Forest Clearcutting And Site-Preparation On A Saline Soil In East Texas: Impacts On Water Quality, Matthew W. Mcbroom, Mingteh Chang, Alexander K. Sayok

Faculty Publications

Three 0.02 hectare plot-watersheds were installed on a saline soil in the Davy Crockett National Forest near Apple Springs, Texas. Each plot was installed with an H-flume, FW-1 automatic water level recorder, Coshocton N-1 runoff sampler, and two storage tanks. One watershed was undisturbed forested and served a control, one was clearcut without any site-preparation, and the third was clearcut, V-blade sheared, windrowed, and vegetation regrowth was prevented for the first 2 years. A total of 274 storms were recorded during the four-year study period, 1989-1992. Average annual sediment losses for the study period were 55, 197, and 1,530 kilograms …

First-Year Survival And Growth Of Bareroot And Container Water Oak And Willow Oak Seedlings Grown At Different Levels Of Mineral Nutrition, Hans Michael Williams, Matthew Stroupe Jan 2002

First-Year Survival And Growth Of Bareroot And Container Water Oak And Willow Oak Seedlings Grown At Different Levels Of Mineral Nutrition, Hans Michael Williams, Matthew Stroupe

Faculty Publications

Bareroot and container water oak (Quercus nigra) and willow oak (Quercus phellos) seedlings were treated with 3 different levels of nitrogen (N) mineral fertilizer applied during the growing season in the nursery. Comparisons were made between species, N treatments, and stock-types for seedling morphology, first-year survival and height growth, and seedling water relations. Water oak seedlings were shorter, heavier, and more first-order lateral roots than the willow oak seedlings. The N fertilizer treatments did not have a statistically significant effect on seedling morphology. Bareroot seedlings were taller, had greater root-collar diameters, and were heavier than the container seedlings. The seedlings …

Innovate Or Evaporate . . . Business Concept Innovation In The Furniture Industry In The Age Of Information, Steven H. Bullard Jan 2002

Innovate Or Evaporate . . . Business Concept Innovation In The Furniture Industry In The Age Of Information, Steven H. Bullard

Faculty Publications

Introduction The U.S. furniture industry has changed dramatically in recent years. Furniture manufacturers, for example, have recently faced competition from foreign producers that has been particularly intense – resulting in factory closings and job losses in many areas of the country, including the Mid-South. In Mississippi, for example, the number of employees in furniture and fixtures industries dropped by 2,100 (6.8%) in the year 2000 (Center for Policy Research and Planning 2001). Similar job losses have been occurring in Tennessee, Virginia, North Carolina and other important furniture-producing states. Nationwide, employment in furniture and fixtures manufacturing dropped by 40,000 (7.2%) from …

Furniture Manufacturing And Marketing: Eight Strategic Issues For The 21st Century, Steven H. Bullard, C. D. West

Faculty Publications

“Take change by the hand, or it will take you by the throat.” Attributed to Winston Churchill, this brief sentence emphasizes the need to understand and embrace change in general. What important “changes” will impact furniture production and marketing in the 21st century? And what can furniture manufacturers and marketers do to “take change by the hand” today and in the future?

Effect Of Ga Content On Defect States In Cuin1-XGaXSe2 Photovoltaic Devices, Jennifer T. Heath, J. David Cohen, William N. Shafarman, Dongxiang Liao, Angus Rockett Jan 2002

Effect Of Ga Content On Defect States In Cuin1-XGaXSe2 Photovoltaic Devices, Jennifer T. Heath, J. David Cohen, William N. Shafarman, Dongxiang Liao, Angus Rockett

Faculty Publications

Defects in the band gap of CuIn1-xGaxSe2 have been characterized using transient photocapacitance spectroscopy. The measured spectra clearly show response from a band of defects centered around 0.8 eV from the valence band edge as well as an exponential distribution of band tail states. Despite Ga contents ranging from Ga/(In+Ga)=0.0 to 0.8, the defect bandwidth and its position relative to the valence band remain constant. This defect band may act as an important recombination center, contributing to the decrease in device efficiency with increasing Ga content.

