La /S/ Hipercorrecta En Las Noticias Dominicanas, Orlando Alba

Faculty Publications

Tort Law Inside Out, Cristina Carmody Tilley Mar 2017

Tort Law Inside Out, Cristina Carmody Tilley

Faculty Publications

For more than a century, scholars have been looking at tort law from the outside in. Theorists committed to external goals like efficient allocation of resources or moral justice have treated tort as a mere vehicle for the achievement of their policy preferences, rather than as a body of law with a discernible internal purpose. It is time to revisit tort on its own terms.

This Article takes its cue from the New Doctrinalists, who urge that extralegal normative insights from fields such as economics or philosophy aid adjudication only when they are directly tethered to legal concepts; that is, …

The Jurisdiction Canon, Aaron-Andrew P. Bruhl Mar 2017

The Jurisdiction Canon, Aaron-Andrew P. Bruhl

Faculty Publications

This Article concerns the interpretation of jurisdictional statutes. The fundamental postulate of the law of the federal courts is that the federal courts are courts of limited subject-matter jurisdiction. That principle is reinforced by a canon of statutory interpretation according to which statutes conferring federal subject-matter jurisdiction are to be construed narrowly, with ambiguities resolved against the availability of federal jurisdiction. This interpretive canon is over a century old and has been recited in thousands of federal cases, but its future has become uncertain. The Supreme Court recently stated that the canon does not apply to many of today’s most …

Understanding The Abrahamic Covenant Through The Book Of Mormon, Noel B. Reynolds Mar 2017

Understanding The Abrahamic Covenant Through The Book Of Mormon, Noel B. Reynolds

Faculty Publications

Interpretation of God's covenant to Abrahamic and its promised fulfillment varies across scholarly and religious writings. The Book of Mormon emphasizes this covenant and the promise that through Abraham all the kindreds of the earth will be blessed. It also features a unique interpretation--that the covenant will be fulfilled as the Book of Mormon itself, a record of the seed of Joseph, is given first to the Gentiles, and then to house of Israel.

On Doubting Nephi's Break Between 1 And 2 Nephi: A Critique Of Joseph Spencer's "An Other Testament: On Typology", Noel B. Reynolds

Faculty Publications

This essay rejects the proposal by Joseph Spencer to recognize the true break in Nephi's two books as occurring after the fifth chapter of the second book. The essay invokes standard interpretive practices arguing that while Spencer does present reasoning to make sense of this novel proposal, he does not acknowledge the much greater weight of standard interpretation or provide explanations for ignoring it.

The Lord Of The Wedding Ring: J.R.R. Tolkien’S True Love, Jason B. Whiting Feb 2017

The Lord Of The Wedding Ring: J.R.R. Tolkien’S True Love, Jason B. Whiting

Faculty Publications

John Ronald Reuel Tolkien is known worldwide for his fantastic characters and creations. His hobbits, dwarves, elves and warriors have changed the face of literature and culture. As a boy, he had unusual interests. He loved reading mythology, playing chess, drawing fierce dragons, and by age 9, young Ronald (as he was usually called) had invented several languages. Well-known is Tolkien’s prodigious geek cred, but less known is that he was a hopeless romantic.

How "Come Unto Me" Fits In The Nephite Gospel", Noel B. Reynolds Feb 2017

How "Come Unto Me" Fits In The Nephite Gospel", Noel B. Reynolds

Faculty Publications

Book of Mormon readers can easily be left wondering in numerous passages where the repeated term "come unto me/him/Christ" refers to unspecified elements of the gospel understood as "the way" by which men and women can come to him. This paper identifies six passages that are presented as quotations from Jesus himself and that have identical rhetorical structures---in which this phrase appears to refer each time to that stage of the gospel described as "enduring to the end." This discovery may offer useful interpretive guidance for the numerous other passages that invoke the same phrase. This paper was updated June …

Norms Of Valence And Arousal For 14,031 Spanish Words, Hans Stadthagen-Gonzalez, Constance Imbault, Miguel A. Pérez Sánchez, Marc Brysbaert Feb 2017

Norms Of Valence And Arousal For 14,031 Spanish Words, Hans Stadthagen-Gonzalez, Constance Imbault, Miguel A. Pérez Sánchez, Marc Brysbaert

Faculty Publications

Most current models of research on emotion recognize valence (how pleasant a stimulus is) and arousal (the level of activation or intensity that a stimulus elicits) as important components in the classification of affective experiences (Barrett, 1998; Kuppens, Tuerlinckx, Russell, & Barrett, 2012). Here we present a set of norms for valence and arousal for a very large set of Spanish words, including items from a variety of frequencies, semantic categories, and parts of speech, including a subset of conjugated verbs. In this regard, we found that there were significant but very small differences between the ratings for conjugations of …

