Co-Worker Evidence In Court, Sandra F. Sperino Oct 2020

Co-Worker Evidence In Court, Sandra F. Sperino

Faculty Publications

This symposium explores ways to empower workers. Many employment laws rely on workers filing private rights of action to enforce the underlying substantive law. Unfortunately, when workers file these claims in court, courts often do not allow them to rely on evidence from their co-workers. While courts regularly allow employers to submit co-worker evidence of a plaintiff's poor performance or lack of qualifications, they often diminish or exclude a plaintiff's co-worker evidence that the plaintiff performed well or possessed desired qualifications. This Article identifies and explores this evidentiary inequality. It argues that efforts to empower workers must include the power …

Distorted Drug Patents, Erika Lietzan Oct 2020

Distorted Drug Patents, Erika Lietzan

Faculty Publications

Drug patents are distorted. Unlike most other inventors, drug inventors must complete years of testing to the government’s specifications and seek government approval to commercialize their inventions. All the while, the patent term runs. When a drug inventor finally launches a medicine that embodies the invention, only a fraction of the patent life remains. And yet, conventional wisdom holds — and empirical studies show — that patent life is essential to innovation in the pharmaceutical industry, perhaps more so than any other inventive industry. Congress tried to do something about this in 1984, authorizing the Patent and Trademark Office to …

© 2020 Missouri Botanical Garden. All rights reserved. The Neotropics are the most species-rich area of the planet. Understanding the origin and maintenance of this diversity is an important goal of ecology and evolutionary biology. Success in this endeavor relies heavily on the past work of taxonomists who have collected specimens and produced the floras and monographs that constitute the foundation for the study of plant diversity. To illustrate this, we visualize collecting efforts through time and identify the importance of past taxonomic and collection efforts in generating the bulk of specimen data that broad-scale analyses rely on today. Secure High Der Penetration Power Distribution Via Autonomously Coordinated Volt/Var Control, Anto Joseph, Keyue Smedley, Shahab Mehraeen

Faculty Publications

Traditionally voltage control in distribution power system (DPS) is performed through voltage regulating devices (VRDs) including on load tap changers (OLTCs), step voltage regulators (SVRs), and switched capacitor banks (SCBs). The recent IEEE 1547-2018 from March 2018 requires inverter fed distributed energy resources (DERs) to contribute reactive power to support the grid voltage. To accommodate VAR from DERs, well-organized control algorithm is required to use in this mode to avoid grid oscillations and unintended switching operations of VRDs. This paper presents two voltage control strategies (i) static voltage control considering voltage-reactive power mode (IEEE 1547-2018), (ii) dynamic and extensive voltage …

Staying current on literature related to antimicrobial stewardship can be challenging given the ever-increasing number of published articles. The Southeastern Research Group Endeavor (SERGE-45) identified antimicrobial stewardship-related peer-reviewed literature that detailed an actionable intervention for 2019. The top 13 publications were selected using a modified Delphi technique. These manuscripts were reviewed to highlight the actionable intervention used by antimicrobial stewardship programs to provide key stewardship literature for teaching and training and to identify potential intervention opportunities within one's institution.

Cosmic rays arriving at Earth collide with the upper parts of the atmosphere, thereby inducing extensive air showers. When secondary particles from the cascade arrive at the ground, they are measured by surface detector arrays. We describe the methods applied to the measurements of the surface detector of the Pierre Auger Observatory to reconstruct events with zenith angles less than 60 using the timing and signal information recorded using the water-Cherenkov detector stations. In addition, we assess the accuracy of these methods in reconstructing the arrival directions of the primary cosmic ray particles and the sizes of the induced showers.