Ending A Mud Bowl: Defining Arbitration’S Finality Through Functional Analysis, Amy J. Schmitz Jan 2002

Ending A Mud Bowl: Defining Arbitration’S Finality Through Functional Analysis, Amy J. Schmitz

Faculty Publications

The Federal Arbitration Act (FAA) and Uniform Arbitration Act (UAA), on the state level, prescribe a nearly identical procedural and remedial scheme for promoting independent, self-contained arbitration. To that end, both acts curtail courts' review of arbitration awards, by limiting the grounds for vacating awards to those aimed at ensuring only basic procedural fairness. Nonetheless, seemingly "pro-arbitration" impulses have driven some courts' eager application, or misapplication, of the FAA/UAA statutory scheme to enforce dispute resolution agreements that reject the acts' limited review prescriptions. This Article tackles this arguable abuse of the FAA/UAA scheme, by proposing a functional analysis for defining …

Supreme Court Employment Law Cases 2001-02 Term, Rafael Gely

Faculty Publications

I set two simple objectives for the article. First, the article will summarize each of the cases. My intent is to provide those unfamiliar with the cases a brief review of the facts and a summary of the Court's reasoning. Parts II through VI provide this discussion, grouping the cases by subject area. Second, in Part VII, the article provides a "big picture" analysis of the various cases. My intent is to identify trends, issues, interesting aspects and features of the Court's term. My objective is to aid in our understanding of the patterns that might affect the Court's treatment …

Lawyers And Trust In Business Alliances, George W. Dent Jan 2002

Lawyers And Trust In Business Alliances, George W. Dent

Faculty Publications

This Article attempts a first step in filling the gap in the legal literature about lawyers and strategic business alliances. Part I describes the distinctive nature of strategic alliances. Part II discusses why strategic alliances pose unique problems for lawyers. Part III considers how lawyers' negotiation tactics can enhance rather than erode trust between the parties in alliances. Part IV suggests how lawyers can draft substantive contract terms that foster trust and cooperation in alliances. Part V explores how law schools and continuing legal education can train lawyers to perform better not only in strategic business alliances but in all …

Insurance, Terrorism, And 9/11: Reflections On Three Threshold Questions, Robert H. Jerry Ii Jan 2002

Insurance, Terrorism, And 9/11: Reflections On Three Threshold Questions, Robert H. Jerry Ii

Faculty Publications

For most of us, the collapse of the World Trade Center towers exists at the outermost edge of human comprehension. Even after one visits Ground Zero, the events of 9/11 retain a surreal quality, invoking feelings beyond words as one tries to contemplate losses immeasurable with numbers. Indeed, the insurance losses are insignificant when compared to the human tragedies caused by the terrorist attacks-and in insurance terms, we witnessed the most costly, complex events to transpire in a single day in the history of the planet. Many years will pass before all the insurance ramifications of 9/11 are sorted out.

The Social Welfare Of Advertising To Children, Dennis D. Crouch Jan 2002

The Social Welfare Of Advertising To Children, Dennis D. Crouch

Faculty Publications

The aim of this Comment is to approach the issue of advertising to children through an examination of economic incentives and efficiency. The Comment ultimately makes the claim that televised advertisement of products, such as junk food, directed toward children may be inefficient and tend to decrease social welfare. Although they may be compelling, this paper does not rely on the secondary negative externalities often associated with television, such as the cost of treating diabetes and heart disease. Rather, the inefficiency discussed in the Comment involves the informational qualities of advertising. Advertising directed towards young children can be thought of …

Product Liability: A Commentary On The Liability Of Suppliers Of Component Parts And Raw Materials, David A. Fischer Jan 2002

Product Liability: A Commentary On The Liability Of Suppliers Of Component Parts And Raw Materials, David A. Fischer

