อากาศยานไร้คนขับ (Unmanned Aerial Vehicle หรือ “UAV”) เป็นเครื่องมือสิ่งประดิษฐ์ชนิดใหม่ที่ถูกนำมาใช้ในงานกิจการด้านต่างๆ ไม่ว่าจะเป็นการใช้งานของรัฐบาล การใช้งานเชิงพาณิชย์ รวมถึงการใช้งานส่วนบุคคล ซึ่งอากาศยานไร้คนขับโดยส่วนใหญ่จะมีการติดตั้งกล้องที่มีความคมชัดสูง หรืออุปกรณ์รวบรวมข้อมูลอื่นๆ ไว้ ทำให้ลักษณะของการใช้งานอากาศยานไร้คนขับซึ่งบินในมุมสูงในแต่ละครั้ง อาจถูกนำไปใช้เป็นเครื่องมือในการละเมิดความเป็นส่วนตัว และก่อให้เกิดความเสียหายต่อสิทธิความเป็นส่วนตัวของบุคคลอื่นได้ ปัญหาที่เกิดขึ้นจากการใช้อากาศยานไร้คนขับส่วนบุคคลนั้น ได้แก่ การใช้อากาศยานไร้คนขับรุกล้ำพื้นที่ส่วนบุคคล และการใช้อากาศยานไร้คนขับเป็นเครื่องมือในการถ้ำมอง รวมถึงการแอบถ่าย สอดแนม และการละเมิดความเป็นส่วนตัวอื่นๆ โดยอากาศยานไร้คนขับนั้นอาจถูกนำมาใช้โดยผิดวัตถุประสงค์ ด้วยเหตุนี้จึงต้องพิจารณาถึงปัญหาจากการใช้อากาศยานไร้คนขับในการละเมิดความเป็นส่วนตัว เช่น การบุกรุกโดยอากาศยานไร้คนขับ (Trespass by UAV) การใช้อากาศยานไร้คนขับในการถ้ำมอง (Voyeurism) การใช้อากาศยานไร้คนขับในการสอดแนม (Spying) หรือติดตามบุคคลอื่น (Stalking) เป็นต้น วิทยานิพนธ์เล่มนี้จะศึกษาถึงแนวทางการกำหนดความรับผิดทางอาญาจากการละเมิดความเป็นส่วนตัวโดยอากาศยานไร้คนขับ ซึ่งแบ่งการพิจารณาออกเป็นสามประเด็น ได้แก่ การบุกรุกโดยอากาศยานไร้คนขับ การถ้ำมองโดยอากาศยานไร้คนขับ และการละเมิดความเป็นส่วนตัวโดยอากาศยานไร้คนขับ โดยวิเคราะห์ถึงปัญหาการบังคับใช้กฎหมายไทยกับการใช้อากาศยานไร้คนขับในการละเมิดความเป็นส่วนตัว และศึกษากฎหมายเกี่ยวกับการใช้อากาศยานไร้คนขับในการละเมิดความเป็นส่วนตัวในต่างประเทศ ซึ่งได้แก่ สหรัฐอเมริกา จำนวน 5 มลรัฐ ได้แก่ มลรัฐเทนเนสซี มลรัฐมิสซิสซิปปี มลรัฐแคลิฟอร์เนีย มลรัฐหลุยเซียนา และมลรัฐโรดไอแลนด์ เพื่อหาแนวทางคุ้มครองความเป็นส่วนตัวที่เหมาะสมจากการใช้อากาศยานไร้คนขับ

วิทยานิพนธ์นี้มุ่งศึกษาแนวคำตัดสินขององค์การการค้าโลกในประเด็นความหมายของคำว่า Public Body ตามข้อ 1.1 (a)(1) ของความตกลงว่าด้วยการอุดหนุนและมาตรการตอบโต้ (WTO Agreement on Subsidies and Countervailing Measures) เนื่องจากความตกลงดังกล่าวไม่ได้กำหนดความหมายของถ้อยคำดังกล่าวเอาไว้ ตลอดจนศึกษาถึงกรณีปัญหาที่เกี่ยวข้องกับเรื่องดังกล่าวโดยเฉพาะในคดี US – Anti-Dumping and Countervailing Duties (China) ซึ่งมีประเด็นทางกฎหมายที่ต้องวินิจฉัยว่า รัฐวิสาหกิจจีนที่ได้ให้การอุดหนุนเป็น Public Body ตามข้อ 1.1 (a)(1) ของความตกลงดังกล่าวหรือไม่ จากการศึกษาพบว่า แนวคำตัดสินของ WTO ที่นำมาปรับใช้กับการวินิจฉัยกรณีดังกล่าวข้างต้นคือหลัก