When tort judgments exceed the assets of tortfeasors and the tort victim has first-party insurance for a portion of the loss suffered, the question arises as to how the recovery from the tortfeasor should be divided between' the tort victim on the one hand and the insurer via its rights of subrogation on the other. A common view among the courts and legal commentators is that the insured should be made whole before the insurer recovers subrogation. This paper employs simple models of optimal insurance contracts to show that the opposite rule will often be optimal. Accordingly, there is little …

The Minnesota innovation, "Extended Jurisdiction Juvenile Prosecution (EJJ)," allowed judges simultaneously to impose a delinquency disposition and an adult criminal sentence, the execution of which the judge stayed pending successful completion of the delinquency sentence. Podkapacz and Feld analyze the implementation of Minnesota's new EJJ blended sentencing law in Hennepin County, the largest metropolitan county in the state.

Edward Bartoli, a Chicago attorney, was recently suspended by the Illinois Supreme Court for aiding nonlawyers in the unauthorized practice of law. Bartoli's argument? He claimed that he was merely running a multidisciplinary practice ("MDP"). The regulations governing such activity would soon change, claimed Bartoli, and thus he was only, "ahead of his time." Because of the apparent inevitability of MDP-reform, attorneys like Bartoli are contemplating the creation of, and participation in, multidisciplinary practices throughout the United States. Professor Robert D. Putnam's work is, in many respects, the contemporary companion to Democracy in America.' It comprehensively surveys and tests common presumptions held about our democracy with apparently very reliable quantitative data. Until recently, a work of this depth and breadth has been unavailable. No company can operate without a supply chain. recent years have seen change in the way many companies manage their supply chains - holistically rather than as a series of separate pieces. Manufacturers have taken the lead in improving supply chain management, but now the fast-growing service industry is adopting these principles. The objective of this study is to examine the association between nonpension postretirement benefits (NPPRB) liability and systematic risk (beta) during the period of 1989 through 1991. This study has identified a sample of Statement of Financial Standards (SFAS) 106 adopters who were required to disclose the estimated NPPRB liability no later than calendar year 1993. Beta is modeled as a function of unlevered beta, debt, the NPPRB liability and equity. We find that investors recognized the NPPRB liability prior to 1992 and used this information in the assessment of systematic risk.

The College Retirement Equities Fund (CREF) will celebrate its 50th anniversary in 2002. It was the first variable annuity to focus its investments on common stock equalities, designed to help investors overcome problems of inflation. A study of it history show: When used in combination with a traditional annuity, such as TIAA, CREF has been an effective vehible for developing additional retirement dollars at a reasonable risk level. An LiBr-H2O chiller was modified to utilize heat sources from natural gas combustion and/or from hot fluid. This was achieved by replacing the original gas-fired generator with a dual-fired generator. Steam was used as the hot fluid. The generator of the chiller can be powered by each source separately or both sources simultaneously. Experimental investigation was performed to obtain capacity and coefficient of performance (COP) of the original chiller and the modified chiller. During the experiments, the modified chiller was powered solely by steam, natural gas, or both. There was a significant increase in COP and capacity when …

This past January the U.S. Supreme Court held that the Clean Water Act (CWA) did not authorize the federal government to prohibit a landfill operator from filling isolated ponds on its property merely because the ponds were used as habitat by migratory birds. The National Association of Home Builders claimed that the decision in Solid Waste Agency of Northern Cook County v. U.S. Army Corps of Engineers (SWANCC) was "a major legal victory for home builders and other private property owners." In this paper we describe e-SpatialTM technology, comprising an innovative software solution for deploying integrated web-based spatial applications within Oracle 9i Database environments. The two main components of the solution are the iSMARTTM database development technology and the i-SpatialTM Information Server (iSIS). This technology allows Oracle users to build and deploy both spatially enabled and standard Internet applications without requiring any application-specific GIS source code. It can be deployed on any Oracle supported hardware platform and on any device running a Java Virtual Machine, thus providing full support for wireless, PDAs and other mobile devices. The objective of this research is to improve the atomic oxygen resistance of KaptonTM, a polyimide (PI) made from pyromellitic acid dianhydride (PMDA) and 4,4'-oxydianiline (ODA), while retaining or enhancing the desirable properties of the pure polymer. Toward this end, zirconium-containing complexes and polymers were used to make composites and blends. Tetra(acetylacetonato)zirconium(IV), Zr(acac)4, which is commercially available, was identified as the best zirconium-containing complex for enhancing the atomic oxygen resistance of polyimide composites of the 10 complexes screened. Films prepared from the commercially-available polyamic acid (PAA) of PMDA-ODA (DuPont) have good uniformity, flexibility, and tensile strength. A 24-layer 10% (mol) …
