Notes On A Bicentennial Constitution, Part I: Processes Of Change, William W. Van Alstyne Oct 1984

Notes On A Bicentennial Constitution, Part I: Processes Of Change, William W. Van Alstyne

Faculty Publications

With the approach of the Bill of Rights bicentennial, this paper takes the cause for celebration as an equally important occasion for critique. This work argues that the most distinguishing aspects of our Constitution are not the Bill of Rights, federalism, and separation of powers, but rather the availability of judicial review, the political insulation of federal judges, and the limited mechanisms available for constitutional change.

Characterization Of Glycated Proteins By 13C Nmr Spectroscopy, Carolyn I. Neglia, Helga J. Cohen, Albert R. Garber, Suzanne R. Thorpe, John W. Baynes Sep 1984

Characterization Of Glycated Proteins By 13C Nmr Spectroscopy, Carolyn I. Neglia, Helga J. Cohen, Albert R. Garber, Suzanne R. Thorpe, John W. Baynes

Faculty Publications

13C NMR spectroscopy has been used to characterize Amadori (ketoamine) adducts formed by reaction of [2-13C]glucose with free amino groups of protein. The spectra of glycated proteins were acquired in phosphate buffer at pH 7.4 and were interpreted by reference to the spectra of model compounds, N alpha-formyl-N epsilon-fructose-lysine and glycated poly-L-lysine (GlcPLL). The anomeric carbon region of the spectrum (approximately 90-105 ppm) of glycated cytochrome c was superimposable on that of N alpha-formyl-N epsilon-fructose-lysine, and contained three peaks characteristic of the alpha- and beta-furanose and beta-pyranose anomers of Amadori adducts to peripheral lysine residues on protein (pK alpha approximately …

Administrative Law, Paul A. Lebel Jul 1984

Administrative Law, Paul A. Lebel

Faculty Publications

This survey of Eleventh Circuit administrative law decisions covers the law applicable to the administrative agencies, rather than the law applied by those agencies. The substantive law administered by the agencies is beyond the scope of this survey. The surveyed cases may be broken down into two major categories: decisions relating to administrative decisionmaking and decisions concerning judicial review of administrative actions.

Mediation Paradigms And Professional Identities: Can Mediators Activate A New Movement For Justice?, John M. Lande Jun 1984

Mediation Paradigms And Professional Identities: Can Mediators Activate A New Movement For Justice?, John M. Lande

Faculty Publications

This article, written early in the modern ADR era, provided a framework for developing the mediation field. It begins by elaborating William Simon’s critique of the “ideology of advocacy.” Simon argues that the adversary system is supposed to foster values of individuality, autonomy, responsibility, and dignity, but it often undermines those values in practice. This article catalogs a “parade of horribles” experienced by disputants, attorneys, judges, and the public. These include unequal access to justice, procedural rules that frustrate substantive justice, a narrow set of available remedies, a game psychology undermines respect for law and justice, parties’ alienating experience in …

Establishment Clause Limits On Governmental Interference With Religious Organizations, Carl H. Esbeck Apr 1984

Establishment Clause Limits On Governmental Interference With Religious Organizations, Carl H. Esbeck

Faculty Publications

In this article it will be argued that the establishment clause, properly viewed, functions as a structural provision regimenting the nature and degree of involvement between government and religious associations." The degree of involvement should be a limited one, although it is clear that the interrelationship need not nor cannot be eliminated altogether. Although the degree of desired separation has proven to be a continuing controversy, the goal of separation is not so divisive. The aim of separation of church and government is for each to give the other sufficient breathing space. The ordering principle is reciprocity in which "both …

Some Plant Leaves Have Orientation-Dependent Epr And Nmr Spectra, Douglas C. Mccain, Ted C. Selig, Govindjee, John L. Markley Feb 1984

Some Plant Leaves Have Orientation-Dependent Epr And Nmr Spectra, Douglas C. Mccain, Ted C. Selig, Govindjee, John L. Markley

Faculty Publications

Proton nuclear magnetic resonance (1H NMR) spectra of leaves from 50 plant species were obtained at a spectrometer frequency of 470 MHz. Water present in leaf samples gives rise to characteristic spectral patterns. Most species show only one broad 1H NMR peak; however, the leaves of some plants display complex, orientation-dependent spectra in which a common three-line pattern is discerned. The pattern varies with the angle between the leaf surface and the external magnetic field. Proton relaxation measurements show the presence of at least two water compartments in the leaves. The compartments are responsible for different components …