Combined Aphasia And Apraxia Of Speech Treatment (Caast): Systematic Replications In The Development Of A Novel Treatment, Julie L. Wambaugh, Sandra Wright, Shannon C. Mauszycki, Christina Nessler, Dallin Bailey

Faculty Publications

Purpose: The purpose of this investigation was to examine the effects of a modified version of a newly developed therapy for aphasia and acquired apraxia of speech (AOS), Combined Aphasia and Apraxia of Speech Treatment (CAAST).

Method: Four speakers with chronic AOS and aphasia received CAAST in the context of multiple baseline designs. Dependent variables included language measures (i.e. production of correct information units (CIUs)) and speech production measures (i.e. speech intelligibility and percent correct consonants (PCC) in sentence repetition).

Result: Three of the participants demonstrated improved CIU production with treated picture sets and two also demonstrated generalization to untreated …

Rethinking Mono-Sensory, Implicational Approaches To Ideophones In Pastaza Quichua, Janis B. Nuckolls, Sydney Jensen, Emily Peterson, Matthew Millar

Faculty Publications

This paper will evaluate a claim about a possible areal bias for the semantic typolgies of ideohone systems. According to this claim, ideophone systems of the Americas are mainly dedicatied to encoding sound and motion, while for Africa and Asia, they cover a broader range of sensory imagery , including visual patterns, textures, and cognitive states. Additionally, and implicational hieracry for ideophone systems' se,amtics has been posted. We demonstrate with data from Pasta Quichua, that ideophones' semantics span the full range of senory and cognitive possibilities. Further, the mono-sensory schematization of ideophones' semantics make the implicational hierarchy problematic as presently …

Black Activist Mothering: Teach Me About What Teaches You, Jacqueline Roebuck Sakho- Jan 2017

Black Activist Mothering: Teach Me About What Teaches You, Jacqueline Roebuck Sakho-

Faculty Publications

This work defines Black activist mothering as a position of strength, courage, and brilliance that requires being in conversation with elders in order to make meaning of the present. Told as a conversation between the elders, the author enacts important cultural traditions that demonstrate the significance of intergenerational conversations in the process of becoming a mother, an activist, and an educational leader. The theoretical framework bridges the gap between Black mothering, leadership, and narrative all the while addressing educational inequities without compromising identity, culture, and womanhood. In the end, the piece demonstrates the author’s ability to move in and out …

Working With Latinos In Rural Communities: “Nuts And Bolts”, Wilma Cordova, Aparecida De Fatima Cordeiro Dutra Jan 2017

Working With Latinos In Rural Communities: “Nuts And Bolts”, Wilma Cordova, Aparecida De Fatima Cordeiro Dutra

Faculty Publications

Latinos currently compromise 16% of the entire U.S. population and 9.3% live in rural areas ((U.S. Census, 2010). These current percentages indicate that most social workers will work with this population at least once during their careers. Therefore, it is important that social workers develop skills and knowledge to work effectively with Latinos. Working with Latinos in our current sociopolitical climate poses many challenges for social workers working in rural areas. However, if social workers adhere to the guidelines and standards initially established by the profession and implement best practices many of their efforts will be successful. This chapter aims …

Impact Of Reviewer Social Interaction On Online Consumer Review Fraud Detection, Kunal Goswami, Younghee Park, Chungsik Song Jan 2017

Impact Of Reviewer Social Interaction On Online Consumer Review Fraud Detection, Kunal Goswami, Younghee Park, Chungsik Song

Faculty Publications

Background Online consumer reviews have become a baseline for new consumers to try out a business or a new product. The reviews provide a quick look into the application and experience of the business/product and market it to new customers. However, some businesses or reviewers use these reviews to spread fake information about the business/product. The fake information can be used to promote a relatively average product/business or can be used to malign their competition. This activity is known as reviewer fraud or opinion spam. The paper proposes a feature set, capturing the user social interaction behavior to identify fraud. …

The Intersections Of Africana Studies And Curriculum Theory: An Exploration, Theodorea Regina Berry Jan 2017

The Intersections Of Africana Studies And Curriculum Theory: An Exploration, Theodorea Regina Berry

Faculty Publications

There has been much critique of globalization now circulating in curriculum studies both nationally, in the United States, and internationally, helps us understand some of the lethal effects of globalization. Nevertheless, little of such critique is grounded in a strong commitment to work beyond the Western epistemological perimeter. While we, as reconceptualists in curriculum studies, acknowledge the necessity to honor the multiple sources and perspectives of knowledge, we continue to operate in spaces and with intentions embedded in globalized, traditional notions of curriculum. This problem is especially heightened for socially marginalized learners, particularly Black/African American learners.

