Allocating Antitrust Decisionmaking Tasks, Frank H. Easterbrook Jan 1987

Allocating Antitrust Decisionmaking Tasks, Frank H. Easterbrook

Articles

Antitrust law has become a branch of industrial organization, itself a branch of economics. Today judges and the antitrust enforcement agencies search at every turn for economic arguments pro and con. This is a staple in academic thought as well-and it makes little difference what stripe. Those who could be called hawks employ economic argument, just as do those who see less scope for antitrust do. Most of the papers delivered at this symposium, like the merger guidelines issued by the National Association Attorneys General (NAAG),' are grounded in economic rather than political theories. More economics lies ahead. But what …

Guerilla Decisionmaking: Judicial Review Of Risk Assessments, William H. Rodgers, Jr. Jan 1987

Guerilla Decisionmaking: Judicial Review Of Risk Assessments, William H. Rodgers, Jr.

Articles

This paper describes four types of uncertainty confronted by decisionmakers undertaking risk assessments. It then discusses individual and institutional responses to uncertainty; these include both formal attempts to acquire more information, and pragmatic efforts to isolate and act upon salient considerations. The tendency of decisionmakers to narrow the agenda and search for a decisive datum or metaphor is called guerilla decisionmaking. Courts oversee agency decisions by techniques known widely in the legal community as the hard-look doctrine. This doctrine is defined, and the case law is used to illustrate how courts insist upon identification of salient risk-assessment factors and the …

Economics And Law: Two Cultures In Tension, James Boyd White Jan 1987

Economics And Law: Two Cultures In Tension, James Boyd White

Articles

I want to preface my remarks by saying something about the kind of talk this is going to be. As my title says, I shall speak mainly about economics and law, which I shall examine as forms of thought and life, or what I shall call cultures. With law, about which in fact I shall speak rather briefly, I am naturally familiar by training and experience. But with economics I am familiar only as an observer as a general reader who reads the newspaper, as a lawyer who has followed a little of the law and economics literature, and as …

Optimum Shape Synthesis Of Maximum Gain Omnidirectional Antennas, Frances J. Harackiewicz, David M. Pozar Feb 1986

Optimum Shape Synthesis Of Maximum Gain Omnidirectional Antennas, Frances J. Harackiewicz, David M. Pozar

Articles

Using characteristic mode shape synthesis, some antenna surfaces and their current distributions are found which produce maximum realizable gain for rotationally symmetric omnidirectional antennas. The same shape synthesis method fails to produce antennas which have maximum endfire gain.

A Novel Technique To The Solution Of Transient Electromagnetic Scattering From Thin Wires, Sadasiva Rao, Tapan Sarkar, Sohail Dianat Jan 1986

A Novel Technique To The Solution Of Transient Electromagnetic Scattering From Thin Wires, Sadasiva Rao, Tapan Sarkar, Sohail Dianat

Articles

Previous approaches to the problem of transient scattering by conducting bodies have utilized the well-known marching-on-in-time solution procedures. However, these procedures are very dependent on discretization techniques and in many cases lead to instabilities as time progresses. Moreover, the accuracy of the solution procedure cannot be verified easily and usually there is no error estimation. Recently an alternate approach to the solution of transient scattering by thin wires was presented based on the conjugate gradient (CG) method. In this procedure, space and time are discretized independently into subintervals and the error is minimized iteratively. Unfortunately, this procedure is very slow, …

Adaptive Spectral Estimation By The Conjugate-Gradient Method, Huanqun Chen, Tapan Sarkar, Sohail Dianat Jan 1986

Adaptive Spectral Estimation By The Conjugate-Gradient Method, Huanqun Chen, Tapan Sarkar, Sohail Dianat

Articles

This paper proposes an alternative technique for adaptive spectral estimation. The new technique applies the method of conjugate gradient, which is used for iteratively finding the generalized eigenvector corresponding to the minimum generalized eigenvalue of a semidefinite Hermitian matrix, to the adaptive spectral analysis problem. Computer simulations have been performed to compare the new method to existing ones. From the limited examples presented, it is seen that the new method is computationally more efficient at the expense of more core storage. Also, this method is effective for small data records and can implement noise correction to yield unbiased spectral estimates …

In Step With The Times: Law Library Keeps Up With Changes In Legal Research, Margaret A. Leary Jan 1986

In Step With The Times: Law Library Keeps Up With Changes In Legal Research, Margaret A. Leary

Articles

Change is constant in legal research. Plucknett's work describes, for example, the modem textbook replacing published case reports as the most important form of legal literature. More recently, A.B.W. Simpson has argued that the law review article has displaced the treatise. Apart from these changes, the law itself has continued to embrace concepts from other disciplines and deal with facts and methodologies of an increasingly technological society.

Judicial Criticism, James Boyd White Jan 1986

Judicial Criticism, James Boyd White

Articles

Today I shall talk about the criticism of judicial opinions, especially of constitutional opinions. This may at first seem to have rather little to do with our larger topic, "The Constitution and Human Values," but I hope that by the end I will be seen to be talking about that subject too. In fact I hope to show that in what I call our "criticism" our "values" are defined and made actual in most important ways.