Recent Developments In Kansas Insurance Law: A Survey, Some Analysis, And Some Suggestions, Robert H. Jerry Ii

Faculty Publications

For most of us the "small world" of insurance law, as it reflects and responds to changes in the "larger world," is also becoming increasingly complex. Part I of this article discusses cases involving questions of contract formation and termination; Part II concerns issues involving the performance of obligations arising out of the insurance contract; Part III studies several cases involving the construction and interpretation of contract language; Part IV is devoted solely to automobile insurance issues; finally, Part V discusses a few detached ideas.

Religion And A Neutral State: Imperative Or Impossibility?, Carl H. Esbeck Jan 1984

Religion And A Neutral State: Imperative Or Impossibility?, Carl H. Esbeck

Faculty Publications

The thesis of this Article is that the myth-of-neutrality argument is partially right and partially wrong. For reasons of religious liberty, the state can and should avoid any involvement with matters of religious worship, and the propagation or inculcation of matters that comprise the very heart of one's belief concerning the nature and destiny of mankind. Conversely, the state cannot retreat from the regulation of certain conduct which is arguably immoral and still claim its neutrality concerning the rightness of the conduct. The very decision by the state to withdraw its regulation, leaving the morality of the conduct up to …

Who Volunteers For Adult Development Research? Research Findings And Practical Steps To Reach Low Volunteering Groups, Michael Todd, Keith E. Davis, Thomas P. Cafferty Jan 1984

Who Volunteers For Adult Development Research? Research Findings And Practical Steps To Reach Low Volunteering Groups, Michael Todd, Keith E. Davis, Thomas P. Cafferty

Faculty Publications

The present study is an attempt to determine volunteering bias in racial, gender, and age groups in an adult development study. Samples were drawn from three different types of organizations in the Columbia, South Carolina SMSA. Volunteering rates were calculated as a function of the number eligible to participate in three age groups: 1) young adult (aged 20-25); 2) middle adult (aged 40-45); and 3) old (aged 60-80). The middle group volunteered at a higher rate than the other two age groups, but this effect was restricted to the white sample. Women volunteered more readily than men, but not among …

The Three-Dimensional Structure Of Retinol-Binding Protein., M. E. Newcomer, T. A. Jones, J. Aqvist, J. Sundelin, U. Eriksson, L. Rask, P. A. Peterson

Faculty Publications

The complex of retinol with its carrier protein, retinol-binding protein (RBP) has been crystallized and its three-dimensional structure determined using X-ray crystallography. Its most striking feature is an eight-stranded up-and-down beta barrel core that completely encapsulates the retinol molecule. The retinol molecule lies along the axis of the barrel with the beta-ionone ring innermost and the tip of the isoprene tail close to the surface.

External Labelling Of Glycoproteins From First-Trimester Human Placental Microvilli, S. J. Fisher, M. S. Leitch, R. A. Laine Jan 1984

External Labelling Of Glycoproteins From First-Trimester Human Placental Microvilli, S. J. Fisher, M. S. Leitch, R. A. Laine

Faculty Publications

The brush-border glycoproteins of first-trimester human placentas were investigated by using two external labelling techniques: (1) sequential digestion with neuraminidase and galactose oxidase, followed by reduction with NaB3H4, which 3H-labels terminal galactose and galactosaminase residues; and (2) sequential treatment with periodate and NaB3H4, which 3H-terminal sialic acid residues. The labelling procedures were performed on intact tissue so that the results would more closely approximate the topography of the bursh border in vivo. The microvilli were isolated, subjected to sodium dodecyl sulphate/polyacrylamide-gel electrophoresis, and the [3H]glycoproteins detected by fluorography. Densitometer scans of the fluorograms of the [3H]galactoproteins showed that, under reducing …

Faculty Publications

A randomized, crossover trial was carried out on the effect of moderate sodium reduction on red-blood-cell sodium metabolism. The participants were healthy high school students (mean age = 16 years, n = 33). Changes in sodium-lithium countertransport and intracellular sodium concentration were evaluated 24 days after a decrease in dietary sodium from approximately 110 to 40 mEq per day. Dietary sodium restriction had no significant effect on either sodium-lithium countertransport or intracellular sodium concentration. © 1984 American Heart Association, Inc.