In this article, I …

Anti-Bias Or Not: A Case Study Of Two Early Childhood Educators, Flora Farago Jan 2017

Anti-Bias Or Not: A Case Study Of Two Early Childhood Educators, Flora Farago

Faculty Publications

This work examines anti-bias teaching practices through a case study of two early childhood educators working in classrooms with 4- to 5-year-old children. The educators self-identified that they intentionally addressed diversity in their classrooms using the anti-bias curricular approach (Derman-Sparks & the ABC Task Force, 1989). Specifically, the study explored how early childhood educators used anti-bias practices, and how educators discussed race and gender with young children. The methodology involved semi-structured interviews, naturalistic observations of educator-child interactions, and a survey of educators’ beliefs and classroom practices regarding race and gender. Findings indicated that educators felt more comfortable and skilled at …

Measurement Of Transformative Learning In Study Abroad: An Application Of The Learning Activities Survey, Garrett A. Stone, Mat D. Duerden, Lauren N. Duffy, Brian J. Hill, Eva M. Witesman

Faculty Publications

Study abroad research has demonstrated that education abroad provides a host of benefits; however, it is still unclear how and to what extent these benefits occur. The present study aims to elucidate the study abroad learning process, especially as it pertains to the outcome of transformative learning. First, the study introduces the Learning Activities Survey (LAS), an instrument that operationalizes and quantitatively measures transformative learning constructs. Second, the study demonstrates the utility of the LAS for tourism educators, using data collected from students enrolled in the school of management at a private northwestern university. Results confirm that transformative learning occurs …

Embodied Conversational Agent-Based Deception Detection, Aaron C. Elkins, Jeffrey G. Proudfoot, Nathan Twyman, Judee K. Burgoon, Jay F. Nunamaker Jr.

Faculty Publications

An Embodied Conversational Agent-based human deception detection system was tested in a laboratory experiment during which some subjects had committed a mock crime and had guilty knowledge of that crime. Sensor signals were analyzed for their ability to discriminate between guilty/deceptive and innocent/truthful examinees and suitability for conducting automated agent-based deception interviews. Electrodermal activity confirmed the presence of arousal during the agent-based interviews.

The Higher-Ed Organizational-Scholar Tension: How Scholarship Compatibility And The Alignment Of Organizational And Faculty Skills, Values And Support Affects Scholar’S Performance And Well-Being, Milagros Pereyra-Rojas, Enrique Mu, James Gaskin, Tony Lingham Jan 2017

The Higher-Ed Organizational-Scholar Tension: How Scholarship Compatibility And The Alignment Of Organizational And Faculty Skills, Values And Support Affects Scholar’S Performance And Well-Being, Milagros Pereyra-Rojas, Enrique Mu, James Gaskin, Tony Lingham

Scholars and institutions alike are concerned with academic productivity. Scholars not only further knowledge in their professional fields, they also bring visibility and prestige to themselves and their institutions, which in turn attracts research grants and more qualified faculty and graduate students. Many studies have been done on scholar productivity, and many of them focus on individual factors such as gender, marital status, and individual psychological characteristics. Also, a few studies are concerned about scholars’ well-being. We propose a causal model that considers the compatibility of the scholarship dimensions valued by scholars and institutions and their academic alignment with actual …

Structural Covariance Of Sensory Networks, The Cerebellum, And Amygdala In Autism Spectrum Disorder, Garrett Cardon, Susan Hepburn, Donald C. Rojas Jan 2017

Structural Covariance Of Sensory Networks, The Cerebellum, And Amygdala In Autism Spectrum Disorder, Garrett Cardon, Susan Hepburn, Donald C. Rojas

Faculty Publications

Sensory dysfunction is a core symptom of autism spectrum disorder (ASD), and abnormalities with sensory responsivity and processing can be extremely debilitating to ASD patients and their families. However, relatively little is known about the underlying neuroanatomical and neurophysiological factors that lead to sensory abnormalities in ASD. Investigation into these aspects of ASD could lead to significant advancements in our general knowledge about ASD, as well as provide targets for treatment and inform diagnostic procedures. Thus, the current study aimed to measure the covariation of volumes of brain structures (i.e., structural magnetic resonance imaging) that may be involved in abnormal …

