Is Originalism Orthodoxy?, Neel Sukhatme

Articles

What theory of constitutional interpretation has the Supreme Court followed? We search Supreme Court opinions for a wide range of sources that originalists identify as central to their methodology, over the entire universe of cases beginning in 1791. We find that for much of Supreme Court history, conventional indicators of originalist practice--citations to Founding-era sources--are largely absent, raising questions about originalism's past orthodoxy. Originalist citation practices are absent for much of the 19th century and grow sharply in the late 20th century. The Article elaborates the implications of these findings for debates in constitutional law.

After trial on the tenant's counterclaims of breach of warranty of habitability, harassment, and rent overcharge, the court entered judgment for the tenant on all three. The subject apartment was found to be an unlawful combination of predecessor apartments whose legal rent was never registered with DHCR, requiring application of the default formula under RSC § 2522.6(b)(3) to calculate overcharge damages. The court awarded a rent abatement, civil penalties for harassment, and entered an order enjoining the landlord from further harassing the tenant.

Background: Allergic fungal rhinosinusitis (AFRS) is a severe subtype of chronic rhinosinusitis characterized by fungal hypersensitivity and accentuated type 2 inflammation. Dupilumab-a fully human mAb blocking IL-4/13, approved for type 2 inflammatory diseases, including chronic rhinosinusitis with nasal polyps-may benefit patients with AFRS.

Objective: We sought to understand the effect of dupilumab in AFRS.

Methods: In this phase 3 trial, patients with AFRS age ≥6 years were randomized to dupilumab or matched placebo for 52 weeks. The primary end point was Lund-Mackay computed tomography score, quantifying sinus opacification, at 52 weeks. Secondary end points were multiplicity-controlled and hierarchically tested.

Periodontitis, a chronic inflammatory disease affecting approximately 40% of U.S. adults aged 30 years and older, is characterized by dysbiosis of the dental plaque microbiome. However, although scaling and root planing (SRP) is the cornerstone of periodontal treatment, its effects on the taxonomic composition and functional potential of the dental plaque microbiome remain incompletely understood. In this study, we used whole-metagenome shotgun sequencing to characterize taxonomic composition and functional potential in dental plaque microbiomes collected from 39 patients with Stage II or III generalized periodontitis before and 3–4 months after SRP. The explosive growth of artificial intelligence workloads has triggered unprecedented data center construction, yet environmental assessment remains focused on operational energy efficiency. This paper introduces DC-WLC3O, a framework that simultaneously optimizes three objectives across the full data center lifecycle: whole-life cost, whole-life carbon, and material circularity index. The framework integrates cradle-to-cradle lifecycle assessment with dynamic material flow analysis, employing a four-layer analytical stack: Monte Carlo simulation with Latin Hypercube Sampling and Iman–Conover rank correlation; NSGA-III tri-objective Pareto optimization; Sobol’ variance-based global sensitivity analysis; and Many-Objective Robust Decision Making (MORDM). Developing three-dimensional (3D) skin models provides a physiologically relevant platform to investigate the dynamic interactions between the skin microbiome and immune cells in chronic wounds, offering insights into delayed healing, persistent inflammation, and microbial dysbiosis. Traditional in vitro models fail to replicate the complex architecture of human skin and its immune-microbiome crosstalk, motivating the development of biomimetic systems that incorporate stratified epidermal layers, dermal fibroblasts, and innate immune components such as macrophages and neutrophils. Engineered 3D skin constructs inoculated with wound-associated microbiota, including Staphylococcus aureus, Pseudomonas aeruginosa, and Cutibacterium acnes, can reveal how biofilm formation, quorum sensing, …

Medical device–related pressure injuries are a significant and largely preventable patient safety problem, yet existing pressure injury risk scales do not adequately capture device-specific risk factors in adults. This methodological study developed and psychometrically evaluated a standardized risk assessment scale to identify medical device–related pressure injury risk in hospitalized adult patients. An initial item pool was generated from an extensive literature review and clinical expertise, and content validity was assessed by seven experts using the Davis technique (content validity index = 0.96). Identity-Dependent Externalities Can Mitigate Overbidding In Tullock Contests: Theory And Evidence, Dan Kovenock, Jian Song, Francesco Trevisan

We investigate how identity-dependent externalities infuence bidding behavior in Tullock lottery contests. While experimental studies of standard contests, in which losers are indiferent to the winner’s identity, consistently document overbidding, the role of identity-dependent preferences remains less explored. We address this gap by frst showing that the class of three-player Tullock lottery contests with identity-dependent externalities considered here can be mapped into a standard Tullock lottery contest with appropriately chosen prize valuations and endowments, yielding identical Nash equilibrium predictions. We then use this mapping to design a laboratory experiment that directly compares the two “equilibrium-equivalent” contest formats. In our three-player …

Female germ cells must preserve the integrity of their genome and generate genetic diversity via meiotic recombination. This challenging process is error prone. Highly conserved checkpoint pathways detect errors in recombination and DNA damage, inducing the death of defective oocytes. Nuclear Envelope Membrane Protein (NEMP) homologs are highly conserved proteins critical for fertility in flies, worms, fish and mice. They localize to the inner nuclear envelope where they provide mechanical support. However, why NEMP homologs are specifically required for fertility is still unclear. Entity Labels Are Not Entity Signals: A Framework For Observable Relevance In Document Re-Ranking, Utshab Kumar Ghosh, Shubham Chatterjee

Entity-aware document retrieval uses query-associated entities as ranking signals, assuming that semantically relevant entities are also useful retrieval signals. We show this assumption is insufficient - and explain why. Unlike terms, which are ground-truth observations, entity links are hypotheses produced by an imperfect linker: an entity can be topically central yet provide no discriminative signal if the linker fires indiscriminately across relevant and non-relevant documents. We formalize this as a distinction between Conceptual Entity Relevance (CER) - whether an entity is topically related to a query - and Observable Entity Relevance (OER) - whether its observed presence in a collection …