Faculty Publications

The liability of suppliers of raw materials and component parts for harm caused by the product into which the materials have been incorporated poses difficult questions. When the raw material or component part is clearly defective, there is no question that the supplier is liable. Thus, where an ingredient in processed food is contaminated or where a truck tire has a flaw that causes a blowout, the supplier of the ingredient or the tire is liable. The difficult questions arise where the components are not inherently defective, but the finished product is defective because it lacks a safety feature or …

Spouses Need Not Apply: The Legality Of Antinepotism And No-Spouse Rules , Rafael Gely, Timothy D. Chandler, Jack Howard, Robin Cheramie

Faculty Publications

We begin this analysis in Part II with a brief discussion of employment policies that have been adopted to meet the unique needs of working families. Interestingly, these practices often exist contemporaneously with policies that restrict employment opportunities for dual-earner couples, namely antinepotism and no-spouse rules. In Part III, we present the results of our comprehensive analysis of case law in this area to show the nature of legal challenges to antinepotism and no-spouse rules and how they have been decided by the courts. In Part IV, we describe the legislative framework under which MSD claims have been raised and …

The Role Of Jury In Modern Malpractice Law, Philip G. Peters Jr. Jan 2002

The Role Of Jury In Modern Malpractice Law, Philip G. Peters Jr.

Faculty Publications

This article explores the policy issues raised by the choice between a custom-based standard of care and a jury-determined reasonability standard. The author examines not only traditional legal arguments but also the recent findings of cognitive psychology, jury performance studies, and health industry research. Not surprisingly, this analysis reveals that both options are imperfect. However, the author cautiously recommends the reasonable physician standard. The revolutionary transformation of the health care industry in last quarter of a century has transferred considerable power from physicians to the health insurance industry, an industry that has not yet earned the privilege of self-regulation. Unlike …

Interracial Intimacy And The Potential For Social Change, Stephanie M. Wildman

Faculty Publications

In her review essay Interracial Intimacy and the Potential for Social Change, Stephanie Wildman examines Interracial Intimacy: The Regulation of Race and Romance by Rachel F. Moran. Moran's book investigates the so-called private landscape of race in the context of interracial intimacy. Moran urges the connection between our personal, private views of race and racial issues and the policy decisions society makes in the public realm. Moran explores historic antimiscegenation laws and their role in establishing societal norms and customs, the significance of race in daily life, the legal decisions leading to Loving v. Virginia, and the role of race …

The bilayered rhodium oxide (formula presented) was synthesized by high-pressure and high-temperature heating techniques. The single-phase polycrystalline sample of (formula presented) was characterized by measurements of magnetic susceptibility, electrical resistivity, specific heat, and thermopower. The structural characteristics were investigated by powder neutron diffraction study. The rhodium oxide (formula presented) (formula presented) is isostructural to the metamagnetic metal (formula presented) with five (formula presented) electrons per Rh, which is electronically equivalent to the hypothetical bilayered ruthenium oxide, where one electron per Ru is doped into the Ru-327 unit. The present data show the rhodium oxide (formula presented) to be metallic with …

The Effect Of Reactor Geometry On Frontal Polymerization Spin Modes, John A. Pojman, Jonathan Masere, Enrico Petretto, Mauro Rustici, Do Sung Huh, Min Suk Kim, Vladimir Volpert Jan 2002

The Effect Of Reactor Geometry On Frontal Polymerization Spin Modes, John A. Pojman, Jonathan Masere, Enrico Petretto, Mauro Rustici, Do Sung Huh, Min Suk Kim, Vladimir Volpert

Faculty Publications

Using reactors of different sizes and geometries the dynamics of the frontal polymerization of 1,6-hexanediol diacrylate (HDDA) and pentaerythritol tetraacrylate (PETAC), with ammonium persulfate as the initiator were studied. For this system, the frontal polymerization exhibits complex behavior that depends on the ratio of the monomers. For a particular range of monomers concentration, the polymerization front becomes nonplanar, and spin modes appear. By varying the reactor diameter, we experimentally confirmed the expected shift of the system to a greater number of "hot spots" for larger diameters. For square test tubes a "zig-zag" mode was observed for the first time in …