Government Authority Approach ที่นิยามคำว่า Public Body เอาไว้ว่าหมายถึง หน่วยงานที่มีอำนาจรัฐ และมีการใช้อำนาจรัฐ ทั้งนี้ แม้ว่าหลักดังกล่าวจะสามารถนำมาปรับใช้กับปัญหาการอุดหนุนโดยรัฐวิสาหกิจจีนได้อยู่บ้างคือกรณีการอุดหนุนโดยธนาคารพาณิชย์ของรัฐของจีนก็ตาม แต่ก็ยังไม่ครอบคลุมถึงกรณีปัญหาการอุดหนุนโดยรัฐวิสาหกิจจีนในกลุ่มทุนเข้มข้น (Capital Intensive State-Owned Enterprise) บางกลุ่ม เนื่องจากไม่มีหลักฐานที่ชัดเจนและมีเหตุผลเพียงพอที่สะท้อนให้เห็นว่ารัฐได้ใช้อำนาจรัฐเหนือการกระทำของหน่วยงานดังกล่าว จึงทำให้หน่วยงานดังกล่าวไม่เป็น Public Body ซึ่งทำให้มาตรการที่ใช้โดยรัฐวิสาหกิจจีนดังกล่าวไม่อยู่ในข่ายที่จะถูกตอบโต้ได้

วิทยานิพนธ์ฉบับนี้มีวัตถุประสงค์เพื่อศึกษาความเหมาะสมของการนำข้อสันนิษฐานแห่งการทุจริตมาใช้บังคับกับความผิดเกี่ยวกับเจ้าพนักงานตามประมวลกฎหมายอาญา โดยศึกษาแนวคิดและความผิดเกี่ยวกับสินบนและข้อสันนิษฐานแห่งการทุจริตในประเทศไทยและต่างประเทศ เพื่อให้ได้มาซึ่งข้อเสนอแนะในการแก้ไขเพิ่มเติมความผิดเกี่ยวกับเจ้าพนักงานตามประมวลกฎหมายอาญาของประเทศไทยและมาตรการในการคุ้มครองสิทธิและเสรีภาพของผู้ต้องหาหรือจำเลยจากข้อสันนิษฐาน ในคดีอาญา ผู้ต้องหาหรือจำเลยจะต้องถูกสันนิษฐานไว้ก่อนว่าบริสุทธิ์จนกว่าจะพิสูจน์จนสิ้นสงสัยตามสมควรว่า เขาเป็นผู้กระทำความผิดจริงตามหลักการสันนิษฐานไว้ก่อนว่าบุคคลบริสุทธิ์ แต่สำหรับความผิดเกี่ยวกับสินบนที่สร้างความเสียหายแก่สังคมอย่างร้ายแรงและมีความสลับซับซ้อน การยึดถือหลักการดังกล่าวอย่างเคร่งครัดอาจส่งผลให้ผู้กระทำความผิดอาศัยประโยชน์แห่งความสงสัยตามสมควรหลุดพ้นไปจากเงื้อมมือของกระบวนการยุติธรรมได้ การนำข้อสันนิษฐานแห่งการทุจริตที่ผลักภาระการพิสูจน์จากโจทก์ไปตกแก่จำเลย ย่อมสามารถเพิ่มประสิทธิภาพในการป้องกันและปราบปรามความผิดเกี่ยวกับสินบน และเป็นมาตรการทางกฎหมายที่สามารถนำมาปรับใช้กับประเทศไทยได้โดยไม่ขัดหรือแย้งต่อรัฐธรรมนูญ ดังนั้นประเทศไทยจึงควรนำข้อสันนิษฐานแห่งการทุจริตมาใช้กับความผิดเกี่ยวกับเจ้าพนักงานตามประมวลกฎหมายอาญา ควรแก้ไขเพิ่มเติมประมวลกฎหมายอาญา และควรกำหนดมาตรการในการคุ้มครองสิทธิและเสรีภาพของผู้ต้องหาหรือจำเลยจากข้อสันนิษฐาน เพื่อให้ประเทศไทยสามารถป้องกันและปราบปรามความผิดเกี่ยวกับสินบนและสามารถคุ้มครองสิทธิเสรีภาพของผู้ต้องหาหรือจำเลยได้ในขณะเดียวกัน

