After quickly outlining recent, legislation in the field of practice and pleading, this Article proceeds to a more detailed treatment of pertinent judicial developments. Several of the Supreme Court of Appeals' decisions merit close attention, principally Rakes v. Fulcher and Sullivan v. Little Hunting' Park, Inc. Recurrent in the discussion of the judicial opinions is concern not only with the announced law, but also with the manner of the announcement-concern, that is, with both the legal results and the legal craftsmanship. Organizationally, an attempt has been made to discuss the judicial material at the time of its "moment of truth" …

Instruction In College Freshman Composition. Final Report., Ross M. Jewell, John Cowley, Gerald Bisbey
Faculty Publications
The research attempted to determine whether or not there was any difference between the scores of two groups of juniors; both of which had no freshman composition instruction; but one of which (Group 1) had composition instruction in the junior year and the other (Group 2) had not. Three measures; COOP; CEEB; and a theme; were administered at the end of the sophomore year and again at the time when Group 1 completed the course. Comparisons were made between scores of the two groups; of the males of each group; and of the females of each group. Results are: (1) …

Foreign Studies; an elective course for junior and senior students; is a study of selected Asian cultures; including the nations of China; Japan; and India; and of African cultures; including the nations of Nigeria; Ethiopia; and the Democratic Republic of the Congo. Asia and Africa are studied from the American cultural viewpoint with emphasis upon the three concepts of culture; ideology; and the comparison of traditional and modern society. This teacher's guide is divided into four main sections. 1) An outline of content is presented from which many generalizations are developed. These generalizations provide the framework for the development of …

The equivocation which may result from violation of natural language or face I validity is manifested in an article by Faulkner and DeJong (1966), "Religiosity in 5-D: An Empirical Analysis." The authors (1966:246-247) claim to be measuring and testing the associations among Glock's (1962) five dimensions of religiosity. They adequately refer to his dimensions as "experiential (feeling, emotion), ritualistic (religious behavior, i.e., church attendance), ideological (beliefs), intellectual (knowledge), and consequential (the effects in the secular world of the prior four dimensions)." The empirical "definition" of the dimensions, however, is given by the items used to measure them. It cannot be …

This final report of a two-stage project describes an effort to determine whether students receiving instruction in freshman English composition perform better on standardized tests than students who do not receive similar instruction; when both groups are in college the same length of time. The second phase of the experiment detailed in the report involves 1;040 matched pairs of students from the University of Northern Iowa; the University of Iowa; Kent State University; the University of Colorado; and Northern Illinois University. Using the Cooperative English Tests: English Expression (COOP); the College Entrance Examination Board (CEEB) English Composition Test; and a …

Beginning with Justice Douglass's assertion that the State is bound in the same ways when acting as an employer as it is when acting as a governing body, this examination delves deeper to determine how this doctrine actually limits the government when it acts as an employer. This article endorses the theory of examining these limits not in the context of if the government is allowed to enforce them in the public sphere, but if the government may mandate such limits in the private sphere.

Dakota Civil Code: More Notes For An Uncelebrated Centennial, William B. Fisch

In an earlier article in this journal, I sketched and discussed the Dakota Civil Code as originally drafted for New York by David Dudley Field, the historical and conceptual background into which the work was cast, and some of the departures made in the Code from what appear to have been then generally accepted common law classifications, terminology and substantive rules. In this sequel I propose to consider the history of the Code after its completion in 1865 by Field's commission, concentrating on three jurisdictions: New York, where it was rejected after twenty-five years of wearying debate, amendment, parliamentary maneuver, …

The Demise Of The Right-Privilege Distinction In Constitutional Law, William W. Van Alstyne
The Demise Of The Right-Privilege Distinction In Constitutional Law, William W. Van Alstyne
Faculty Publications
The right-privilege distinction, as it appeared in an early statement by Justice Holmes, has long hampered individuals within the public sector in protecting themselves against arbitrary governmental action. In this article Professor Van Alstyne reviews the uses and misuses to which the "privilege" concept has been put and then examines those doctrines whose flanking attacks have gradually eroded its efficacy. But none of these doctrines comes to grips with Holmes' basic idea of a "privilege" to which substantive due process is inapplicable. Applying Holmes' own jurisprudence, the author argues that the concept of "privilege" is today no longer viable, and …

To supplement an experiment at the University of Northern Iowa on the effectiveness of college-level instruction in freshman composition; the University of Iowa conducted its own experiment on the evaluation of freshman composition. This experiment was designed to determine (1) which method of rating papers is more reliable--the "general impression" method of the Educational Testing Service or the "analytical" method used at the University of Iowa; (2) if a more significant measure of writing quality is obtained when the better of two papers; rather than merely one; is used as a criterion; and (3) if the writing performance of students …
