaeological Metadata Analysis Of Animal Domestication In The Neolithic Northern Levant, Ashlyn R. Cartier May 2023

A Zooarchaeological Metadata Analysis Of Animal Domestication In The Neolithic Northern Levant, Ashlyn R. Cartier

University Scholar Projects

This project compiles and examines 17 published faunal assemblages spanning the Epipaleolithic to the Pottery Neolithic in the Northern Levant to uncover early trends in animal management practices. Through a close examination of indices tracking the proportions of low and high-ranked prey, wild versus domestic game, and taxonomic diversity, it is possible to examine the trends in and deduce the approximate timing of the shift toward early animal management practices. To examine the conditions from which this phenomenon emerged, analyses of hunting intensity and taxonomic tradeoffs were implemented. Hunting intensity provides an analysis of low and high-ranked prey to examine …