สัญญาอนุญาตให้ใช้สิทธิในโปรแกรมคอมพิวเตอร์ ซึ่งเป็นสัญญาประเภทหนึ่งซึ่งมักที่มีก่อให้เกิดประเด็นปัญหาจากการที่ไม่มีกฎหมายกำหนดสิทธิหน้าที่ตามสัญญาไว้อย่างชัดเจน เนื่องจากสัญญาอนุญาตให้ใช้สิทธิในโปรแกรมคอมพิวเตอร์มักมีลักษณะเป็นสัญญาแบบมาตราฐานที่คู่สัญญาฝ่ายผู้อนุญาตให้ใช้สิทธิสามารถกำหนดเนื้อหาของสัญญาได้โดยฝ่ายผู้รับอนุญาตไม่มีอำนาจต่อรอง การกำหนดสิทธิหน้าที่ของคู่สัญญาโดยอาศัยเพียงข้อสัญญาที่เป็นลายลักษณ์อักษรรจึงอาจก่อให้เกิดความไม่เป็นธรรม และนอกจากนี้สัญญาอนุญาตให้ใช้สิทธิในโปรแกรมคอมพิวเตอร์มีลักษณะเป็นธุรกรรมที่มีการคาบเกี่ยวกันระหว่างสัญญาหลายประเภทในสัญญาฉบับเดียวกัน จึงมีปัญหาว่าสิทธิหน้าที่ของคู่สัญญาควรเป็นไปในแนวทางเดียวกับสัญญาประเภทใดจึงทำให้สิทธิหน้าที่ของคู่สัญญาไม่มีความชัดเจนแน่นอน รวมถึงคู่สัญญาจะไม่ได้รับความคุ้มครองตามกฎหมายเมื่อเปรียบเทียบกับสัญญาที่มีกฎหมายกำหนดสิทธิหน้าที่ไว้อย่างชัดเจน วิทยานิพนธ์ฉบับนี้จึงมุ่งศึกษาเปรียบเทียบถึงเนื้อหาของสิทธิหน้าที่ตามสัญญาอนุญาตให้ใช้สิทธิในโปรแกรมคอมพิวเตอร์ที่มีความเหมาะสมและเป็นธรรมแก่คู่สัญญา รวมถึงศึกษาหลักเกณฑ์และวิธีการในการกำหนดสิทธิหน้าที่ของคู่สัญญาตามกฎหมายของประเทศสหรัฐอเมริกาและประเทศอังกฤษเพื่อนำมาปรับใช้ในการกำหนดสิทธิหน้าที่ตามสัญญาอนุญาตให้ใช้สิทธิในโปรแกรมคอมพิวเตอร์ในประเทศไทย ผลการศึกษาพบว่า ในประเทศสหรัฐอเมริกาและประเทศอังกฤษ มีการนำสิทธิหน้าที่ตามสัญญาซื้อขายและสัญญาให้บริการมาปรับใช้กับสัญญาอนุญาตให้ใช้สิทธิในโปรแกรมคอมพิวเตอร์ด้วย เนื่องจากเป็นสัญญาที่มีลักษณะใกล้เคียงกันพอที่จะปรับใช้หลักเกณฑ์อย่างเดียวกันได้อย่างสมเหตุสมผล โดยมีการปรับใช้ในสองลักษณะคือ การปรับใช้โดยอนุโลมโดยอาศัยการตีความเจตนาของคู่สัญญาว่ามีความประสงค์จะให้สิทธิหน้าที่ตามสัญญาเป็นไปในแนวทางเดียวกับสัญญาซื้อขายหรือสัญญาให้บริการ แล้วแต่กรณี และกำหนดให้คู่สัญญามีสิทธิหน้าที่อย่างเช่นเดียวกันกับสิทธิหน้าที่ตามกฎหมายของสัญญาที่มีความใกล้เคียงมากกว่า และต่อมาในประเทศสหรัฐอเมริกาและประเทศอังกฤษ ได้มีการตรากฎหมายฉบับใหม่เพื่อกำหนดสิทธิหน้าที่ของคู่สัญญาไว้เป็นการเฉพาะเพื่อขจัดปัญหาความไม่ชัดเจนแน่นอนจากการตีความสัญญาโดยศาลเป็นรายคดี ในประเทศไทย การปรับใช้สิทธิหน้าที่ตามกฎหมายลักษณะซื้อขายหรือเอกเทศสัญญาอื่นตามประมวลกฎหมายแพ่งและพาณิชย์กับสัญญาอนุญาตให้ใช้สิทธิในโปรแกรมคอมพิวเตอร์โดยตรงนั้น ไม่สามารถทำได้เนื่องจากสาระสำคัญของสัญญาแตกต่างกัน แต่อย่างไรก็ดีศาลไทยอาจกำหนดสิทธิหน้าที่ตามสัญญาให้เป็นไปในแนวทางเดียวกันได้โดยอาศัยการตีความสัญญาว่าตามเจตนาที่แท้จริงของคู่สัญญา และโดยการใช้หลักสุจริต คู่สัญญาต้องการให้สิทธิหน้าที่ระหว่างกันเป็นไปในแนวทางเดียวกับสิทธิหน้าที่ตามเอกเทศสัญญานั้น ศาลจึงบังคับสิทธิหน้าที่ระหว่างกันให้เป็นไปตามเจตนาอันแท้จริง