A Predictive Analytics Approach To Building A Decision Support System For Improving Graduation Rates At A Four-Year College, Xuan Wang, Helmut Schneider, Kenneth R. Walsh Oct 2020

A Predictive Analytics Approach To Building A Decision Support System For Improving Graduation Rates At A Four-Year College, Xuan Wang, Helmut Schneider, Kenneth R. Walsh

Faculty Publications

Although graduation rates have interested stakeholders, educational researchers, and policymakers for some time, little progress has been made on the overall graduation rate at four-year state colleges. Even though selective admission based on academic indicators such as high school GPA and ACT/ SAT have widely been used in the USA for years, and recent statistics show that less than 40% of students graduate from four-year state colleges in four years in the US. The authors propose using an ensemble of analytic models that considers cost as a better form of analysis that can be used as input to decision support …

Low-Income Energy Affordability In An Era Of U.S. Energy Abundance, Marilyn A. Brown, Anmol Soni, Melissa V. Lapsa, Katie Southworth, Matt Cox

Faculty Publications

In an era of U.S. energy abundance, the persistently high energy bills paid by low-income households is troubling. After decades of weatherization and bill-payment programs, low-income households still spend a higher percent of their income on electricity and gas bills than any other income group. Their energy burden is not declining, and it remains persistently high in particular geographies such as the South, rural America, and minority communities. As public agencies and utilities attempt to transition to a sustainable energy future, many of the programs that promote energy efficiency, rooftop solar, electric vehicles, and home batteries are largely inaccessible to …

Immoral Trademarks After Brunetti, Ned Snow Oct 2020

Immoral Trademarks After Brunetti, Ned Snow

Faculty Publications

For more than a century, marks that were vulgar, profane, and obscene could not receive trademark protection. In 2019, however, the Supreme Court in Iancu v. Brunetti invalidated the statutory provision that had prevented such marks from receiving protection—the bars to “immoral” and “scandalous” marks. Those bars violated the First Amendment because they enabled the government to judge whether ideas in marks were inappropriate. Similarly, two years prior to Brunetti, the Court in Matal v. Tam struck down a bar to marks that could “disparage” others. The Court reasoned that to disparage is to offend, and the ability to offend …

The Fourth Amendment At Home, Thomas P. Crocker Oct 2020

The Fourth Amendment At Home, Thomas P. Crocker

Faculty Publications

A refuge, a domain of personal privacy, and the seat of familial life, the home holds a special place in Fourth Amendment jurisprudence. Supreme Court opinions are replete with statements affirming the special status of the home. Fourth Amendment text places special emphasis on securing protections for the home in addition to persons, papers, and effects against unwarranted government intrusion. Beyond the Fourth Amendment, the home has a unique place within constitutional structure. The home receives privacy protections in addition to sheltering other constitutional values protected by the Due Process Clause and the First Amendment. For example, under the Due …

Geometric Analysis Of The Doppler Frequency For General Non-Stationary 3d Mobile-To-Mobile Channels Based On Prolate Spheroidal Coordinates, Michael Walter, Dmitriy Shutin, Martin Schmidhammer, David W. Matolak, Alenka Zajic Oct 2020

Geometric Analysis Of The Doppler Frequency For General Non-Stationary 3d Mobile-To-Mobile Channels Based On Prolate Spheroidal Coordinates, Michael Walter, Dmitriy Shutin, Martin Schmidhammer, David W. Matolak, Alenka Zajic

Faculty Publications

—Mobile-to-mobile channels often exhibit time-variant Doppler frequency shifts due to the movement of transmitter and receiver. An accurate description of the Doppler frequency turns out to be very difficult in Cartesian coordinates and any subsequent algebraic analysis of the Doppler frequency is intractable. In contrast to other approaches, we base our investigation on a geometric description of the Doppler frequency with the following three mathematical pillars: prolate spheroidal coordinate system, algebraic curve theory, and differential forms. The prolate spheroidal coordinate system is more appropriate to algebraically investigate the problem. After the transformation into the new coordinate system, the theory of …

Early Breastfeeding Practices Contribute To Exclusive Breastfeeding In Bangladesh, Vietnam And Ethiopia, Phuong Hong Nguyen, Sunny S. Kim, Lan Mai Tran, Purnima Menon, Edward A. Frongillo Jr.