Behavior Of Bollworm (Lepidoptera: Noctuidae) Larvae On Genetically Engineered Cotton., J. Gore, B. R. Leonard, G. E. Church, D. R. Cook

Faculty Publications

Reports of bollworm, Helicoverpa zea (Boddie), larvae feeding in white flowers of Bollgard cotton have been relatively common since the commercialization of this technology in 1996. Field studies were conducted in Louisiana to determine if differences in bollworm larval behavior occuron non-Bollgard (cultivar 'Deltapine 5415') and Bacillus thuringiensis (Bt), Bollgard ('NuCOTN 33B') cottons. Larvae were placed on the terminal foliage of either single cotton plants or on all plants within 1-m row micro-plots. On preflowering cotton plants, significantly more bollworms moved from the site of infestation (terminal) on Bollgard plants compared with that on non-Bollgard plants. On individual flowering plants, …

Synthesis Of Isomers Of Organotin Substituted Polyoxotungstates And Comparison Of The Antitumor Activity Of Isomers, Xiaohong Wang, Jutao Liu, Rongchang Zhang, Bin Li, Jingfu Liu

Faculty Publications

A comparison of the antitumor activity against two human tumor cell lines for the isomers of organometallo-substituted polyoxometalates is reported. The polyoxometalate skeletal isomers affect the antitumor activity. It is observed that the order of the antitumor activity of complexes is consistent with the order of the oxidation ability of polyanions among a couple of isomers possessing the same polyanion and organometallic group whether in the series of monosubstituted complexes or trisubstituted complexes as well in the sandwich compounds.

Mixed-Mode Shell-Model Theory For Nuclear Structure Studies, V. G. Gueorguiev, W. E. Ormand, C. W. Johnson, J. P. Draayer

Faculty Publications

We introduce a shell-model theory that combines traditional spherical states, which yield a diagonal representation of the usual single-particle interaction, with collective configurations that track deformations, and test the validity of this mixed-mode, oblique-basis shell-model scheme on [Formula Presented] The correct binding energy (within 2% of the full-space result) as well as low-energy configurations that have greater than 90% overlap with full-space results are obtained in a space that spans less than 10% of the full space. The results suggest that a mixed-mode shell-model theory may be useful in situations where competing degrees of freedom dominate the dynamics and full-space …

A Cross-Firm Analysis Of The Impact Of Corporate Governance On The East Asian Financial Crisis, Todd Mitton Jan 2002

A Cross-Firm Analysis Of The Impact Of Corporate Governance On The East Asian Financial Crisis, Todd Mitton

Faculty Publications

In a sample of 398 firms from Indonesia, Korea, Malaysia, the Philippines, and Thailand, firm-level differences in variables related to corporate governance had a strong impact on firm performance duringthe East Asian financial crisis of 1997–1998. Significantly better stock price performance is associated with firms that had indicators of higher disclosure quality (ADRs and auditors from Big Six accounting firms), with firms that had higher outside ownership concentration, and with firms that were focused rather than diversified. The results suggest that individual firms have some power to preclude expropriation of minority shareholders if legal protection is inadequate.

The Youngs At West Point, J. Michael Hunter Jan 2002

The Youngs At West Point, J. Michael Hunter

Faculty Publications

In 1871, Willard Young, eleventh son of Brigham Young, was the first Mormon to receive an appointment to West Point Academy. His attendance at the military academy drew national attention and criticism from opponents of polygamy. Despite the opposition, he soon gained the respect of his classmates and graduated fourth in his class. He returned to teach engineering in 1879, served in the Spanish-American War, earning a commendation from President McKinley, and during World War I was supervisor of army engineering work on the Missouri River. In 1877, one of Brigham's grandsons, Richard W. Young, was the second Mormon to …