วิทยานิพนธ์ฉบับนี้ มีวัตถุประสงค์เพื่อศึกษามาตรการทางอาญาสำหรับการแอบอ้างถิ่นกำเนิดสินค้าของประเทศไทยในปัจจุบัน รวมทั้งศึกษาแนวคิด รูปแบบ และเนื้อหาของมาตรการทางอาญาสำหรับการแอบอ้างถิ่นกำเนิดสินค้าของต่างประเทศ เพื่อนำมาวิเคราะห์เปรียบเทียบและเสนอแนะแนวทางในการกำหนดมาตรการทางอาญาสำหรับการแอบอ้างถิ่นกำเนิดสินค้าที่เหมาะสมกับประเทศไทย จากการศึกษาพบว่า ปัจจุบันประเทศไทยประสบปัญหาการแอบอ้างถิ่นกำเนิดสินค้า ซึ่งก่อให้เกิดความเสียหายต่อภาพลักษณ์และเศรษฐกิจของประเทศ นอกจากนั้นมาตรการทางกฎหมายของประเทศไทยที่มีอยู่ยังไม่ครอบคลุมและชัดเจนเพียงพอที่จะนำมาปรับใช้กับรูปแบบการแอบอ้างถิ่นกำเนิดสินค้าที่เกิดขึ้นได้ทั้งหมด รวมทั้งไม่สามารถป้องปรามและลดปัญหาการแอบอ้างถิ่นกำเนิดสินค้าได้ เมื่อได้พิจารณามาตรการทางกฎหมายของต่างประเทศ ได้แก่ สมาพันธรัฐสวิส สาธารณรัฐสิงคโปร์ เขตบริหารพิเศษฮ่องกงแห่งสาธารณรัฐประชาชนจีน และสหรัฐอเมริกา พบว่า ได้มีการกำหนดมาตรการทางอาญาสำหรับการแอบอ้างถิ่นกำเนิดสินค้าไว้โดยเฉพาะ ซึ่งมีการบัญญัติฐานความผิดให้ครอบคลุมถึงการแอบอ้างถิ่นกำเนิดสินค้าในรูปแบบต่าง ๆ เช่น การปลอมหนังสือรับรองถิ่นกำเนิดสินค้า การใช้หนังสือรับรองถิ่นกำเนิดสินค้าปลอม และการใช้เครื่องมือโดยมิชอบด้วยกฎหมายเพื่อใช้ในการปลอมหนังสือรับรองถิ่นกำเนิดสินค้า เป็นต้น ตลอดจนมีการใช้มาตรการทางอาญาร่วมกับมาตรการทางกฎหมายอื่น ๆ เช่น มาตรการลงโทษทางแพ่ง มาตรการทางปกครอง เป็นต้น ด้วยเหตุผลดังกล่าวข้างต้น ผู้เขียนวิทยานิพนธ์จึงขอเสนอให้ประเทศไทยมีการกำหนดมาตรการทางอาญาสำหรับการแอบอ้างถิ่นกำเนิดสินค้า ด้วยการบัญญัติเป็นกฎหมายเฉพาะ และนำมาตรการทางกฎหมายอื่น ๆ มาใช้ประกอบกับมาตรการทางอาญาดังกล่าว เพื่อให้เกิดประโยชน์สูงสุดในการป้องกันและแก้ไขปัญหาการแอบอ้างถิ่นกำเนิดสินค้าในประเทศไทย

The main purpose of this study was to propose the guidelines for stakeholders’ accountability in Cambodian students’ reading literacy. By using, two research instruments — face-to-face questionnaire with 5 liker-scale and reading task which accounted by students only— the total of 29 primary school principals, 41 school teachers, 427 parents/caregivers and 427 students who were studying at grade 5 and 6 were the sample size. Ferroresonance phenomena often appear in any typical distribution systems consisting of drop-out fuse cutouts, overhead lines or power cables and a distribution transformer. Single-pole energization and fuse operation may lead to ferroresonance overvoltages, resulting in electrical equipment damage. The occurrence of ferroresonance