Faculty Publications

Limited evidence exists on the complex relationship among interventions, early initiation of breastfeeding (EIBF), prelacteal feeding and exclusive breastfeeding (EBF). We examined whether early breastfeeding practices are associated with EBF and how much improving EIBF and non-prelacteal feeding contributes to increased prevalence of EBF. Survey data were collected in 2010 and 2014 as part of impact evaluations of Alive & Thrive (A&T) interventions to improve infant and young child feeding (IYCF) practices in Bangladesh, Vietnam and Ethiopia. Multivariable logistic regression analyses were used to examine effects of interventions and early breastfeeding practices on EBF. Structural equation modelling quantified the direct …

End-To-End Direct Digital Synthesis Simulation And Mathematical Model To Minimize Quantization Effects Of Digital Signal Generation, Pranav R. Patel, Richard K. Martin

Faculty Publications

Direct digital synthesis (DDS) architectures are becoming more prevalent as modern digital-to-analog converter (DAC) and programmable logic devices evolve to support higher bandwidths. The DDS architecture provides the benefit of digital control but at a cost of generating spurious content in the spectrum. The generated spurious content may cause intermodulation distortion preventing proper demodulation of the received signal. The distortion may also interfere with the neighboring frequency bands. This article presents the various DDS architectures and explores the DDS architecture which provides the most digital reconfigurability with the lowest spurious content. End-to-end analytical equations, numerical and mathematical models are developed …

No Mow May Lawns Have Higher Pollinator Richness And Abundances: An Engaged Community Provides Floral Resources For Pollinators, Relena R. Ribbons, Israel Del Toro

Faculty Publications

No Mow May is a community science initiative popularized in recent years that encourages property owners to limit their lawn mowing practices during the month of May. The goal of No Mow May is to provide early season foraging resources for pollinators that emerge in the spring, especially in urban landscapes when few floral resources are available. We worked with the city council of Appleton, Wisconsin, USA. to allow No Mow May to take place in May 2020. Four hundred and thirty-five property owners registered for No Mow May in Appleton. We measured floral and bee richness and abundance in …

The Development, Design, And Implementation Of A Library Assessment Framework, Holt Zaugg Sep 2020

The Development, Design, And Implementation Of A Library Assessment Framework, Holt Zaugg

Faculty Publications

Common in the language and actions of libraries is the desire to develop and foster a culture of assessment and evaluation. However, most employees in a library have had limited or no experience in designing, conducting, analyzing, and disseminating library assessments. Those who do have experience tend to draw from their personal discipline background that emphasizes one type of method over another. Typically, when these assessments happen, the efforts are one-off or siloed assessments. To create and foster a culture of assessment a framework is needed to guide and support all library assessments. A library assessment framework helps library employees …

Exploring Parents’ Ongoing Role In Romantic Development: Insights From Young Adults, Tyler B. Jamison, Hung Yuan Lo Sep 2020

Exploring Parents’ Ongoing Role In Romantic Development: Insights From Young Adults, Tyler B. Jamison, Hung Yuan Lo

Faculty Publications

Important decisions about romantic relationships are often made during adulthood, but the foundations for healthy relationships begin during childhood. Romantic development is related to experiences in the family of origin such as parenting, parents’ romantic history, and patterns of interaction within families. In order to better understand how this process unfolds into adulthood, we used relationship history interviews from 35 young adults (ages 24–40) to explore the mechanisms through which parents influence their children’s romantic development. We used Applied Thematic Analysis to guide our secondary analysis of relationship histories data. The findings suggest adult children internalize and apply the examples …

Zika Virus Infection Causes Widespread Damage To The Inner Ear, Kathleen T. Yee, Biswas Neupane, Fengwei Bai, Douglas E. Vetter