Introduction: Individuals with idiopathic subglottic stenosis (SGS) are at risk for voice disorders prior to and following surgical management. This study examined the nature and severity of voice disorders in patients with SGS before and after a revised cricotracheal resection (CTR) procedure designed to minimize adverse effects on voice function. Method: Eleven women with idiopathic SGS provided presurgical and postsurgical audio recordings. Voice Handicap Index (VHI) scores were also collected. Cepstral, signal-to-noise, periodicity, and fundamental frequency (F0) analyses wereundertaken for connected speech and sustained vowel samples. Listeners made auditory-perceptual ratings of overall qualityand monotonicity. Results: Paired samples statistical analyses revealed that …

Language Of Intervention In Bilingual Children With Autism Spectrum Disorders, Connie Summers, Vanessa Smith, Vannesa Mueller, Victoria Alexander, Amelie Muzza Jan 2017

Language Of Intervention In Bilingual Children With Autism Spectrum Disorders, Connie Summers, Vanessa Smith, Vannesa Mueller, Victoria Alexander, Amelie Muzza

Faculty Publications

Selecting the appropriate language of intervention for bilingual children with language impairment is difficult, especially for bilingual children with autism spectrum disorders (ASD) as their families are often encouraged by professionals to select one language only for communication. The limited evidence supports the use of bilingual language interventions when working with bilingual children with ASD. The current study sought to expand this limited work by presenting preliminary data of the effects of a bilingual and monolingual treatment condition on the language skills of two bilingual children with ASD (ages 3 and 5) using an alternating treatment, single-subject design. The two …

Wrongly Affirmed Without Opinion, Dennis D. Crouch Jan 2017

Wrongly Affirmed Without Opinion, Dennis D. Crouch

Faculty Publications

In his 1909 treatise on appellate jurisdiction, the future Justice Benjamin Cardozo explained the role of appellate courts - not simply "declaring justice between man and man, but . .. settling the law." In Justice Cardozo's view, the appellate courts exist "not for the individual litigant, but for the indefinite body of litigants, whose causes are potentially involved in the specific cause at issue." Justice Cardozo's vision more than a century ago still resonates, and precedential opinions form a mainstay of appellate court activity nationwide. However, one court of appeals is quite different from the rest. The Court of Appeals …

E. B. White Could Nod Too: Thoughts Occasioned By Reading “Death Of A Pig”, Erik M. Jensen Jan 2017

E. B. White Could Nod Too: Thoughts Occasioned By Reading “Death Of A Pig”, Erik M. Jensen

Faculty Publications

This is an essay on grammar and writing, with extended consideration of the value of Strunk & White as a guide. Although the essay defends Strunk & White against several of that volume’s strongest critics, it also illustrates that even the best writers—and E. B. White was terrific, as was Antonin Scalia—sometimes make mistakes. (At great, perhaps excessive, length, the essay dissects a problematic passage in White’s “Death of a Pig.”) We should learn from those mistakes, not accept them as inevitable.

Epistemological Matters Matter For Theological Understanding, Joseph F. Laporte Jan 2017

Epistemological Matters Matter For Theological Understanding, Joseph F. Laporte

Faculty Publications

This article leads the reader to appreciate some of the importance of philosophical epistemology, to the field of theology, by way of two fascinating philosophical topics. As it does so, it provides some development and clarification of two notions important in epistemology: first, rationality, and second, the distinction sometimes called the “propositional–experiential” distinction. The first is the more central to mainstream philosophy today. Since at least Plato, philosophers have asked: what is it to know something, or to be rational or right-headed, as opposed to kooky or gullible, in believing something? Christian philosophers have applied this study to the …

Between Description & Prescription: Law, Wittgenstein, And Constitutional Faith, Gregory Brazeal Jan 2017

Between Description & Prescription: Law, Wittgenstein, And Constitutional Faith, Gregory Brazeal

Faculty Publications

The occasions on which a judge or legal scholar has peered into the depths of the Constitution and found, to her surprise, that the Constitution requires the opposite of her ideological preferences, are extremely rare. Yet judges and scholars continue to present their conclusions as the product of ideologically neutral reasoning, while often criticizing the ideological bias in the reasoning of their opponents. A Wittgensteinian perspective on the nature of legal discourse can shed light on this puzzlingly persistent state of affairs. Legal discourse, including constitutional argument, is partly defined by the blending of descriptive reasoning about what the law …