depends on several factors including size and length of line, power rating and type of distribution transformer. This thesis presents two case studies involving ferroresonance phenomena. The first case studies the lengths of overhead lines and underground cables which create enough capacitive reactance for ferroresonance. Thailand is one of the top broiler exporters. Red blood cell (RBC) and white blood cell (WBC) counting is one of the most basic methods for health screening process. Because the mammalian and avian blood is different, the mammalian blood analyzing techniques cannot be used, so the counting is done manually. This thesis proposes an automatic counting method for avian RBCs and heterophils, the most common type of avian WBC. High PV penetration reduces stability tolerance due to the lower of system inertia and system ramp capability. To handle higher PV penetration issues, the system operator and PV owners should consider the operation improvement. For the system operator, critical system ramp capability with respect to PV penetration ratio can be useful to determine the lower bound of system ramp capability for handling N-1 contingency and expected disturbances. This study evaluated the influence of a curved root canal on the retreatment efficacy of root canals sealed with bioceramic sealer. 60 mandibular molars were divided into 4 subgroups of severely curved canal filled with AH Plus, slightly curved canal filled with AH Plus, severely curved canal filled with BioRoot RCS and slightly curved canal filled with BioRoot. Two weeks after root canal obturation, retreatment was performed with WaveOne Gold Primary and ProTaper Next X3 following with passive ultrasonic irrigation. English, French and Thai are different in that past tense inflectional morphology is obligatory in English and French, but not in Thai. The study aim (1) to develop oracy skills instruction in a blended-learning environment, (2) to investigate the effects of students’ metacognitive awareness after implementing the oracy building instruction via blended-learning environment, (3) and to investigate the students’ opinion towards using blended-learning environment. Twenty- nine high school students in Rayong were chosen as the sample group.