Faculty Publications

Zika virus (ZIKV) has been recently recognized as a causative agent of newborn microcephaly, as well as other neurological consequences. A less well recognized comorbidity of prenatal ZIKV infection is hearing loss, but cases of hearing impairment following adult ZIKV infection have also been recognized. Diminished hearing following prenatal ZIKV infection in a mouse model has been reported, but no cellular consequences were observed. We examined the effects of ZIKV infection on inner ear cellular integrity and expression levels of various proteins important for cochlear function in type I interferon receptor null (Ifnar1−/−) mice following infection at …

What We’Ve Managed To Transcribe Thus Far: Lessons From The Blythe Owen Letter Transcription Project, Marianne Kordas

Faculty Publications

In 2016, the music librarian at Andrews University in Berrien Springs, MI launched a project to transcribe approximately 2,000 by twentieth-century American composer Blythe Owen into typed, keyword-searchable documents. The goal of the transcription project is to make these letters more accessible beyond their current archival setting, and thereby lay the foundation for further inquiry into Owen, her works, and the people she knew – among them pianist and pedagogue Rudolf Ganz, African-American composer Florence Price, and composition teacher Nadia Boulanger. Managing such a large project has proven challenging, but worth the effort. This article describes the methodology, successes, challenges, …

Quantum-Limited Squeezed Light Detection With A Camera, Elisha S. Matekole, Savannah L. Cuozzo, Nikunjkumar Prajapati, Narayan Bhusal, Hwang Lee, Irina Novikova, Eugeniy E. Mikhailov, Jonathan P. Dowling, Lior Cohen Sep 2020

Quantum-Limited Squeezed Light Detection With A Camera, Elisha S. Matekole, Savannah L. Cuozzo, Nikunjkumar Prajapati, Narayan Bhusal, Hwang Lee, Irina Novikova, Eugeniy E. Mikhailov, Jonathan P. Dowling, Lior Cohen

Faculty Publications

We present a technique for squeezed light detection based on direct imaging of the displaced-squeezed-vacuum state using a CCD camera. We show that the squeezing parameter can be accurately estimated using only the first two moments of the recorded pixel-to-pixel photon fluctuation statistics, with accuracy that rivals that of the standard squeezing detection methods such as a balanced homodyne detection. Finally, we numerically simulate the camera operation, reproducing the noisy experimental results with low signal samplings and confirming the theory with high signal samplings.

Young Adults' Short-Term Trajectories Of Moderate Physical Activity: Relations With Self-Evaluation Processes, Alex .. Garn, Kelly L. Simonton Sep 2020

Young Adults' Short-Term Trajectories Of Moderate Physical Activity: Relations With Self-Evaluation Processes, Alex .. Garn, Kelly L. Simonton

Faculty Publications

Young adults face numerous barriers that can undermine their engagement in healthy behaviors. For example, young adults on average experience disproportionally large declines in physical activity (PA) participation compared to other demographic groups. Self-evaluation processes may help explain these declines. This study investigated young adults' weekly trajectories of moderate physical activity, exploring self-evaluation processes, including self-efficacy and shame as time-varying covariates. A total of 71 young adults (Mage = 21.25,SD= 1.18; 55% male) reported moderate physical activity, exercise self-efficacy, and anticipated shame toward exercise once a week for 5 weeks. Latent growth curve models showed that a linear slope fit …

Machine Intelligence For Nerve Conduit Design And Production, Caleb E. Stewart, Chin Fung Kelvin Kan, Brody R. Stewart, Henry W. Sanicola Iii, Jangwook P. Jung, Olawale A. R. Sulaiman, Dadong Wang

Faculty Publications

Nerve guidance conduits (NGCs) have emerged from recent advances within tissue engineering as a promising alternative to autografts for peripheral nerve repair. NGCs are tubular structures with engineered biomaterials, which guide axonal regeneration from the injured proximal nerve to the distal stump. NGC design can synergistically combine multiple properties to enhance proliferation of stem and neuronal cells, improve nerve migration, attenuate inflammation and reduce scar tissue formation. The aim of most laboratories fabricating NGCs is the development of an automated process that incorporates patient-specific features and complex tissue blueprints (e.g. neurovascular conduit) that serve as the basis for more complicated …
